The activities occurring on the 1 Northwest Nursery site including the shade house are considered an expansion to what was approved with the original conditional use permit for your wholesale nursery. For these activities to be permitted, you must receive another conditional use permit 1 from the City providing approval for expansion of your business . Due to the hot and dry weather we have been experiencing this 1 year, staff stated that we would allow you to construct imme- diately the shade house to provide protection to the plants rather than having to wait until you go through the conditional I use permit process. In our conversation it was stated that you would have to meet the setbacks required by the ordinance which is 100 feet from a public right-of-way for all storage and yard areas and that the outdoor storage areas must be completely I screened by 100% opaque fencing or berming. Therefore, when you construct the shade house, these conditions must be met. PIt was our understanding that by August of 1988 you would have made your application for the conditional use permit for the expansion of your business and also the wetland alteration permit 1 application for your proposal to fill in a portion of the wetland for site expansion. Staff visited the site with a Fish and Wildlife representative on Thursday, June 30 , 1988. It was con- firmed that there has been partial filling of the wetlands at I this time and that no further filling of the wetlands would be permitted until the wetland alteration permit has been applied for and if it is approved by the City. Any filling of wetlands 1 that has occurred prior to receiving a wetland alteration permit is not permitted by the city and must stop immediately. The dimensions are 110' x 85' to be placed as ' shown on the plot map. It will be constructed using 4 x 4 posts set in concrete. The structure will be 10' tall with 2 x 8' lumber as support joices with snow fencing tacked to them. The purpose of this is to provide shade for our sun sensitive plants that we offer for sale here. With this unusually hot spring, this structure is a necessity for the survivability of these plants. On that day, you responded to a call of a possible ruptured pipe at 1 960 Pontiac Lane in the City of Chanhassen. Although the resi- dent was not home at the time, you were able to gain entry and subsequently shut off the water, thereby preventing possible 1 major damage from occurring. Your actions were certainly beyond the call of duty and showed a true concern for the needs of the citizens of our community. I commend you for taking that little extra step to help out on an issue that some may consider not 1 truly a law enforcement function. Your actions speak well for you and the Carver County 1 Sheriff' s Department. This is an incredibly exciting time for all of us as we develop the CSO position to meet the needs of our City. On the other hand, the fact that you are helping to develop the new program while still being new yourself, may 1 be the source of some understandable frustrations at times. First, both Jim and I have faith that you will continue to do just fine. Feel 1 free to ask questions, make suggestions, and ask for help when you need it. To help clarify what you should concentrate on in the immediate future, the 1 following are some guidelines: 1. Continue to arrange the training that you feel you need, utilizing such resources as Eden Prairie's CSO's and Animal Control Officer, as well as I other neighboring departments (i.e. Chaska, Minnetonka, etc.) . Please feel free to schedule such as needed, but schedule some time here to handle calls as needed. Please ask Jim or me if you need any assistance in organizing or 1 arranging needed training. 2. Respond to animal calls as dispatched. II3. Respond to code calls as assigned. Certainly, if you observe a dog at large or a code violation, take the necessary I action. In time I would expect you to be able to take more proactive and even more self-initiated enforcement actions, but this will develop with time. IIPlease keep us updated on your progress, frustrations and accomplishments. We are glad you are a part of the team! I thought that excellent points were raised, with productive discussion occurring. Secondly, as promised, I have begun to research the issues brought up. I would ' like to remind you that I will be frank in advising you of the areas that we can and cannot be of assistance. ' The following is what I have learned to date: 1. I have established contact with the Hennepin County Sheriff's Water Patrol in order to utilize their expertise in the area of watercraft enforcement. 2. I have met with Lori Sietsema and obtained the following information: ' a. The gate attendants are keeping records of park use; b. The gate attendants were trained on how to deal with unruly people, as ' well as how to summon help when needed; c. The gate attendants are handing out the rules; ' d. Lori advised me that there is presently no law against swimming in the access area and that she questions the need for such a law at this time; ' e. There is a phone in the attendant shack. 3. I also discussed the matter of City Code amendments with Lori (specifically the areas of limiting horsepower of watercraft on the lake; further regu- lating hours of watercraft operation; and restricting the operation of jet ski-type watercraft) . She advises me that the proper way to pursue such is to obtain amendments to the Water Surface Zoning Ordinance, and that she is ' the City staff person to work with in order to develop such additions to our Code. t II Ms. Cindy Gilman June 28, 1988 Page 2 ' 4. Regarding the four "Slow/No Wake Buoys" that you feel are both the wrong signs and incorrectly placed, Lori advises me that she believes that they are correctly placed. I would suggest that you continue to pursue this with ' Lori if you wish. 5. I have again requested that the Carver County Sheriff's Water Patrol empha- size enforcement/patrol efforts on the lake. 6. Attached is a copy of the proposed noise ordinance for the City. 7. I asked Lori who a DNR contact for your Association would be and she recom- mended Mr. Kim Elverum (296-3310) . ' 8. I have also placed a phone call to Minnesota Conservation Officer Steve Walter (who coincidentially lives in Chanhassen) in hopes that he may also serve as a resource for your Association. ' 9. Lori advises that she had requested that the Park Department arrange to have the old Carver Beach access barricaded. I understand that the problem is that a workable solution has not been devised (one that will work during the ' summer, but will allow snow plowing in the winter.. .) . I have brought the matter to Dale Gregory's attention, advising him that you are concerned. ' 10. The park hours remain 6:00 a.m. to 10:00 p.m. and the gates are supposedly being locked at 10:00 p.m. by the gate attendants. 11. I have requested that our Animal Control Officer maintain a cautious watch for the pit bull that was attracked to Jack! I hope that I have addressed most of the issues you brought to my attention. The City Council, at their June 13th meeting, acted to appoint all of the applicants to the Trailway Task Force, including the following people: ' Sue Boyt Mike Lynch ' Carol Dunsmore Richard Donnay Karen Hasse ' The first meeting of the Task Force will be held on July 14 at City Hall. Our first order of business will be to become fami- liar with the trail plan and then try to understand why this item ' failed in February. From the beginning, Rick Novak has always been cooperative in keeping the job sites as clean as possible. Dumpsters are provided at each i new home under construction. Labor crews clean the job site I ' daily and as needed along the silt fence and pond. Recently, complaints have been received about the litter in the pond. On Wednesday, June 15th, I spoke with the job superintendent at Chan I Vista about the litter in the pond. That same day his laborer was sent to clean all litter in and around the pond. As of June 13 , 1988 , Rick Novak has hired a full time laborer, his sole job 1 will be to keep the subdivision clean. Hopefully, this will stop further complaints from residents about the trash in and around the Chan Vista subdivision. Try to remember that along with construction, there will always be some litter, muddy streets , I dust and noise. BOX 147 • CHANHASSEN, MINNESOTA 55317 1 (612) 937-1900 1 MEMORANDUM TO: Lori Sietsema, Park and Recreation Coordinator 1 FROM: Jim Chaffee, Public Safety Director DATE: June 17, 1988 SUBJ: Eurasian Watermilfoil I received a call from Cindy Gilman, Co-President of the Lotus Lake Homeowners Association, who stated that an article in the June 13th edition of the Sailor Newspaper is causing their 1 organization some concern. The article is on the front page of the Sailor and concerns a new weed discovered in Lake Minnetonka that chokes out other weeds and destroys zooplankton on which 1 fish feed. The article states that Lake Minnetonka was probably infested by 1 by a boat that had been used in other infested waters and then the weeds being transferred by that boat to Lake Minnetonka. Apparently the weeds get caught in the props of the boat and people fail to clean the props, subsequently taking their boats 1 from one lake to the other spreading the weed. The article states that the DNR will be posting signs on the public accesses to Lake Minnetonka asking that boaters check their props for 1 weeds prior to launch. Mrs . Gilman is asking that we also post signs at our public accesses for boaters to be aware of this new threat to our lakes 1 and ask that they check their props and boats for any weeds that might be transferred. You might want to bring this up to the Park and Recreation Commission for their advice. I was told at the entrance that there was a new rule this year stating in effect that if you plan to stay and watch the game, you have to pay the entrance Itofee . Even the coaches, whose help is voluntary, were required pay! We were at Lake Ann on May 24th, for a game and no such "rule" was in effect . We ' ve never had to pay for these games before either here or any other community we ' ve lived I in . Also , the parents have no say in where the games are played . We receive a schedule at the beginning of the season I stating that two games are to be played at Lake Ann . I thought the City of Chanhassen encouraged family partici - pation in sports . Evidently the greater interest is in revenue accumulation which supplements the already high taxes which we continue to pay. The City of Chanhassen needs to reevaluate this preposterous policy which serves only to detract from parental participation in children ' s athletics . Since we currently do I not have a stormwater management fund in place to generate reve- nue for these types of activities , the maintenance is done on a haphazard basis normally in response to complaints. We hope to I change this policy (in particular establish a stormwater manage- ment fund) but it also is dependent on Watershed District involvement. IConcerning the two pond areas in question , the South Lotus Lake ponds are under City ownership and we have done maintenance a couple of times on these ponds as a result of last year ' s storm I damage. I have directed Jerry Schlenk to again clean out the lower ponds to take advantage the dry weather which we are currently experiencing. This will recapture the retention Ivolume. This should be accomplished within the next week. Concerning the Near Mountain pond, I personally inspected the site last week and did not observe any significant amounts of Idebris and, in fact , the site looked relatively clean to me. I had Jerry Schlenk investigate the ponding area ( 6/21/88) . He observed that there is a large buildup of silt and sediment at I the storm sewer inlet ( see attached plan) . To remove this material will require two things: equipment , which we can come up with, and access. The City does have a drainage easement over this area, however, the property remains in the ownership of the I abutting property owners. To properly solve this problem we need access across the back of lots 7 , 8 , 9, 10 and 11 . If we can get access agreements from these property owners and their I willingness to replant any damaged lawn area, we will be glad to clean out the silt/sediment deposits. As such, while I we- do not want them to be eyesores, their main purpose is to control runoff rate and nutrients. The City therefore does not spend time or money treating and/or aerating these water areas to I address any water quality concerns , especially _since significant funds would be necessary to deal with these basins in that regard. City Planner -I DATE: July 7, 1988 ISUBJ: City Wide Trash Pick-Up Day On April 11, 1988, the City Council directed staff to provide a report on the city sponsoring a trash pick up day (Attachment I #1) . On April 28 , 1988, staff sent a letter to all waste haulers working within the City of Chanhassen requesting the cost esti- mate for providing a trash pick up day throughout the city I (Attachment #2) . The city received a written response from Crosstown Sanitation and verbal responses from several of the other waste haulers (Attachment #3 ) . Crosstown Sanitation was I the only waste hauler that provided a cost estimate. The other waste haulers that contacted staff stated that they could not make an estimate because there is a charge per load and addi- tional charges for certain types of wastes collected (such as Irefrigerators, tires, etc. ) . Staff then contacted several cities who provide a city wide clean I up (Attachment #4) . In general, for what the City Council was proposing the costs could run anywhere from $8, 000 and up. The city has the choice of either providing a curbside pick up or pick up at a drop off site. The drop off site will be less Iexpensive but would require a very large site which could store the solid waste for up to two weeks. The site should be secured to prevent additional dumping, etc. The cities contacted that I use a drop off site used parkland or an old landfill site. The curbside pick up is more expensive. The cities that provided curbside pick up either bid out for a waste hauler to perform it I or had city crews do it. The cities typically broke the city into sections to perform the pick up. The type of waste collected varies greatly. There are separate I charges to landfill large appliances and some landfills will no longer accept them. Tires are not accepted by landfills and a separate tire recycler would have to be contracted. Some cities I charged a fee for the amount of waste dropped off (by car, van, etc. - Shorewood) . This offset their total cost and they still had good participation. I IA. Typically, the collection takes place in the spring. It is possible to have it in the fall, but there would probably be more participation in the spring. Send letters to newspaper and radio station noting ' dates of program, etc. II. Obtain Quotes to Supply Containers and Award Contract a. Send letters to prospective contractors. b. Send letters to low bidder awarding contract and to ' other bidders noting results of quotes. III. Mange the Program a. Put up sign at site (stored at Public Works) . b. Make sure sufficient number of containers are on-site, especially on weekends, after hours, etc. c. Record number of containers filled - process invoice ' when program is over. d. It is our intent to provide as safe of a- community as possible in which to 1 live and this includes enforcing traffic laws to insure safe vehicular traffic. Unfortunately, limited resources prevent us from accomplishing the high standard so often requested of public 1 safety. The City of Chanhassen at any one time has only one deputy to I patrol a 24 square mile city with a population of approximately 9 ,000 people. This deputy is often busy responding to calls for service. In their spare time, which as of late is becoming less and less, they have many, many demands for special requests . 1 I have, however, written a pass on to the deputies asking them to patrol Lake Lucy Road in search of the violators of which you I spoke. I will also be requesting the Carver County Sheriff to provide for extra patrol services specifically for the concerns expressed by the citizens on Lake Lucy Road. We will use what- ever ever resources are available to this office to help alleviate some of the traffic problems in your area of Lake Lucy Road.
