The drop off center was located at the Public Works Building and was open the second and fourth Saturday of each month. The drop off center was attended by volunteers (boy scouts, etc. ) who received $75 and collected clear glass , aluminum and newspapers. The center was funded by the City and a grant from Carver County. The center averaged a participation of about 50 households/Saturday and was therefore not reaching a large percentrage of housesholds in Chanhassen. ' The total cost of the drop off center has not been calculated yet but will range between $5 , 000 - $6 ,000 . It was felt that the drop off center was not cost effective and that a curbside program should be investigated. In October, 1988 , staff contacted several waste haulers to receive estimates for curbside pickup service twice a month for the entire City of Chanhassen. The estimates ranged from $20, 000 to $25 ,000 . The city budgeted $30 ,000 for 1989 recycling pro- jects . Carver County has stated they may not have money in 1989 to provide another recycling grant. Therefore, the City may have to bear the whole cost. 1 The most appropriate type of recycling program for Chanhassen should be thoroughly investigated prior to any long term committ- ment being made by the city. In 1989, staff will be organizing a committee to work on Chanhassen recycling programs . The commit- - tee should consist of Council and Commission members, private citizens and representatives of waste haulers . The purpose of the committee will be to determine what type of recycling program is best for Chanhassen (curbside, drop-off center, etc) , who should provide it (one contract vs . several contracts by sec- tioning off areas of the city) and whether all trash pickup should be under a city wide contract administered by the city. 0 6) r-� o cr.-t c/`:.1 4 II Don Ashworth , February 6 , 1989 Page 2 I The resolution of these issues will take some time and in the interim staff would like to still provide recycling oppor- tunities for Chanhassen residents . Staff is recommending that the City receive bids for a one year contract for city wide curb- side pickup. This will allow the city to provide recycling to Chanhassen residents while determining the best long term recycling program for Chanhassen. Attachment #1 is the specifi- cations for bids for curbside recycling services. ' RECOMMENDATION Staff recommends that the City Council adopt the following 1 motion: "The City Council approves of the plans and specifications for ' curbside recycling as shown in Attachment #1 and authorizes the publication for bids for curbside recycling service. Letters from Recycle America/Admiral Waste/Chaska Sanitation. 1 Manager' s Comments : Although less expensive, the option of con- tinuing the drop-off center at the Public Works property cannot be recommended. Initial surveys showed that drop-off centers are the least effective and most difficult type of recycling program. Those predictions were accurate. Security for the property was difficult, i .e. although no damage or loss occurred, we were susceptable to such; inadequate facilities were available to workers ( restrooms, shelter, etc. ) ; site abuse did occur (drop-off of tires and batteries at times the center was closed) ; continuous re-handling of recyclables because they were left at the gate or around the binds ; and, most importantly, par- ticipation was far less than can be achieved via other programs, i .e. curbside pickup. This office endorses the recommendation of our planners . Again, the program as being recommended was included in the 1989 budget. ' I 1 II ' REQUEST FOR BIDS FOR CURBSIDE RECYCLING SERVICES A. BACKGROUND The City of Chanhassen is interested in establishing twice-per-month curbside collection of recyclables in the City in 1989 as a service to our residents . This program will be administered and funded by ' the City. / B . DESCRIPTION The City is interested in providing curbside recycling service to all residential properties within e ►, ty. The total number of house- holds to be serviced is abou• 3 , 398 A map showing the service area ' is attached for the convenien. - the bidder. The proposed length of contract considered in this bid shall be for one year, beginning April 1 , 1989 to January 31 , 1990 . Collection will be from the curbside. At a minimum, collection should be twice monthly for newspaper, glass containers, cardboard, bi-metal, aluminum and tin cans . At the bidder' s option, other materials can be added such as oil, batteries , and other types of paper and metal. The entire area should be picked up on one day, but a reasonable schedule will be considered if this is not feasible for the bidder . It is requested that each bidder also provide an alter- native bid for once-per-month curbside collection. Collection vehicles must be in good working condition and must be plainly marked with the contractor' s name and logo ( if a logo has been established) . ' Collection contractors must provide information for all materials collected. The required information includes original truck scale tickets or market receipts showing the name of the collection ' contractor and the market, date of delivery to market, and the net weight of materials . The insurance and bond requirements which will have to be met for the collection contract are as shown on the attached list. The City retains the right to reject and and/or all bids, or to nego- ' tiate with any number of low bidders . C. MATERIALS TO BE SUBMITTED BY BIDDERS Bids must be received by 2 : 00 p.m. on at City Hall, 690 Coulter Drive, Chanhassen, MN 55317 1 All bids must contain the following items : 1 . Name, address, telephone number and contact person. I 2 . Amount of bid for the area outlined above, with details of any option which may be presented by the bidder . I 3 . A description of how the curbside service will be provided including: I a. Collection will be done twice per month per household. b . Total number of days required to provide service to area ' described above. c . A list or explanation of current collection schedules for garbage collection or recycling contracts within the Twin Cities metropolitan area. d. Equipment to be used for curbside service, such as trucks , , intermediate processing vehicles and equipment, household containers , etc. e . Material preparation instructions that will be given to residents . 4 . A description of procedures to be followed for handling missed pickups or customer complaints . At a minimum, the following should be addressed: a. A phone number available until 6 : 30 p.m. on pickup day. b . A procedure for pickup that evening or the following day I before 3 : 00 p.m. c . Availability of vehicles to handle missed pickups . ' ' 5 . A description of how collection tonnages will be verified and how records will be kept for reimbursement. This description should 11 include: a. Weighing receipts . b. Market receipts showing name of collection contractor and market and the date of delivery to market and the type of material. 6 . A statement that all trucks and equipment will be maintained in good working condition , be marked with the contractor' s name and recycling logo and be clean and aesthetically pleasing. , 7 . A description of any innovative provisions to your bid such as the inclusion of specialized equipment or bins , the collection of materials other than those listed, or any other provisions which would make your bid unique. -2- 1 1 " . Thorughout the duration of the contract, bidder' s relationship to ' the City shall be that of an independent contractor and nothing herein shall be construed to imply an employee status . Bidder understands that he is responsible for establishing the proper employer/employee relationship with his own employees , including, but not limited to, payment of his employee' s wages , --ith proper deductions for social security and State and Federal income tax, and including the procurement of the proper Worker' s Compensation coverage for employees . 10 . CONTRACT AGREEMENT BETWEEN CITY OF CHANHASSEN AND FOR RECYCLING SERVICES I I THIS AGREEMENT is made this day of , b 19 between the CITY OF CHANHASSEN (hereinafter "City") , and (hereinafter "Contractor") . WITNESSETH: WHEREAS, the City supports curbside recycling and desires Ithat it be available to its residents; and WHEREAS, the City supports curbside recycling as part of Ian overall landfill abatement program; and WHEREAS, Carver County has funding available for curbside recycling; and IWHEREAS, the Contractor has submitted a proposal for curbside recycling to the City. INOW, THEREFORE, the City and Contractor mutually agree as follows in consideration of the mutual promises and covenants contained herein: ' 1. DEFINITIONS. I A. "Service Area" means the City of Chanhassen (see attached map) : NOTE: All boundaries, unless otherwise noted, fall on the center of boundary streets such that they include residents on the City half of the street. B. "Recyclable Materials" means newsprint, cardboard, glass, mixed aluminum and bimetal beverage containers, other aluminum, tin food cans, and other materials as mutually agreed upon by the City and the Contractor. C. "Recycling Collection" means the taking up of all ' recyclable materials accumulated at residential properties and the transporting of the recyclable materials to a specified processing site or market. ' 2. PAYMENT. I A. The City will compensate the Contractor for the collection of recyclable materials from residential units as described in Section 3 . I I • 1 B. The City shall reimburse the Contractor, on a 1 monthly basis, $ per month. C. The Contractor must invoice the City monthly and indicate tonnages of each material recycled from the area for the billing period. Truck scale receipts (for glass and metals) and market receipts (for newsprint and cardboard) must be attached to this invoice. D. The City will provide the Contractor with maps of the City, noting areas for recycling collection and areas where recycling collection is not desired and/or necessary. 3. OBLIGATIONS - CONTRACTOR A. Service. The Contractor shall provide twice-a- month collection services for all recyclable materials. B. Contractor's Operation. The Contractor shall establish and maintain in a location approved by the City, an office with continuous supervision for accepting complaints and , customer calls. The office shall be in service with continuous supervision during the hours of 7: 00 a.m. until 7: 00 p.m. on all days of collection as specified in this Agreement. The address and telephone number of such office and ten (10) days prior notice of changes shall be given to the City in writing. The address and telephone number of this office as of the execution of this Agreement is: 1 ( ) - C. Collection. 1. The Contractor shall collect all recyclable materials on the following days: 2 . Complaints on service will be taken and collected by the City and the Contractor. The City will notify the Contractor of all complaints it receives. The Contractor is responsible for all corrective action. All complaints shall be answered by the Contractor courteously and promptly. 3 . Whenever the City or a resident notifies the 1 Contractor of locations which have not received scheduled service, the Contractor is required to service such locations by 7:00 p.m. the following day. Penalty for not servicing an area or household shall be $2. 00 per household occurrence. 4. Recyclable materials shall be prepared as follows: Newsprint and Non-Glossy Paper: Place in paper bags or cardboard boxes or tied in bundles. 1 -2- I . • Glass: Rinsed and placed in paper bags or cardboard boxes. Metals: Rinsed and placed in paper bags or cardboard boxes. ' Cardboard: Flattened and placed in paper bags or tied in bundles no larger than three (3) inches in length, width, or depth. 5. Containers in which recyclable materials have been stored shall be placed on curbside in front of the resident's property by 7: 00 a.m. on the scheduled days of collection. 6. All recyclable materials placed for 1 collection shall be owned by and be the responsibility of the occupants of residential properties until they are handled by the Contractor. Upon collection of the containers and recyclable materials by the Contractor, the recyclable materials become the property and responsibility of the Contractor. 7. Recyclable materials deemed unacceptable by the Contractor according to the preparation procedures in Subsection 4 shall be collected on the first occurrence by the Contractor. Each time materials are incorrectly prepared, the Contractor shall leave at the residence a written notice form, prepared by the City, which explains why materials were not collected. The address and the reason why materials were not collected shall be reported to the City the following day so that I the City can notify the resident of the proper procedure. Subsequent instances of unacceptable recyclable materials may be rejected; however, this shall be reported to the City. 8. The Contractor shall not landfill, incinerate or make fuel pellets out of the recyclable materials. ' 9. The Contractor's employees shall leave for the residents' re-use any containers marked "SAVE". These containers, once emptied, shall be returned to curbside. Any 1 spills will be cleaned up immediately. D. Vehicles. Il. The Contractor's vehicles shall be marked with the name of the Contractor. 2. The Contractor shall maintain all trucks and equipment in good working condition. The Contractor's trucks shall be clean and aesthetically pleasing. 4. TERM. The term of this Agreement shall be from April 1, 1989 to March 31, 1990. -3- 1 5. CANCELLATION. Either party may cancel this Agreement , at any time upon thirty (30) day written notice to the other party. In such event of termination, the Contractor shall be entitled to reimbursement for those expenses incurred up to the I termination date provided the expenses have been incurred by providing the services in Section 3 . 6. DEFAULT. Any of the following shall constitute , default on the part of the Contractor: A. The failure of the Contractor to provide service 1 in a manner consistent with Section 3 . B. The failure of the Contractor to deliver glass and metals to the recycling centers. C. Falsifying any records or information required under this Agreement and/or failure to supply the information required in Subsection 2C above. D. Failure to maintain current performance bonds and insurance policies as required by Subsections 7B and 7C. 7. GENERAL CONDITIONS. 1 A. All services and duties performed by the Contractor pursuant to this Agreement shall be performed to the satisfaction of the City and in accordance with all applicable federal, state, and local laws, ordinances, rules, and regulations as a condition of payment. Contractor agrees to comply with Minnesota Statute § 181.59, relating to non- discrimination. B. The Contractor shall post a bond in a form approved by the City Attorney of not less than $ (approximately three (3) months payments) to be made available to the City in the event of the Contractor's inability to execute the Contractor's obligations set forth by this Agreement. , C. The Contractor must obtain and upon request, provide the City with a certificate of insurance indicating the following minimum levels of insurance coverage are in force: Workman's Compensation Insurance Statutory Contractor's Public $ 500, 000 each person Liability Insurance $1, 000, 000 each accident I Property Damage $ 500, 000 each accident $1, 000, 000 aggregate -4- 1 Automobile $ 500, 000 each person Public Liability $1, 000, 000 each accident ' Property Damage $ 200, 000 each accident D. The Contractor shall at all times be an 1 independent contractor and shall not be the employee of the City for any purpose. The City shall not be responsible for the payment of any taxes, either federal or state, on behalf of the Contractor, nor shall the City be responsible for any fringe benefits. No civil service or other rights of employment will be acquired by virtue of Contractor's services. E. The Contractor agrees to defend, hold harmless, and pay on behalf of the City and its officials, agents, and employees from any and all liability, loss or damage they may suffer as a result of demand, claims, judgments, or costs, arising out of or related to the Contractor's negligent actions or failure to act in performance of this Agreement. ' F. All data collected, created, received, maintained or disseminated for any purpose in the course of this Agreement is governed by the Minnesota Governmental Data Practices Act, 1 Minnesota Statute Chapter 13 (1984) , or any other applicable state statute, any state rules adopted to implement the act, as well as federal regulations on data privacy. The City agrees to abide by these statutes, rules, and regulations. G. All books, records, documents, and accounting procedures and practices of the Contractor relative to this Agreement are subject to examination by the City, the County, and the State Auditor, as appropriate, in accordance with the provisions of Minnesota Statute § 16B. 06, subd. 4 (1984) . H. Any amendments to this Agreement shall be valid only when reduced to writing and duly signed by the parties. We would also, however, like to offer a few suggestions for your consideration. I To maintain high participation, we recommend that Chanhassen specify weekly recy- cling collection. Our experience shows that the convenience of weekly collection ensures high participation and fulfillment of recycling goals. For example, if collection is twice monthly residents must remember that the first and third Wednesdays are for recycling, and during five-week months, they must store materials for three weeks instead of two. In contrast, weekly collection gives residents the opportunity to develop a regular recycling habit. Residents that miss twice-monthly pickups often find it very in- convenient to store a four-week accumulation of recyclables. Newspapers, in parti- cular, can pile up rapidly. Monthly or twice-monthly recycling service may initially appear to be less expen- sive, but in the long run, such programs are actually quite costly: Because they recycle far fewer tons, the cost per ton recycled is much higher than comparable weekly programs. A program that saves money on the front end but does not meet its goals cannot be considered successful. We also recommend that Chanhassen not require that the entire City receive service on a single day. Single-day service would require four or more trucks. Four- or five-day service, in contrast, would require just one truck. Smaller recycling companies are unlikely to have enough excess truck capacity to provide single-day service. If they plan to buy new trucks, the entire capital cost may be reflected in their bids. Multiple-day service, in contrast, allows all companies to bid on an even playing field. Finally, single-day collection may hurt the service Chanhassen receives. The high capital cost required by the contract will encourage a contractor to stretch scarce capital dollars. Consequently, a company may try to get by with four trucks instead of five and then push the trucks that much harder. Truck breakdowns and problems are likely--and Chanhassen's service will suffer. I also didn't receive a map with this information but, I've got a good idea on how large ' of an area Chanhassen is. Below are some questions I have on recycling. Could you please send me future information? ' 1. Has Chanhassen considered certain drop-off stations rather than curbside service? 2. Have you considered letting every licensed garbage hauler controlling their on accounts, such as Scott County has just started? 3. Have you considered splitting up certain sections to collectors rather than just one company? 4. Is the City of Chanhassen definitely going this route or are you looking for input from the hauler? What is the residents thoughts of this? 5. Are you mandating that residential accounts have to recycle or just suggesting this?
