1h Contract Law Enforcement , 1R CONTRACT FOR LAW ENFORCEMENT SERVICES - This Agreement ("Agreement") made this , by and between Carver County, Carver County Sheriff's Office (hereinafter collectively known as the "Sheriff's Office"), and City of Chanhassen with its principal place of business, 690 City Center Drive. Chanhassen, (collectively, the "Parties"). WHEREAS, the Carver County Sheriff's Office desires to perform off-duty services for the City of Chanhassen at its place of business located at city streets ; and WHEREAS, City of Chanhassen is desirous of hiring Carver County Sheriff's Office to perform off-duty services for the business; NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties agree as follows: 1. City of Chanhassen agrees to hire Carver County Sheriff's Office for the purpose of TRUCK INSPECTIONS AND OVERWEIGHT ENFORCEMENT SERVICES FROM MARCH 2. 2000 THROUGH OCTOBER 31. 2000 for a total of approximately hours; 2. City of Chanhassen agrees to pay Carver County for services actually rendered at the rate of $36.79 per officer per hour plus $5.00 an hour per car if needed (dependant upon service). Payment is to be made within thirty (30) days after receipt of invoice from Carver County. 3. Carver County shall provide the requested services pursuant to its off-duty policy. 4. The Carver County Sheriff's Office duties shall include: Chapter 169 Enforcement. 5. City of Chanhassen agrees to hold Carver County, the Carver County Sheriff's Office, and their officers and employees harmless from and against any and all claims, damages, expenses and costs arising out of its performance under this Agreement, so long as such claims, damages, expenses or costs are not the result of actual or alleged negligent, willful, reckless or wrongful act or omission. 6. In the event that City of Chanhassen cancels the request for contractual police services with less than six (6) hours notice to the Sheriff's Office, assigned officers will be paid a three (3) hour minimum, which will be billed to the requesting entity. The Sheriff's Office will use . all reasonable means to notify officers promptly of canceled events. 7. This Agreement constitutes the entire understanding between the Parties and supersedes all previous agreements or negotiations on the subject matter herein, whether written or oral, and shall not be modified or amended except by written agreement duly executed by the Parties. This Agreement shall be binding upon and inure to the benefit of the Parties, their heirs, successors and assigns. ]. ,~ . , IN WITNESS WHEREOF, the Municipality has caused this contract to be executed by its Mayor and its City Administrator by the Authority of its governing body this day of ,2000. Court File No. C2-95-614 (Galpin Boulevard Improvement Project 93-26) Dear Mr. and Mrs. Van De Veire: This letter will serve as a follow up to my conversations with Elizabeth on May 9 and you on May 10. We will be recommending to the City Council that they accept your settlement offer of $13,000.00 related to the additional compensation owing to you relating to the Galpin Boulevard Improvement Project 93-26. In June of 1995, the City paid you $14,560.00 pursuant to the City's appraisal. This $13,000.00 would be additional compensation and would constitute a full, fmal and complete settlement of all claims relating to the taking including any tree loss, interest and appraisal fees. It is understood that your settlement proposal is based upon the current offer by the State of Minnesota, for additional property being taken, which is acceptable to you. The next Chanhassen City Council meeting when this matter will be considered is on May 22, 2000. Enclosed for your signature is the Stipulation of Settlement which I will need returned to me prior to the delivery of the check after council approval.
