City of Chanhassen vs . Henry A. Pauly, et al ' This action involves the acquisition of 13 parcels in connection with the downtown redevelopment project . All parcels have been settled with the exception of Parcel 1 which is owned by Henry and Gloria Pauly and Parcels 8 and 9 which are owned by B.C . ' Burdick. It is our understanding that the City is attempting to negotiate a settlement with Pauly . If a settlement is unlikely, you should authorize us to schedule a commissioners ' hearing immediately . A pre-trial has been scheduled in the Burdick case for March 27 , 1989 . A trial date will be set at that time . Mr. Burdick recently replaced William "Frank" Kelly as his attorney and is now represented by Mr . Phillip Krass and co-counsel Mr . Bruce Malkerson. 2 . City of Chanhassen vs . Bernard N. Hanson, et al . ' This action involves the acquisition of the Chanhassen Lawn and Sports property and the Modeen-Hendrickson property. The ' Modeen-Hendrickson property has been purchased by the City. A commissioners ' hearing was scheduled in January for the Chan- hassen Lawn and Sports property but you advised our office to cancel this hearing. We were later informed that the City had ' settled with Mr . Hanson but we have not been advised of the terms of this settlement. Roger Pauly, et al This condemnation proceeding for the acquisition of the Pauly Commercial Building on 78th Street West has just been commenced . The parties are in the process of being served notices of the proceedings . The first court hearing has been scheduled for March 23 , 1989. As indicated in our letter to you of February 15 , 1q89 , Roger Pauly has offered to settle this matter for the payment of $150 , 000. You should notify Pat Farrell of the City 's position relative to this settlement demand. The City has authorized an appraisal for the Chanhassen Taco Shop ' property . Mr. Harvey Swenson has been requested to prepare an ap- praisal of this property. Condemnation proceedings , however , have not been authorized by the City and our office will not pursue this acquisition until instructed to do so by you. It is my understanding that the City will be acquiring property from the Estate of M. J . Ward in connection with the realignment of Highway 101 . We can attempt to negotiate for this acquisition but we cannot commence condemnation proceedings because a legal description of the taking has not been furnished by BRW. For this reason we cannot guarantee that the City will have access when needed. Hopefully, the landowner will cooperate in allowing the City access , but as you know, this cannot be assured. Box 1389 Minneapolis, MN 55440 1 Dear Bud: Per our telephone conversation the other day, I want to follow up I with the particulars of the incident I described. The truck I talked about was No. 202 and was on Highway 5 turning to go on to County Road 4 in Eden Prairie. The date was February 8, 1989 at approximately 8 : 40 a.m. Our Mayor, Don Chmiel, observed the I truck and driver driving safely and courteously. The good driving was obvious enough to the point where the Mayor came into my office and asked that I send a letter. Mayor Chmiel indicates that he is thankful for drivers of this individual ' s caliber. He suggested that because of the safe driving conduct the roads were made safer, at least on that par- ' ticular morning. It is a pleasure to write this letter since most of my correspondence concerning driving conduct is from the other end and has to do with complaints of inappropriate driving. I Please extend our heartfelt appreciation to this driver from all of us who must drive these sometimes treacherous roadways. This Finding of No Significant Impact (FONSI) is based upon the attached Environmental Assessment approved September 19, 1988, the Finding of Fact, the December 19, 1988 letter to the Environmental Protection Agency discussing wetland impacts and mitigations, the December 21, 1988 finding of no affect by the State Historic Preservation Officer and Mn/DOT's ' January 6, 1989 letter requesting this FONSI. The documents have been independently evaluated by the FHWA and determined to adequately and accurately discuss the need, environmental issues, ' and impacts of the proposed project and appropriate mitigation measures. They provide sufficient evidence and analysis for determining that an EIS is not required. The FHWA takes full responsibility for the accuracy, scope, and content of the attached documents. There followed a discussion as to the problems and delays "being encountered in dealing with the Minnesota Pollution Control Agency. The Engineer and the Chairman reported on the ongoing discussions with the Pollution Control Agency staff to arrange for the finalization of the sub-State agreement for Phase I of the Lake Riley Restoration Project. The Chairman reviewed the assistance being provided by the legislators within the Lake Riley area . There followed a discussion concerning the cost to the ' District if, for some reason, the EPA and MPCA did not decide to continue with the program. The Chairman reported that the City of Chanhassen was acquiring a public access to Lake Lucy. Following discussion, the staff was directed to press for the action by the Pollution Control Agency so the final agreements can be reached and executed on behalf of the parties to the cooperative pilot study. Engineer ' s Report The Engineer reported that the City of Eden Prairie had submitted for preliminary review and comment, four major projects . No problems existed for those few projects continuing through the winter months . The Chairman inquired concerning the ' report on the Purgatory/Mitchell Road Study. The Engineer reviewed the status of that study. ' Chain of Lakes Basic Water Management Project The Engineer reviewed the status of the project and reported that the City of Eden Prairie had recently identified five additional items of work that they considered remained unfinished. The Engineer reported that clean-up items had been accomplished, and estimated that the items identified by the City of Eden Prairie could involve an expenditure of $500 to $1, 000 . The Managers discussed the status of the settlement that had been reached with the contractor in connection with the litigation that ' had been commenced. It was the recommendation of the Attorney that the District not jeopardize the settlement and that the staff proceed to settle the case on the basis of the previous agreement, with a request that the contractor return following the winter ' season, to complete the items of work identified within the last week by Eden Prairie. It was the Attorney' s recommendation that it would be expeditious and cost-effective to complete the ' settlement of the litigation, as the cost involved did not justify jeopardizing the settlement that had been reached. Legis ative Report Senator Earl Renneke rc .'iewed the status f o legislation under consideration at the 1989 session. Minutes of Regular Meeting of January 4, 1989 Page 6 Board did request that its consultants provide the Board with various data ' on fees that are to be charged to the District for calendar year 1989. The Managers instructed this information be submitted to them as quickly as possible and prior to the February 1989 meeting. ' Cooperative Project - Lake Riley Chain of Lakes As requested, the staff detailed various event surrounding the initiation of the Lake Riley Chain of Lakes Project. Mr. Obermeyer distributed a memorandum to all Managers detailing the various activities that the Board and its staff have participated in since the inception of this project. The Managers also reviewed the memorandum prepared by Mr. Jim Anderson of the Minnesota Pollution Control Agency summarizing the various events in November 1988 pertaining to the initiation of this 1 cooperative project among various local , state and federal agencies. A Q newspaper article discussing this project was distributed to the Board to update the Managers on current activities of several government agencies involved in this project. Following discussion, the Managers instructed Chairman Fiskness to correspond with the Minnesota Pollution Control Agency to request from the MPCA appropriate funding and support for full implementation of the Lake Riley Chain of Lakes Project. The Managers felt that local governmental bodies are most committed to this project and want to take all actions necessary to ensure that both the cities of Eden Prairie and Chanhassen, along with the watershed district, are fully informed of the intent to proceed with this project. Metropolitan Surface Water Management Activities - 509 Report Mr. Obermeyer distributed the final draft of the District' s 509 Report. The District' s engineer requested that each Manager review the Management Plan and submit all comments to the engineer for final modification prior to its final review and approval . Chairman Fiskness asked each Manager to complete their review of the Report as quickly as possible in order that the Report might be considered at the February 1989 meeting prior to submission to the various regulatory agencies for their review and comment. Engineer' s Annual Report - 1987 1 Mr. Obemeyer distributed the 1987 Engineer' s Annual Report. The Managers reviewed the report noting the complete synopsis of information, particularly the rather detailed information on the July 1987 storms . Following review of that report, it was moved by Peterson, seconded by Cardinal , that the report be accepted and distributed by the engineer in accordance with past practices . BOX 147 • CHANHASSEN, MINNESOTA 55317 (612) 937-1900 ' MEMORANDUM TO: Mayor and City Council FROM: Todd Hoffman, Recreation Supervisor A4 ' DATE: March 7 , 1989 SUBJ: Results of the Discussion on Adult Softball Player Eligibility Requirements A public discussion was held at the February 28, 1989 Park and ' Recreation Commission meeting to allow teams and players to voice their opinion concerning the new eligibility rules established for 1989. The majority of those present were against this new rule being enforced. A copy of those in attendance is attached. The opponents agreed that when recreational facilities reach their maximum usage level, something needs to be done to assure conflicts do not arise. However, they did not agree with the method being proposed. An alternative suggestion was to be more creative in scheduling fields by making use of facilities which have not been available in the past and by scheduling more games ' on Friday evenings. The Commission felt this arrangement could be explored and directed staff to do so. ' To ensure that it is the concensus of each league that being more flexible in scheduling is preferred over the new eligibility rule, a league meeting has been set to discuss these options. Please find attached a copy of the memo announcing this meeting ' which was sent to four of the five leagues ( the Industrial League is not affected) . By treating each league separately, the unique needs of each can be more readily met. It is the sincere wish of staff to resolve this issue in such a way that the needs of all parties involved can be met. Now that everyone involved has a better understanding of why things must 1 change, a solution can be found. I -- - I - - I _ I I MEMORANDUM ' TO: Women ' s Open League Managers FROM: Todd Hoffman, League Director DATE: March 1, 1989 ' SUBJ: 1989 Adult Softball Leagues As a result of the public discussion which took place at the ' February 28th Park and Recreation Commission meeting, a change in the new eligibility requirements may occur. In an effort to meet the specific needs of all leagues , each will be addressed individually. To ensure that the decision which is made repre- sents the concensus of each league, resolution of this issue will be determined through special league meetings held prior to the organizational meetings scheduled for March 22 . Discussion of the possible alternatives to the new rule will be encouraged and a final decision on eligibility will be reached through a majority vote. To accomplish this it is asked that a maximum of two ( 2) representatives per team attend with one ( 1) of those representatives being eligible to vote. The topic of discussion will center around the fact that some teams and individuals disagree with the new eligibility require- ment and would like it relaxed. One suggestion which resulted from the February 28th meeting was to allow all 1988 rostered players to participate this year and impose the new policy in 1990. If this would be done the leagues must agree to be open to the possibility of playing a portion of league games on Friday evenings and also the possibility of playing some games at the Datasery location if need be. These meetings have been scheduled on a short notice to allow this issue to be resolved as quickly as possible. I apologize for any inconvenience this imposes . All meetings will be held in the City Council Chambers . Manufacturing Facility Project in Chanhassen, Carver County, MN (Performed September 21-24, 1988) . ' MRS Referral File Number: 88-2718 Thank you for providing us with the above-referenced report of the ar- ' chaeological survey conducted of your project area. We note with interest that two previously unreported prehistoric archaeological sites were found. Both finds add to our understanding of the prehistoric settlement patterns of Carver County. We concur with the consulting archaeologist's opinion that the ' site area she designated as Opus I is so sparse and so disturbed that it is unlikely to retain any scientific significance and therefore does not merit preservation. We also agree that Opus II is potentially highly significant and should be protected from disturbance. Because the project will not affect Opus II, we do not see any reason not to proceed with the project as planned. However, we endorse the consultants recommendation that the site be protected ' from "wear and tear," and we also urge more detailed study of the wooded areas for other sites should development activities be planned in those areas. There will be basically three wells installed, one of which will be in the City right-of-way just opposite West 79th Street. The well will be a 2-inch diameter casing a minimum of 12 inches above the ground surrounded by I three 4-inch diameter buffer posts. Warzyn will be attempting to identify groundwater flow direction and hydrocarbon content in the water. The PCA has been provided with Part I procedures on I February 13 for the site and Warzyn anticipates completing the Part II investigations by April , 1989 . In general terms, these wells remain in place anywhere from six I months to three years . The ownership of the well remains with Amoco. Removal of the wells will be at the discretion of the Pollution Control Agency and the Department of Health. They will I be capped at the time of abandonment in accordance with the Department of Health criteria . I Utility clearance for installation of the well had been acquired through the Gopher State One Call system. Steve Kirchman is under the impression that the contractor has pulled out due to lack of payment by Steve Liefschultz . Building Numbers: Apparently not only is the Chanhassen Inn not complying with the Code, but neither is City Hall . I will refer this also to Scott Harr . iInspection Department' s Help: It was a relief having Mike Wegler assist us last week in our busy inspection schedule . Ne will continue to utilize Mike as long as he can be spared from the Public Works Department. we anticipate utilizing him for the remainder of this week and possibly until such time as our inspection problem is taken care of . Also , the statistical ' information needed to justify more help in the inspection depart- ment is nearing completion . Steve will be giving me the infor- mation today; hopefully Ron ' s will follow . First Aid Training: The first aid training that occurred on February 22 and 23 was a hit according to all involved. There were approximately 15 people that attended from public works and ' the inspection department. It has been suggested that first aid kits be made up for each public works and inspection vehicle. The first aid kit would be basic in nature and Mark Littfin will be getting with rescue captain Dick Wing to assist. The con- sensus of the CCRRA was to continue involving city and township officials , private business persons, and the public in light rail transit ( LRT) planning through the establishment of advisory com- Imittees and/or through cooperative planning efforts . An example of cooperative planning is the recently executed joint I powers agreement involving Carver County and the Cities of Car- ver , Chanhassen , Chaska and Victoria for the completion of an Eastern Carver County Comprehensive Transportation Planning IStudy . The purposes of this study are: 1 . To take advantage of current technical work for the TH 212 EIS study at the subregional scale , and determine traffic Iand related effects at the local scale. 2 . To reach agreement and consistency between Carver County and I affected cities and townships on the number , location and functional classification of minor arterials and collectors to be included in the comprehensive plan of each affected Ijurisdiction . 3 . To determine needed improvements on minor arterials and col- lectors in eastern Carver County to serve the development of Icity and township comprehensive plans . The technical committee created by this joint powers agreement I had its first meeting on January 18th . The group discussed the possibility of the Carver County Regional Railroad Authority ap- plying for a grant through the Minnesota Department of Transpor- tation for light rail transit ( LRT ) planning funds. During the January of 1989 meeting of the transportation committee charged with overseeing the Eastern Carver County Comprehen- sive Transportation Planning Study, support for expanding the tasks of the study to ' include light rail transit planning was unanimous. The purpose of this funding application is to secure financial assistance in completing an overall transportation planning study of road system and light rail transit needs in eastern Carver County for the Year 2010. Light rail transit planning funds would assist in the preparation of a study chapter specifically devoted to LRT issues. A particular objective of this chapter would be to identify and evaluate LRT opportunities, both present and future. The addition of this effort to the Eastern Carver County Comprehensive Transportation Planning Study would result in a product addressing both comprehensive LRT and roadway planning in the rapidly developing east- ern portion of the county. Analysis Process ' The analysis process to be implemented under this study will include the follow- ing tasks. ' _ Review current transportation system Analyze projected population, employment, and land use - Identify current and future transportation needs ' - Select recommended street and highway system Identify potential LRT corridors Evaluate street, highway and LRT alternatives (County and Regional Perspectives) ' - Establish function classifications of the streets and highways in the roadway system - Identify transportation system deficiencies and estimate improvement costs 1 I I 1 11 Public Participation/Special Interest Group Involvement 1 The proposed study of LRT in eastern Carver County would become a part of the Eastern Carver County Comprehensive Transportation Planning Study. Carver County, as lead agency for this joint effort, would hold meetings with the appropriate cities, state agencies, regional agencies, and special interest groups. As lead agency for the Eastern Carver County Comprehensive Transportation Plan- ning Study, Carver County has entered into a professional services agreement with Howard Needles Tammen and Bergendoff (HNTB) to complete the planning study. It is proposed that the study of LRT in eastern Carver County would be performed by HNTB un- der a supplement to the inplace services agreement. Projected Funding Sources The proposed funding for the inclusion of light rail transit planning in the Eastern Carver County Comprehensive Planning Update would be through the inplace com- mitments of Carver County and the cities of Carver, Chanhassen, Chaska and Victoria to the planning update currently under contract along with the addition of the requested State LRT Funds. Project Time Frame The Eastern Carver County Comprehensive Planning Update as defined by the professional services agreement with HNTB is proceeding at the current time. The ad- dition of LRT planning to this agreement would be absorbed in the project schedule. Completion of the study during the last quarter of 1989 is anticipated. Project Budget The total transportation study including LRT planning is estimated at $28,000. Approximately $6 ,000 of this amount would be attributed to the LRT portion of the study. While Public Safety would have input to the process , typically the Engineering Department is responsible for applying standards IIfor determining the location of no parking zones . As a result, I have done a preliminary review of the engineering files on this issue and have found that in November of 1986 City I staff conducted a survey of the Greenwood Shores area to poll the overall opinion regarding leaving the no parking signs in place. As noted in the attachments , the overall feeling was that the I street was too narrow and that a traffic problem would be created on the curve if parking were allowed . Council action at that time was to deny the request of the property owner at 7120 Utica ILane, and leave the no parking zone in place. From an engineering standpoint, cursory review would indicate that, with the exception of the no parking signs located on Utica 1 Lane curve at the park area , the remaining no parking signs could be removed at least on one side of the roadway. I As you noted in your December 15 , 1986 memorandum on this issue, staff found it difficult to make a recommendation on this item as the original installation did not involve traffic control cri- teria, but rather was authorized in reaction to requests from the neighborhood itself . Mayor Hamilton: When we acted on this previously and we asked Jim Castleberry I to go back and talk to some of the neighborhood people and you have that information before you. Don Ashworth: You have the survey from Jim and you have a petition letter Ifrom the Engebretsons as well. . , Councilwoman Watson: The no parking signs were originally requested because of very definite parking problems in relationship to the park. I would say I those problems have been solved. From reading this, it is apparently the consensus of opinion among the people along there that they want the signs to stay. I guess it was a case of majority rules. They went up and I suppose Iit is a case of majority rules whether they come down or not. Councilman Geving: I seem to recall that when we did this action back in the II early 1980's, we don't just put up signs arbitrarily. These were requested by the neighborhood. We were having a lot of problems along Lake Lucy Road and in the Carver Beach area and as a result of the input from citizens, we went I ahead and installed no parking signs in both of those areas. I think they accomplished a purpose. I think we have diminished a lot of the problems that we had at both Carver Beach and Greenwood Shores because of the parking situation. I have to believe that even the people who are making this I petition tonight were part of the original petition that wanted the signs. Let me understand though, is this the end where the Engebretsons live, is this the last sign on Utica Lane? ICouncilwoman Watson: No. II Councilman Geving: So this would be right in the middle of the signs? Councilwoman Watson: Sort of in the middle of the signs. I William Engebretson: This is at the end of the signs. What we're asking for is just take down the signs in front of our property so when we get company we're not violating the parking ordinance if they park out there. 'I Mayor Hamilton: We realize what you're asking for. William Engebretson: We're not asking to take down all the signs all over the lit-- area. In recent years the people walk in from the adjoining areas and parking really hasn't been that much of a problem in the area that I've seen in the last few years. What the original concern was in the neighborhood was a lot of other people coming in and using the park and making a lot of noise at the park. I don't think it's a problem with parking. , Councilman Geving: If we remove this sign in front of your home, would there still be no parking signs to the east of where you live? ' William Engebretson: No. Councilman Geving: Yours is the last home? William Engebretson: It's the last one on the west side of the street. Councilwoman Watson: It's not supposed to be the last one of the west side of street however. It is only because the sign just doesn't happen to be in Way's yard anymore but the signs are to run up so they are even. It is to run up to Way's and Marcy's property line just as they do on Mr. Benson's side of the street. Right now, you are right but technically, there always should have been one up there. Way's always had a sign until like last summer when it disappeared one night and it never got put up again but they were to run, they ran to our property line and right across from us on Marcy's and Way's property line. That was the ending point of the signs and Mr. Benson still has one on our side of the road but like I said, Way's disappeared during the night last summer and it was never replaced but techically, when we were told they put up, they had to be on both sides of the street and run I!! uniformally within whatever area but the pattern had to be uniform as far as parking in order for the officers to have any idea of where the beginning and ending of those signs are to take place. If the vote is to keep the signs up, then that sign on Way's property should be put back so the uniformity exists but they are right right now, they have the last sign because it disappeared ' last summer. Councilman Geving: One of the points that you made Bill was that if you parked in the street and you had visitors over, you would be violating the Ordinance on no parking. It is my understanding that you could call the Sheriff's office for that event, let's say it was a holiday event or party that you were having and they would disregard the no parking. ' William Engebretson: I've called several times and it usually takes 3 or 4 calls to get to the right person to get it on the patrol car list. Getting back to the parking thing, the original problem was not the parking, it was the noise in the park. Councilman Horn: First of all, I am appalled to hear that last statement 1 about if you call the Sheriff's Department you won't have it enforced. What is the purpose of having the sign there in the first place if you don't enforce it. My other concern is the fact that we put up City Parks and then we put no LI parking signs in front of them so people can't use them. In my opinion, if we are going to put no parking signs out so they become private parks, we shouldn't spend any money on improving them. 91 8 1 ' City Council Meeting - December 15, 1986 IMayor Hamilton: So you are saying that you would not be in favor of... Councilman Horn: I think all the signs should come down. Mayor Hamilton: Being able to call the Sheriff's Department for an evening? g ' Councilman Horn: Yes, I think the signs there should be enforced uniformally and if you like, the City Attorney could comment on it. Mayor Hamilton: I think it's a matter of we're not a Gestapo I hope yet and ' it would seem to me that if we want to have good relations with our fellow citizens and with the Sheriff's Department, we would be able to do those types of things without offending anyone or causing a great deal of problems within our community. Councilman Horn: Selected enforcement? ' Mayor Hamilton: I don't know if that's selected enforcement if you call ahead of time and you state that you going to have additional cars parking 0.// p ng in front II of your house and you would like them not to enforce the law for that evening and the Council has already approved that, how is that selected enforcement? Councilman Horn: Why would it be some special event? Why couldn't somebody II I call in and say they want to use the park the next day? Mayor Hamilton: I suppose they would have i y that opportunity to do that. Don Ashworth: I think you have to look at the purpose and intent of anything that is passed by the City Council. You have a number of examples of where we have no parking overnight in the residential areas. If someone did have a ' party and it went past 12:00 at night, technically they would be in violation. The intent of that type of regulation is to insure that in case of snowfall we can clear the streets. If there is no problem, I don't see where it harms the I purpose and intent of the Ordinance to allow parking on a street for a party or in this case, if they had guests over and to allow parking in that instance. 1 Councilman Geving: The only other point I want to make is that we did get a letter expressing quite a bit of sentiment from the neighbors that they want to leave the signs up. I have indications here of seven neighbors in that ' neighborhood on Utica Lane and Tecumseh, all indicating that they want to leave the signs up. They feel that it is a police enforcement measure. It controls the traffic and it gas quieted the neighborhood down so I get the impression that the neighbors of the Engebretson's would like to see the signs ' left as is. There was one suggestion in that is kind of intriguing. They said leave the signs up on one side of the street. That's a possibility. Councilwoman Swenson: That was going to be my comment. If the people on the other side of the street haven't any objection, why don't we just leave it on one side? The concern seems to be that the street is too narrow and that _ I ! there would be a traffic problem created on the curb if parking on both sides were to continue. If we were to park on one side, if that would alleviate the 1 9 ■ City Council Meeting - December 15, 1986 problem. I think if there is a dangerous curve there then by all means the [11 sign should be up at a minimum around the curve. Mayor Hamilton: But don't you think that is going to create the same problem ' again in the summertime when the park opens and they are parking on the side where parking would be allowed to use the park? Councilwoman Swenson: I don't think there are any easy solutions. Don Chmiel: Mr. Mayor, Members of the Council, I live at 7100 Tecumseh. I think the real intent of having the signs is probably what you are reading. It has eliminated a lot of the problems, a lot of the concerns. Mainly during the early morning hours at 2:00 we've had different situations arise where there are still parties going on down at the lake and then in addition to that, when those people left afterwards, you were cleaning up behind them picking up the beer cans, the pop bottles, the other bottles that they were .1/ also consuming and it did leave an undesirable amount of problems within the area. I think by keeping the signs as they are and if Bill and Kathy do have problems with parking, I myself have called the Sheriff and I haven't called them anymore than one time and indicated that we were having a wedding reception or having a bunch of guests over and they would adhere so they knew that, we never had any problems at all but there were existing problems as far as the park is concerned. It is not too much of a pleasure waking up at 2:00- 3:00 a.m. with car doors slamming and people running around and different I things occurring so with that I would ask that those signs do remain. Mayor Hamilton moved, Councilwoman Swenson seconded to deny the request to remove the No Parking Signs on Utica Lane, to leave them as they are and ask that the Engebretsons work with the Sheriff's Department and City Hall. Public input was taken at that time. It was stated by Councilman Geving at that meeting that there would be no further public input this evening. We will vote on the issue. However, there were several questions raised that evening about some concerns that residents and we would like to have Barb respond to those questions and we will proceed to vote. Barbara Dacy: Both myself and Mr. Engelhardt will respond to the 10 or 11 questions. I would just like to start out with five of them. First of all, there was a question as to whether or not a community that contains a number of cul-de-sacs is a safer community. We asked Jim Castleberry, the Public Safety Director to contact various State and Federal Agencies. His information back to me was that he could not find any studies to prove or disprove that particular statement. Secondly, there was a question as to why the street was not connected several years ago and there is a two point answer to that particular question. It is my understanding that the history behind the placement of IIsigns in this area was to prohibit people from parking in that area during the summer months when large numbers of people want access to the park and lake area. I believe it was the resi- dents of this area at that time that requested no parking 1 signs be placed; therefore, it would be important that a greater sampling of the residents from that area be contacted prior to making decisions relative to this matter. II From a traffic safety standpoint,y p nt, therms does not appear to be a need for the no parking signs . I spoke with the Engebretson' s who explained to me that they had no initial desire at the time II of this no parking provision, to have their property signed as such. However, to maintain some continuity with the rest of the neighborhood, they agreed . Since that time, it has been their II observation that there is not a problem with volumes of people wanting to gain access to the park and that removal of the signs by their home would in no way infringe upon their normal use and II enjoyment of their property. Rather , it prohibits friends and relatives from parking there. This office has no objection to the removal of the no parking 1 sign in front of the Engebretson property; however, I would suggest that the other homeowners be contacted to determine whether a need still exists for the remaining signs to a lessor II extent, if at all . If the no parking ordinance is to be enforced, there will have to be some continuity to its layout or it becomes confusing to the public not familiar to the area as 1 well as the officers who are tasked with its enforcement. Four stalls again, is not too many to request for that particular park. Personally, I would like to see the original 6 to 10, I think we were talking about. 6 or 8. 500 feet is not close enough to any particular recreational area. They keep making the comparison with Lake Ann. Now I would submit to you that we've got a lot that's immediately adjacent to what is considered the beach area down there. Not the sand per se but it is adjacent to the beach area. Actually, this particular park, I believe if we had the graphic up here, is probably still about 200 feet from the sand so there is a comparison between that particular park and this one. If in fact there was parking on that street closer than what exists out there today, then in fact you have taken parking away as you did in Carver Beach and we as a conunission would like to see that replaced. I guess in viewing the situation out there on site and looking at where the parking exists, I would have to agree with where the location of the parking signs is because it's going to be very difficult to get it much closer unless we consider something in the neighborhood of the parking bays which would have to be built adjacent to the existing parking lanes out there. I don't know that there's right-of-way that could accomodate that. It's a very • hazardous corner. Granted, parking doesn't belong on that corner. However, 500 and some feet, plus or minus, can not be considered accessible. The whole point is to get people into that park. Whether you can walk there or if you have to drive there and pull your wheelchair out of the back of the car to get down to the beach. You have to be able to use that park. Thank you. ' Mayor Hamilton: I'd like to make a motion for consideration. I'm going to move that the City Council direct City Staff to do no additional work in the Greenwood Shores Park on either parking nor totlot or increased equipment or trail connections. A trail connection I guess needs to be done at sometime but the park should not be improved in any way at this time. It should be left as it is for use by the people who are currently using it which is a great many people. That is my motion. Councilman Geving: I'll second the motion. 1 Councilman Horn: Do you want to add to that the review of the no parking signs? Mayor Hamilton: Oh yes. I would put that in there. Councilman Geving: I'll amend my second. Mayor Hamilton: That the Public Safety Director review no parking signs to determine if any of them can be removed and if they can, they should be removed. Mayor Hamilton moved, Councilman Geving seconded that the City Council direct City Staff to do no additional work in the Greenwood Shores Park on either parking, totlot or increased equipment. First, I 1 appreciate your taking the time to chat with me about things in general. I would specifically like to take this opportunity to directly respond to your I question of whether I thought our Building Inspectors were putting in a full days work. Recall that I responded, tongue and cheek, with the answer of "no--we are getting 15 hours worth of work for each 8 hours they are here". We followed up by discussing my concern that they may well in fact be overworked 1 with "burnout" being a real consideration. I feel absolutely certain that everyone at City Hall would agree that Ron 1 Jukowski, Steve Kirchman and Carl Barke go non-stop every moment that they are here, which often includes coming in early, remaining late and working evenings and weekends. Why do they do this? Because they take their profession very I seriously, and take pride in the fact that they are able to meet the needs of our building community in getting inspections done as quickly as possible, so that builders may maintain schedules. 1 As I am sure you are aware, building inspection is a very demanding position, with a great amount of skill, knowledge, and tact being necessary. Each of these inspectors provide their professional services to the community (not only 1 doing inspections, but by doing plan reviews and serving as a valuable resource for builders, homeowners, contractors, as well as city staff) . I do not know whether you or Councilpersons Dimler and Workman have received 1 complaints or have concerns about the work product being delivered by Ron, Steve and Carl, but let me assure you that it is nothing but excellent. I hope I did not sound defensive; however, as we have talked, assumptions do sometimes get 1 made without the full picture being viewed. The 5 foot utility easement shown as item 18 on the commitment will need to be formally vacated by the City. Notice of the vacation proceeding will need to be served on all utility companies and others having any interest in the easement. John Rice will initiate the vacation proceeding and undertake to complete it if it cannot be comploted by closing. I understand that Chicago Title will insure c,ver the easement on the basis of such undertaking. 4 . The catch basin easement shown as item 17 on the commitment will need to be released or vacated by the City of Chanhassen . John Rice will pursue this with the City. I believe we concluded that a simple release deed from the City will be sufficient to eliminate this item. 5 . The mechanic ' s lien shown as item 16 on the commitment will need to be released as to all of the property in the proposed plat . Cary Meagher will provide John Rice with a copy of the Loren Anderson contract for deed and John Rice will obtain the necessary release from Dahl & Associates . 6 . The "Rettler" property, described as Parcel 2 in the commitment, will need to be registered in order to eliminate certain clouds on title resulting from the use of varying legal descriptions over the years . Tim Berg has already commenced the registration proceeding and will undertake to complete it . There are, however, two issues that will have to be addressed immediately : first, the Examiner will have to be satisfied that Parcel 2 will have sufficient legal access ; s ,cond, the legal description used in the registration proceeding will have to match up precisely with the legal description for Parcel 3 . Stephanie Young ' s letter of December 12 , 1988 indicates that if our closing occurs prior to the registration hearing, the access issue will be satisfactorily resolved, since Parcel 2 will be part of a larger parcel or lot bordering on a public street. Tim should confirm this with Ms . Young as soon as possible. If a new legal description is to be substituted for that shown on the commitment as to Parcel 2, we will need a certificate from the County Surveyor, and perhaps also a finding in the order for registration, that the descriptions for Parcels 2 and 3 match up exactly. Based on the foregoing and an escrow deposit of approximately $2 , 500 by the City to ensure completion of the registration , Chicago 'Title will insure clean title to Parcel 2 . 7 . The access easem-nt shown as item 21 on the commitment will need to be released or extinguished. Cary Meagher has tentatively concluded that the easement will either 1 ■ II ' DUlib 1i'NEY r be extinguished when title to Parcels 2 and 3 are merged, or can be released by a deed from the Bloomberg Companies . He will confirm this shortly. 8 . The plat of Heritage Square Addition should be completed prior to closing. We understand that the plat has already been finally approved in its current form. Additional ' approval , however, will need to be obtained for the following: (a) The most southerly line of the plat will need to be relocated 15 feet to the north. (b) The legal description for Parcel 2 will need to conform with the description used in the ' registration proceeding . (c ) Signature blocks may need to be revised to reflect current-_ ownership. John Rice and Rich `I'homasgard will take responsibility for ' completing the platting process . 9 . The DeMars-Gabriel survey dated May 7, 1987 will need to be updated to show all current improvements, to reflect ' the easements mentioned in the title commitment, and to reflect the 15 foot change in the southerly line of Parcels 2 and 3 as well as the possible new legal 'escription for Parcel 2 . The updated survey should be certified to Chicago Title Insurance Company, Heritage Park Apartments Limited Partnership and First Trust National Association, as trustee. The certificate should ' state : This is to certify that this map or plat and the survey on which it is based were made in accordance with 'Minimum Standard Detail Requirements for ALTA/ACSM Land TitleSurveys , ' jointly established and adopted by ALTA and ASCM in 1986 ; and meets the accuracy requirements of a Class A Survey, as defined therein. ' John Rice and Rich Thomasguard will take responsi- bility for having the survey updated. iOnce we have confirmation from the City, the Examiner of Titles and others that all of the foregoing can be ' accomplished, Carver County Abstract will issue a revised commitment or pro-forma title policy showing clear title subject to newly created easements shown on the proposed plat . At the time we embarked on the preparation of the I feasibility study for the Lake Lucy Road trunk watermain , staff prepared an updated forecast to evaluate when system demand would dictate the need for Well No. 5 . IThe Water System Analysis study prepared for the City in 1985 concluded that construction for Well No. 5 should commence in 1991 in order to be on line in 1992 . The usage demand forecasts I included in that report I believe were accurate for that time; however, with the growth and industrial development that the City has experienced the past few years , I believe that the siting I process should be accelerated to investigate the best location for this well and the preferred aquifer arrangement. If it is indeed true that we are in the third year of a five-year drought, 1 I believe the preliminary investigation for siting the well could be very useful for us to expedite the installation of Well No. 5. With this in mind I have obtained the attached proposal for pre- I liminary water supply investigations from Bruce A. Liesch Associates, Inc . B. A. Liesch is a firm that has a strong background in conducting geologic and hydrologic investigations I of this nature. They are very knowledgeable in Minnesota aquifers and well drilling and their $2 , 883 fee appears quite reasonable. Depending on the type of well that would be built, I i .e. glacial drift well versus a deep bedrock well , the timeline for the actual design , construction and placing the well in ser- vice could be up to one year ' s time . As we have recently discussed, we feel it would be appropriate to examine the water supply source options, through the use of existing data, prior to conducting more specific work directed towards developing additional wells . In general terms the source options for the city of Chanhassen would include two major divisions: glacial drift and bedrock aquifers. The city' s source of groundwater supply currently consists of a series of bedrock wells which have been finished at varying depths within the Prairie Du Chein - Jordan Aquifer. Based on our knowledge of this aquifer, we would anticipate that additional Prairie Du Chein - Jordan wells could be developed within the city given proper consideration of geologic and hydrologic considerations such as distances from existing wells and the occurrence of a sufficient thickness of the Prairie Du Chein and Jordan formations. Additional bedrock formations may also be available for water supply development below the Jordan formation. These would include the Franconia - Ironton - Galesville and Mount Simon - Hinkley Aquifers. Both these aquifers are generally less productive water producers and may also vary in water quality from that observed within the Prairie Du Chein - Jordan aquifer. Within the Twin Cities area the shallower glacial drift deposits may also be utilized for groundwater supply where sufficient depths, saturated thicknesses and permeabilities occur. Drift aquifers are primarily composed of sand and gravel formations which have been deposited by glacial meltwater. These aquifers are often somewhat limited in extent and can occur in relatively narrow sinuous channels, within depressions in the bedrock (bedrock Minneapolis,Minnesota• Madison,Wisconsin valleys ) or as more large scale features known as outwash or sand plains:. While glacial drift aquifers are somewhat less predictable than bedrock formations, they can be highly productive units. The relativsely coarse grain size and unconsolidated nature of these deposits can result in favorable water transmission characteristics where the deposits exist at sufficient depths and thicknesses. Water .lquality can also vary substantially within these deposits from location to location. As such, evaluation of drift aquifers for potential use as a source of municipal supply requires a differtht approach than that utilized for bedrock sources. This approach usually involves geophysical exploration (electrical resistivity and/or seisinic surveys) which is followed by test drilling and aquifer testing to confirm the quantity and quality of available groundwater. The option to utilize drift aquifers for municipal supply is not available at all locations. However, often times sufficient data is available from existing sources to either eliminate these formations from further consideration or to direct exploration activities in the areas which appear more favorable. Where these formations are available many cities with bedrock sourceb have considered diversifying their supply with drift wells. There hre many factors which should be evaluated in diversifying a supply including well construction, pumping and maintenance costs, potential for contamination, available yield and available water tquality both in terms of naturally occurring dissolved mineral- constituents and contaminants. Each of these factors can vary substantially with the particular source as well as the methodist, which may be utilized for source evaluation. As an .itnitial step in evaluating source options within the city of Chanhassen, we suggest a Preliminary Water Supply Investigation. This _investigation will consist of collection and review of available data regarding the hydrogeologic conditions which exist within);the city. Data sources include City records regarding the existing wells and sources of supply, as well as additional input from tjie appropriate city representatives; Minnesota Geological SurveyE water well records; Minnesota Department of Natural Resources ground water appropriations data; various published reports, maps and papers as well as information contained in the Lieschaibrary regarding similar investigations in the Twin Cities area. This information will be used to identify potential source options and recommended methods for development or further exploration of potential sources. A report will be prepared which documents the work cartpleted, provides a summary of data collected and discusses the options which may be available to the city complete with recommendations and conclusions.
