They passed a resolution not to issue permits I for sprinkling . This action was taken as a result of Jerry Boucher ' s concerns and recent discussions at the Public Safety Weekly meeting having to do with water shortages . Ion July 6 and 7 , According to Boucher , well #2 ran continuously for a 24 :dour period and well #4 ran continuously for 16 hours. In addition , his last checks 1 suggested that the aquifer was down 16 feet . Jerry said that we were presently using 25 , 000 gallons an hour from the downtown water tower causing the excessive running of the wells. I Our concern centered on the possibility of a breakdown on one of the two above wells . It was and is staffs recommendation Ito strictly enforce the odd/even watering restrictions and to stop the issuance of special permits. It was not our recommendation nor the Public Safety Commissions to suggest a 1 total sprinkling ban . It is our feeling that we can handle the potential problems with strict enforcement of the existing restrictions. 1 On the other hand , Jerry Boucher recommends that at a minimum we implement a system eliminating sprinkling between the hours of 6 P.M. and 6 A.M. He suggests that this would give I the wells time to replenish the water tower without overburdening them. As a result of our recent hot and dry spell, City water pumps have been running con- tinously, with a serious lowering of the water level . Mr . Boucher did request assistance in enforcing the current odd/even 1 system, and I have taken a number of steps to do this ( I have requested all City personnel to distribute warning notices to violators; I have requested enforcement personnel to take 1 appropriate steps; and, I have requested the newspapers to print articles concerning the water shortage ) . On July 13, 1989, the president of the Cimarron Homeowner ' s Asso- ciation came into City Hall to request another sprinkling permit for their 156 units, as their initial 8 week sprinkling permit had expired . Because this request came in the midst of our ' current concerns, I did advise the applicant that I would be taking this to the Public Safety Commission for their input that evening. 1 Attached please find copies of the April 24, 1989, City Council meeting minutes, which reflect the approved resolution establishing an odd/even watering ban. You may recall that when 1 the Public Safety Commission initially endorsed our recommen- dation to request an odd/even watering ban in Chanhassen, I reported that my research indicated such a system would provide 1 sufficient watering for our City. The City Council, however, felt it would be appropriate to pro- f vide permits for new seed/sod . We did proceed with such a system, and it worked out fairly well . I understand that the receptionists at the front desk at City Hall have been getting fewer and fewer requests for limited permits as the summer has progressed . In ' reviewing the discussions for the odd/even watering ban at the April 24, 1989, City Council meeting, you will see that the spe- 1 I 11 Jim Chaffee, Public Safety Director ' July 19, 1989 Page 2 cific concern expressed by the representative from the Cimarron Homeowner 's Association was to get their seed established . In speaking with the applicant from Cimarron Homeowner ' s Association this past week, I understand that at this point the purpose of the request is more convenience as they have someone who comes out and moves hoses about the property. I understand that they also put in some additional seed this summer . At the July 13, 1989, Public Safety Commission meeting, two motions were made, passing unanimously. First, the Commission approved the motion that no additional limited watering permits be issued, in light of the information obtained from Mr . Boucher . Secondly, they approved the motion to not grant the additional permit to Cimarron Homeowner ' s Association. In supporting Mr . Boucher 's concern, Fire Chief, Dale Gregory and City Engineer, Gary Warren agree that it is important that we stay with the odd/even restrictions . This provides people with plenty of opportunities to keep their lawns watered, while, hope- fully, providing the City with sufficient water supplies so that , we do not have to impose additional restrictions . While the odd/even system may cause some inconvenience for a small number of residents, a water shortage, which we are leading ourselves toward, would cause everyone an inconvenience, par- ticularly if a fire were to be fought with insufficient reserves . My recommendation, which is supported by Mr . Boucher, Chief Gregory, and Mr . Warren, is that we strictly adhere to the odd/even system for the remainder of this summer . I am holding the two permit applications I have received this past week until this issue can be discussed by the City Council . Also attached please find a copy of the tenantive agenda for July 24th with item No . 8, administrative presentations being a consideration for a total ban. The odd/even system remains in effect, so you are certainly able to ' water on this basis . I have requested that this be discussed at the City Council meeting on July 24 , 1989 . Please understand that this measure is being taken in response to our need for maintaining sufficient water supplies in Chanhassen. 1 v. An officer going by will see the sprinkler. If your home is even and,it's not an even day, they may very well stop and ask you to turn it off. If you would demonstrate to them that you do have a well, that will take care of your problem. Councilman Johnson: I move approval of an even/odd watering ban effective May 1, 1989 with a provision for permits for special purposes. Councilman Workman: I'll second that. - Resolution #89-60: Councilman Johnson moved, Councilman Workman seconded to ' approve a resolution establishing an odd/even water ban effective May 1, 1989 with a provision for permits for special purposes. Jo Ann Olsen: Country Suites, the first portion is rezoning of a portion of the property which is zoned BG to CBD. The property is currently zoned BG. Market Blvd. now separates that portion from the remaining parcel of BG so we're just cleaning up the site. Making the whole hotel property under one zoning district and recommending approval of the rezoning. The Planning Commission did recommend approval of rezoning a portion from BG to CBD. Mayor Chmiel called the public hearing to order on the rezoning. Mayor Chmiel moved, Councilwoman Di.mler seconded to close the public hearing. All voted in favor and the motion carried. The public hearing was closed for the rezoning issue. ' Councilwoman Di.mler: I talked to Steve Hanson this afternoon and he assured me that this is just kind of a housekeeping item and I don't see any problem with passing it. Councilwoman Dimler moved, Councilman Workman seconded to approve Rezoning ' Request #89-1. All voted in favor and the motion carried. VACATION OF UTILITY, DRAINAGE AND RIGHT-OF-WAY EASEMENTS. ' Councilman Johnson: This it was published as a regular Council item as item 12(a) and then moved to the Consent Agenda. The Consent Agenda is ' non-controversial. Watering bans, I can't hardly see as a non-controversial item and I would like to try to give the public any opportunity for public input if anybody came here tonight to address the watering ban. I'd also like to just move it back to 12(a) because that's where people believe it's going to be ' unless there's somebody here right now that'd like to do it. But if somebody was coming to address i.t, they wouldn't come at 7:00 being item 12(a) . Maybe 11:00. Darlene Loving: My name is Darlene Loving and I'm on the Board of Directors of Cimmaron Homeowners Association. My concern as far as watering ban is that due - ' to the ban last year, we have 12 1/2 acres of mowable lawn. Because of the watering ban we lost, totally lost 5 1/2 acres of lawn. It was dormant seeded last fall in October. At this point in time, it will be necessary for us to water that 5 1/2 acres daily in order to have the dormant seeding to take hold ' and whether it would be necessary for us to have a special permit or what but we would not be able to water every other day. We were advised by the University of Minnesota that we would have to water every day and keep it moist until it ' does take hold so that is major concern for our association. We spent approximately $10,000.00 in dormant seeding and we'd certainly hate to see that large sum of money go down the drain so the consideration for that would be appreciated. Don Ashworth: We are proposing an odd/even ban. However, rmi.ts would Pe u d be issued by the City. Anyone in a similar situation as the lady who just spoke should contact our Public Safety Department and they will issue a permit for persons who again have new sod or new plant materials. ' Al Krueger: My name is Al Krueger. I live at 1600 Lake Lucy Road and my only question on the watering ban, does this cover wells? I am not serviced by city water and am I governed by a watering ban? Don Ashworth: Jim, how did we respond to that this past year? Jim Chaffee: It does not cover private wells.
