Consistent with the provisions of the approved 1988 budget, spe-
c cifications for the 1988 Street Sealcoating Program are attached.
As in past years , several areas of the City are involved in this
project , as indicated on the attached map.
I The engineer 's estimate for this work is $42 ,000. 00 . The budget
for road maintenance of this nature is $110 ,000 . The remaining
budget not utilized for sealcoating will be put towards overlay
I improvements in selected portions of the system which warrant it
( see Agenda Item lb. )

Advertisement for Bids
1988 Street Sealcoating Program
Notice is hereby given that the Chanhassen City Council will
receive sealed proposals for its 1988 Street Sealcoating Program
as detailed in the specificiations dated July, 1988 at the office
of the City Engineer until 10: 00 a.m. , July 29 , 1988 , when they
will be publicly opened at City Hall , 690 Coulter Drive,
Chanhassen , Minnesota, 55317. 1
The work includes application of approximately 24, 200 gallons of
bituminous material for sealcoat and 1 ,750 tons of sealcoat
aggregate.
All proposals shall be addressed to:

All proposals shall be securely sealed and shall be endorsed on
the envelope with the statement "PROPOSAL FOR 1988 STREET
SEALCOATING PROGRAM" and shall be on the Proposal Form included
in the plans and specifications. All bids shall be accompanied
by a certified check, cashiers check or bid bond in the amount of
five ( 5) percent of the total bid price made payable to the City
of Chanhassen.
Specifications for the above mentioned work are on file in the
office of the City Engineer, Chanhassen , Minnesota, where copies
for bidders may also be obtained. The City reserves the right to
reject any or all bids and to waive any irregularities in the
bidding , and further reserves the right to award the contract in
the best interest of the City. No bids may be withdrawn within
thirty ( 30 ) days from the date bids are opened. '

Gentlemen:
The undersigned, being familiar with the local conditions
affecting the cost of the work and with these contract documents
' dated July, 1988 , on file in the office of the City Engineer of
the City of Chanhassen , Minnesota does hereby propose to furnish
all labor, material , skills and equipment necessary to sealcoat
designated city streets according to the following schedule of
' approximate quantities and respective unit prices.
1. MnDOT 2356 .505 CRS-2 Bituminous Material for Sealcoat applied
as specified.

' The undersigned bidder also agrees to furnish the required bond
and to enter into a contract with the City within ten ( 10 ) days
after the City ' s acceptance of this Proposal or any section or
sections thereof, and further agrees to complete the entire work
' covered in the contract award prior to , 1988 , except
as noted in the specifications and subject to the provisions of
the contract documents.
' Enclosed is the required Proposal guarantee in the amount of 5% ,
which the undersigned bidder agrees to be forfeited to and become
the property of the City of Chanhassen , as liquidated damages
should this Proposal be accepted and a contract be awarded to him
and he fails to enter into a contract within ten (10 ) days , but
otherwise the aforesaid Proposal guarantee will be returned upon

1988 STREET SEALCOATING SPECIFICATIONS
The bituminous sealcoat shall be constructed in accordance with
' Section 2356 of the current Minnesota Department of
Transportation Standard Specifications , except as modified or
altered below:
Project Description
The project will consist of constructing a bituminous sealcoat
' with either FA-2 Aggregate ( Pea Rock) at 25 to 30 lbs. per square
yard or 3/8" Class A Coarse Aggregate (Gray Granite Chip) and
CRS-2 bituminous material at 0 . 25 to 0 . 30 gallons per square yard
' on City streets as designated in the following list.
The project shall also include the street preparation work of
sweeping clean the street surface, the cleaning of foreign
material , adjusting designated manhole castings, gate valves , and
aggregate sweeping following the sealcoat operations .

SITE INVESTIGATION
The Contractor acknowledges that he has satisfied himself as to
the nature and location of the work and the general and local
conditions of the various sites as well as the character of the
equipment required during and after prosection of the work. Any
failure by the Contractor to acquaint himself with the available
information will not relieve him from the responsibility for
estimating properly the difficulty or cost of successfully per-
forming the work.
TIME SCHEDULE '
The Contractor shall indicate the completion date in the
appropriate spaces provided on the proposal form. The completion
date may be taken into account in making the award of this
contract , but in no case shall the completion date be later than
September 1 , 1988.
Failure to comply with the above noted completion date shall
result in the deduction of liquidated damages as set forth in
Section 1807 of the MnDOT "Standard Specifications for 1
Construction" .
RESTRICTIONS '
Sealcoating operations shall be conducted:
1. Only during daylight hours between 7 :00 a.m. and 6: 00 '
p.m. and not on weekends or holidays .
2 . When the pavement and air temperature are 70 °F or higher; '
3. When the relative humidity is less than 75 percent; and
4. When the road surface is dry and clean. ,
The sealcoating operation shall not start and/or be suspended
when any one of the above conditions cannot be met . '
TRAFFIC
Traffic rerouting when necessary shall be the responsibility of '
the Contractor, which shall include flagmen , barricades, warning
signs and/or traffic cones , to adequately protect the work.

CASTING PROTECTION
' All manholes, gate valves and storm sewer castings shall be
located by the Contractor and masked with suitable cutouts prior
to applications of bituminous materials to protect them from
being sealcoated. Use of a thick aggregate or sand layer as a
mask will not be permitted.
' INCIDENTAL WORK
All work to be done by the Contractor as specified in this docu-
ment , and all minor details of the work not specifically men-
tioned in the specifications , but obviously necessary for the
proper completion of work, shall be considered as incidental to
' and a part of the work for which prices are named in the propo-
sal. The Contractor will not be entitled to any extra or addi-
tional compensation for such work except as sepcifically stated.
' INSURANCE
The Contractor shall maintain in force during the duration of
' this contract , the following insurance coverage to protect
against claim for property damage and bodily injury arising from
this contract:
Bodily Injury Liability $250 ,000 per person
$500 ,000 aggregate or each
' occurrence
Property Damage Liability $500 , 000 each occurrence
' Automobile Liability for Limits same as above
Bodily Injury and Property
Damage
Workers Compensation and Statutory requirement
Employer ' s Liability
ICertificates of Insurance including a separate Workers
Compensation and Employer ' s Liability form certifying that the
' above insurance is in force with companies acceptable to the
City, along with a performance bond, shall be required as a part
of the contract documents .
' PERMITS AND RESPONSIBILITY
The contractor shall, without additional expense to the City,
' obtain all licenses and permits required for the prosecution of
work. He shall be responsible for all damages to persons or prop-
erty occurring as a result of his fault or negligence in connec-
tion with the prosecution of the work. He shall also be
responsible for all materials delivered and work performed until
completion and final acceptance except for any completed unit
which previously may have been finally accepted.

INDEMNIFICATION
The contractor shall indemnify and hold harmless the City and '
engineer and their agents and employees from and against all
claims , damages , losses and expenses including attorney' s fees
arising out of or resulting from the performance of work, pro-
vided that any such claim, damage, loss of expense (a) is attri-
butable to bodily injury, sickness , disease or death, or to
injury to or destruction of tangible property (other than the '
work itself) including the loss of use resulting therefrom and
(b) is caused in whole or in part by any negligent act or
omission of the contractor, any subcontractor, anyone directly or
indirectly employed by any of them or anyone for whose acts any
of them may be liable, regardless of whether or not it is caused
in part by a party indemnified hereunder.
In any and all claims against the City or the engineer or any of
their agents or employees by any employees of the contractor , any
subcontractor, anyone directly or indirectly employed by any of
them or anyone for whose acts any of them may be liable, the
indemnification obligation under this Article shall not be
limited in any way by any limitation on the amount or type of
damages, compensation or benefits payable by or for the contrac-
tor and subcontractor under workmen ' s compensation acts,
disability benefit acts or other employee benefit acts. '
The obligations of the contractor under this Article shall not
extend to the liability of the engineer, his agents or employees
arising out of (a) the preparation or approval of maps , drawings ,
opinions , reports, surveys , change orders, designs or specifica-
tions, or (b) the giving of or the failure to give directions or
instructions by the engineer, his agents or employees provided
such giving or failure to give is the primary cause of injury or
damage.
PROJECT ACCEPTANCE AND FINAL PAYMENT
Upon completion of the work, the engineer shall satisfy himself
by examination and test that the work has been properly and fully
completed in accordance with these specifications . Any and all
manholes , gate valves, and/or storm castings covered by the
sealcoating will have to be exposed, cleaned, and operable as a
part of final acceptance requirements.
Once accepted and a one year warranty bond of the contractor ' s
work is provided, final payment , based upon actual quantities
used, unit prices bid, and approved change orders shall be made
within thirty ( 30 ) days.

WARRANTY BOND
' Prior to final payment and acceptance of work, the contractor
shall provide the City a warranty bond agreeing to maintain the
' stability of all work and materials done, furnished, and
installed under this contract for a period of one year after
final acceptance.

THIS AGREEMENT, made and executed this day of
, 19 , by and between the CITY OF CHANHASSEN,
hereinafter referred to as the "CITY" and '
hereinafter referred to as the "CONTRACTOR" ,
WITNESSETH
CITY AND CONTRACTOR, for the consideration hereinafter stated,
agree as follows:
I. CONTRACTOR hereby covenants and agrees to perform and
execute all of the provisions of the Contract '
Documents prepared by

CONTRACTOR further agrees to do everything required
by this Agreement and the Contract Documents.
II . CITY agrees to pay and CONTRACTOR agrees to receive
and accept payment in accordance with the prices bid
for the unit or lump sum items as set forth in the
Proposal Form attached hereto which prices conform to
those in the accepted CONTRACTOR'S proposal on file
in the office of the City Engineer. The aggregate
sum of such prices, based on estimated required quan-
tities , is estimated to be $
III. Final payment to CONTRACTOR by CITY shall be made as
provided in the Contract Documents.
