SUBJ: The Preserve at Bluff Creek 4`" Addition, Project No. 11 -07: Accept Public Streets and Utilities PROPOSED MOTION "The City Council approves a resolution accepting the public streets and utilities in The Preserve at Bluff Creek 4t1i Addition for perpetual maintenance and ownership." City Council approval requires a simple majority vote of the City Council present. Staff has received a letter from David Hempel of Westwood Engineering stating that the utility and street improvements have been constructed in accordance with the approved plans and specifications. Staff has performed a walk- through inspection and finds the completed improvements acceptable for perpetual maintenance and ownership contingent upon receipt of a street and utility maintenance bond. The public improvements consisted of sanitary sewer, water main, storm sewer and streets construction were observed by our construction observer to be constructed in accordance with the City of Chanhassep requirements. Based upon our part-time observations, it is our opinion that all construction is in conformance with the approved project plans and specifications. Westwood Professional Services, Inc. requests that the City of Chanhassen accept these public improvements for City ownership and that the letter of credit be reduced to the minimum amount per the conditions of the Developers Agreement for this project. NOW, THEREFORE, BE IT RESOLVED that the Chanhassen City Council hereby accepts the streets and utility improvements in The Preserve at Bluff Creek 4`s Addition, Project No. 11 -07, for perpetual maintenance and ownership contingent upon receipt of street and utility maintenance bond.
