This is shown on the attached excerpt from the approved feasibility study. As the Council is no doubt aware, Eckankar has made application to the City for construction of a church on this 175 acre site. This I storm water detention pond is intended to serve the Eckankar pro- perty as well as those properties indicated in the feasibility study. 1 The West 78th Street Detachment plans and specifications are nearing completion and are scheduled to be in front of the Council for approval on March 13, 1989. It appears that the I Eckankar submittal has been scheduled for review by the Planning Commission at its March 1, 1989 meeting. I It is our desire, and we have every good intention of obtaining the storm water detention pond easement from Eckankar without having to condemn this property ( see letter to Eckankar) . The 1 rough grading and subgrade correction work has already been completed for the realignment as a part of the James development work for West Village Heights Second Addition. It is anticipated that Mr. James will aggressively pursue construction of his I retail complex this spring; and as a result, our roadway work and utility work, in particular the storm sewer improvements, needs to be ready for construction with the opening of the spring Iconstruction season. Without the construction of the storm water retention pond on the I Eckankar property, changes would need to be made to the develop- ment plans for storm water management for this area which no doubt would result in detrimental impacts to the Burdick and James properties to accommodate this runoff . i sr s ri lii Don Ashworth February 8 , 1989 II Page 2 As mentioned earlier, we fully intend and believe that acquisi- 1 tion of this ponding site will result from the negotiations with Eckankar as a part of their site improvements . However, since it II is unknown at this time as to the reception that the Eckankar application will receive from the Planning Commission and the Council and since the "quick-take" condemnation process normally results in a 120-day cycle, it is important that we initiate the ' quick-take condemnation process at this time to protect our options and guarantee that we will have access to this property when needed this spring. It is therefore recommended that the City Council authorize the initiation of condemnation proceedings for the Eckankar property I for the storm water detention pond area as indicated on the attachment to this memo and that the City Attorney prepare the necessary documents for initiating these proceedings. It is understood as a part of this recommendation that staff will con- tinue to negotiate with Eckankar to hopefully acquire this pro- perty without the need for condemnation. Attachments 1 . Box 3100 Menlo Park, CA 94026 Re: Registered Land Survey No. 88 , Tract B II Drainage and Roadway Easements File No . 87-2 II Gentlemen: As you have been made aware over the past year , the City of II Chanhassen has authorized construction of improvements on County Road 17 near Highway 5 and the detachment of West 78th Street approximately 300 feet to the north from its current connection II with County Road 17 just to the east of your property . This pro- ject basically completes the downtown redevelopment improvements and is scheduled for construction in 1989 . The attached excerpt II from the approved feasibility study shows the overview of the project as it relates to your property. As a part of this project and the storm water management plan for II the area, the City of Chanhassen is interested in acquiring ease- ments for ponding of storm water in the natural low area located in the southeast corner of your property . The general location II of this easement is shown in blue on the attached Exhibit A. The City likewise is seeking temporary construction easements which are shown in green on the attached map. We have also taken the II liberty to make provisions in this plan for location of a Fron- tage road for accessing your site. The only guide that we have had at this time to use in this regard is the previously approved but never recorded "Chaparral on Lake Ann" plat approved by the I City in 1981 . The purpose of this letter is to initiate discussions for II obtaining these easements and your input as to the roadway access to your site. Since the southeast corner of your property is a natural lowland area, it is an ideal site for accommodating storm I water runoff from the developments of which your property would be a significant contributor.
