Section 5-16-4 permits food processing as a conditional use in the IOP District. ' The setbacks for the IOP District are 30 feet front yard setback, 10 foot rear and side yard setback and IOP District requires a minimum lot frontage of 150 feet, lot depth of 200 feet, maximum ' lot coverage of 70% and maximum height of 4 stories or 50 feet for the principle structure. Article 8 of the Zoning Ordinance requires perimeter landscaping, ' and landscaping of vehicular areas and landscaping for trash enclosures . The zoning ordinance requires the parking equal to the number of employees on the major shift for processing plants . REFERRAL AGENCIES Building Department Attachment #2 DNR Attachment #3 Asst. City Engineer Attachment #4 BACKGROUND On April 11, 1988 , the City Council approved a conditional use ' permit request for food processing facilities and site plan review for the McGlynn Bakeries located at the southwest corner of Hwy. 5 and Audubon Road (Attachment #5) . The applicant has ' revised the building layout to support a different type of food processing than what was proposed originally and is also pro- posing to subdivide the 69. 7 acre parcel into one lot and two ' outlots. Since the applicant already received a conditional use permit for food processing, staff is not requiring the applicant to go ' through another conditional use permit. The original plan for food processing resulted in a fresh food product. The new plan results in a frozen food product. Because the site plan has been ' amended, the applicant must receive site plan approval again. ANALYSIS - Preliminary Plat The applicant is proposing to subdivide 69 . 7 acres into one lot and two outlots . The property is zoned IOP, which requires a minimum lot area of one acre, a minimum lot frontage of 150 feet and a lot depth of 200 feet. Lot 1 , Block 1 contains 37 acres i i McGlynn Bakeries Subdivision & Site Plan July 13 , 1988 Page 3 and meets the requirements for lot depth and lot frontage. ' Outlot A contains 20 .5 acres and Outlot B contains 8 . 8 acres and both meet the requirements for lot frontage and lot depth. The applicant is providing a 60 foot public street right-of-way to provide frontage to Lot 1, Outlot A and Outlot B. The pro- posed public right-of-way will access Audubon Road at two points with a separation of approximately 500 feet. The most northerly access point of the proposed public right-of-way onto Audubon Road is approximately 600 feet from the centerline of Hwy. 5 and directly across from the Paisley Park driveway. Grading, Drainage and Utilities In his attached memo, the Assistant City Engineer reviews the grading, drainage, utilities and street issues for the proposed plat. The Assistant City Engineer will be meeting with the applicant and MnDOT on Tuesday, July 19, 1988, to discuss addi- tional right-of-way needed for Hwy. 5 improvements . The Assistant City Engineer will update the Planning Commission on the results of this meeting. 1 RECOMMENDATION The proposed preliminary plat meets the requirements of the IOP 1 District and staff recommends the Planning Commission adopt the following motion: "The Planning Commission recommends approval of Subdivision Request #88-13 as shown on the plat stamped "Received June 13 , 1988" and subject to the following conditions: 1 1 . The applicant shall enter into a development contract with the City and provide the City with the necessary financial sure- ties to guarantee the installation of these public improvements . 2 . The applicant will work with the City to provide the necessary easements or improvements which are required as a result of the feasibility study for the upgrading of Audubon Road and McGlynn Park. 3 . All stormsewer systems shall be constructed of reinforced concrete pipe to be in accordance with the City' s standards for urban construction. , 4 . The plans shall be revised to show pond skimmer details . 5 . The applicant shall obtain and comply with all conditions of the Watershed District permit. CITY COUNCIL RECOMMENDATION ' It is recommended that the City Council approve Subdivision Request #88-13 as shown on the plat stamped "Received June 13 , 1988" and subject to the following conditions: ' 1 . The applicant shall enter into a development contract with the City and provide the City with the necessary financial sureties to guarantee the installation of these public improvements . 2 . The applicant will work with the City to provide the ' necessary easements or improvements which are required as a result of the feasibility study for the upgrading of Audubon Road and McGlynn Park. ' 3 . All stormsewer systems shall be constructed of reinforced concrete pipe to be in accordance with the City' s standards ' for urban construction. 4 . The plans shall be revised to show pond skimmer details. 5 . The applicant shall obtain and comply with all conditions of the Watershed District permit. ' ANALYSIS - Site Plan Review The applicant is proposing to develop Lot 1, Block 1 of McGlynn Park. The lot is located at the most southerly portion of the ' 69 . 7 acres and will be serviced by an internal public street and Audubon Road. The applicant is proposing to develop 20 .4 acres of the 37 acre lot with potential Phase II of McGlynn Bakeries ' located west of the subject site. The applicant is proposing to locate the building adjacent to the ' internal street with office and visitor parking located west of the building, employee parking located south of the building in the center of the site and the shipping area located south of the building adjacent to Audubon Road. The 161, 700 square foot ' building consists of an office, warehouse, food processing plant and freezer. The building will be serviced by a thirty foot access from the proposed internal street to service both the ' delivery area and the office and visitor parking and will also have an access point from Audubon Road to service the shipping and employee parking. There will be a small service drive from the internal street which will only be used as a mechanical access . McGlynn Bakeries Subdivision & Site Plan July 13 , 1988 , Page 5 The facility will be used for McGlynn' s Taste of France product. The product is a frozen dough which will be made on site and shipped off site for use by other clients . The original facility would have produced a fresh product for McGlynn sales . The pro- posed facility will involve "receiving" truck traffic bringing supplies to the site and "shipping" truck traffic removing the product. The hours of truck traffic will be normal working hours with some shipping traffic at night. Site Requirements ' The total lot coverage, including parking areas and building, is 37 .4% which is under the maximum of 70% total lot coverage. The applicant is providing 210 parking spaces including 5 handi- capped parking spaces . The total number of parking spaces required by the zoning ordinance is 150 (number of employees on major shift) . The building height is 28 feet which is under the ' maximum 50 foot height for the IOP District. The office area will be 2 stories. The proposed building and parking areas meet the setback requirements of the IOP District and the applicant is providing required lighting on the outside of the building and within the parking lots. The site plan locates the parking areas to the west or south side , of the building which provides screening from the internal public street and Audubon Road. In addition, the applicant is providing extensive grading, berming and landscaping to further screen the parking and docking activities from both the internal street and Audubon Road. Sheet 6 and 7 of the plans illustrate the pro- posed grading and berming of the site. Sheet 9 illustrates the proposed landscaping plan. The applicant is extensively landscaping the site including internal landscaping within the vehicular areas . The majority of the proposed plantings are deciduous trees and staff is recom- mending that more evergreens be used to provide 50o winter opa- city. Staff is recommending that the service drive located north of the building should be better screened with evergreens and that the southerly employee parking area be provided with evergreens along the southern and eastern edge of the parking area to provide year round screening. The ordinance requires landscape screening of any service struc- ture such as trash receptacles . The applicant is locating a ' trash compactor on the west side of the building within the bulk storage docking area. The trash receptacle is within the parking area and it will be very difficult to provide separate screening. Since the applicant is providing screening around the parking area itself, staff does not feel separate screening around the receptacle is necessary. The amendment - is minor and still meets the requirements of the ordinance. ' RECOMMENDATION ' The proposed site plan meets the requirements of the IOP District and staff recommends the Planning Commission adopt the following motion: ' "The Planning Commission recommends approval of Site Plan Review #88-3 as shown on the plans stamped "Received June 13, 1988" and subject to the following conditions: ' 1 . ZONING § 20-814 ARTICLE XXII. "IOP" INDUSTRIAL OFFICE PARK DISTRICT Sec. 20-811. Intent. The intent of the "IOP" District is to provide an area identified for large scale light industrial and commercial planned development. (Ord. No. 80, Art. V, § 16(5-16-1), 12-15-86) Sec. 20-812. Permitted uses. The following uses are permitted in an"IOP" District: (1) Offices. (2) Warehouses. (3) Light manufacturing. (4) Trade shops. (5) Health services. (6) Printers. V, § 16(5-16-4), 12-15-86) I State law reference—Conditional uses, M.S. § 462.3595. Sec. 20-815. Lot requirements and setbacks. I The following minimum requirements shall be observed in an "IOP" District subject to additional requirements, exceptions and modifications set forth in this chapter: 0 (1) The minimum lot area is one(1) acre. ), (2) The minimum lot frontage is one hundred fifty(150)feet, except that lots fronting on a cul-de-sac shall have a minimum frontage of sixty(60)feet. I (3) The minimum lot depth is two hundred(200)feet. (4) The maximum lot coverage is seventy(70)percent. I (5) Off-street parking areas shall comply with all yard requirements of this section, except that no rear yard parking setback shall be required for lots directly abutting I railroad trackage; and, no side yard shall be required when adjoining commercial uses establish joint off-street parking facilities,as provided in section 20-1122, except that no parking areas shall be permitted in any required side street side yard. The I minimum rear yard shall be fifty (50) feet for lots directly abutting any residential district. Side street side yards shall be a minimum of twenty-five (25) feet in all districts. Other setbacks are as follows: I a. For front yards, thirty(30)feet. b. For rear yards, ten(10)feet. Ic. For side yards, ten(10)feet. (6) The maximum height is as follows: a. Required number of on-site parking spaces. IOn-site parking areas of sufficient size to provide parking for patrons, customers, suppli- ers, visitors and employees shall be provided on the premises of each use. BOX 147 • CHANHASSEN, MINNESOTA 55317 (612) 937-1900 1 MEMORANDUM 1 TO: Planning Commission FROM: Larry Brown, Staff Engineer /6 DATE: July 14, 1988 1 SUBJ: Preliminary Plat and Site Plan Review for McGlynn Park, Planning Files 88-13 SUB , 88-3 SITE PLAN, McGlynn Bakeries . This seventy acre site is located on the southwest corner of the intersection of State Highway 5 and Audubon road . The site is composed of rolling topography with a grove of mature trees located along a portion of the easterly property boundary. The City Council established an Economic Development District which includes Audubon Road, and the McGlynn parcel . The City Council also authorized a feasibility study to look into the upgrading of Audubon Road between State Highway 5 and the railroad tracks south of the subject parcel, the extension of utilities underneath Audubon Road, and possibly the public improvements for the proposed right of way of McGlynn Park . Unfortunately the feasibility study is not complete . The applicant whishes to pursue preliminary plat review contingent upon compliance with the findings of the feasibility study prior to final plat approval . Sanitary Sewer 1 Municipal sanitary sewer is available at the intersection of Park Road and Audubon Road. As mentioned previously, the feasibility study will address the extension of the utilities across Audubon Road and possibly through the proposed right of way to provide service for the Outlots . 1 II . II II McGlynn Bakeries Page 2 II Watermain Municipal water service is available to the site by an existing 12 1 inch diameter watermain along the east side of Audubon Road . The plan proposes that the watermain be looped throughout the proposed right of way. The proposed fire hydrants should be located a I minimum distance of 10 feet behind the street section to facilitate any future hook-ups to the system with out disturbing the street section. IAccess The applicant has provided for a 60 foot right of way which is in I accordance to the City's standards for industrial subdivisions . The feasibility study for the upgrading of Audubon Road will address the need for turn lanes into the proposed industrial site . I The proposed plat maintains a distance of 590 feet separation between State Highway 5 and the proposed northerly access onto Audubon Road. The Minnesota Department of Transportation(Mn/DOT) recommends a minimum separator of 600 feet such that proper turn I lanes could be constructed on Audubon Road if anticipated traffic volumes warrant the need for the turn lanes . Mn/DOT also stated that they would be requesting an additional 80 feet of right of II way along the northerly property boundary to facilitate the widening of State Highway 5. This would decrease the separation distance to approximately 400 feet . The applicant ' s engineer is concerned as to the impact of these requirements on the northerly II portion of the property. In light of this, the applicant has scheduled a meeting on Tuesday July 19, 1988 to confirm Mn/DOT position. If the results of the additional right of way has a I severe impact on the northerly portion of Outlot B, the applicant will temporarily withdraw the application to revise the plat. In any instance, I will be making a brief presentation during the IPlanning Commission meeting to relay the results of this meeting. Grading and Erosion Control I In the interest of time, the City Council approved the Grading, plan on July 12, 1988 . I have enclosed my memorandum to the City Council dated July 7, 1988 for the commissions review (refer to 1 attachment 1 ) . Drainage IIAdditional ponding may be required for the development of the outlots . Given the existing topography, these additional ponding sites for the outlots will outlet to the proposed ponding site I located on the southerly portion of Lot 1 Block 1 . Additional easements along the westerly portion of Lot 1 Block one will be II .. . 1 McGlynn Bakeries Page 3 reviewed to accommodate this conveyance of storm water run off from the outlots to the primary ponding site as part of the final plat review. The Department of Natural Resources has indicated that the proposed dike infringes on the boundary of a flood zone . The proposed elevation of the dike is at 908 which coincides to the 100 year flood elevation within the flood zone (refer to attachment 2 ) . Both the Watershed District and the Department of Natural Resources have indicated that this dike will have a minimal impact on the flood zone and have given their approval of the proposed grading. It is therefor recommended that the preliminary plat for McGlynn Park dated "Received June 13, 1988" be approved subject to the following conditions : Recommended Conditions 1. The applicant shall enter into a development contract with the City and provide the City with the necessary financial sureties to guarantee the installation of these public improvements . 2 . The applicant will work with the City to provide the necessary easements or improvements which are required as a result of the feasibility study for the upgrading of Audubon Road and McGlynn Park . 3 . All storm sewer systems shall be constructed of reinforced concrete pipe to be in accordance with the City's Standards for urban construction. ' 4 . As you may recall, the original concept plan for the site proposed the construction of the McGlynn Corporate Headquarters. Since that time, McGlynn has determined that a "freezer division" is more appropriate to meet their demand at this time. 1 The grading plan calls for cut and fill depths in excess of 35 feet. The majority of the cut will be at the very top of the I hill central to the site to create the building pad. Similarly, the majority of the fill shall be moved down towards the southern portion of the site to create 4 :1 fill slopes and a ponding Iretention area along the southernmost boundary line. The total 4' volume of excavation has been estimated at 664, 000 cubic yards . Because of the extreme volume of material that needs to be moved I and the soil conditions that exist in the field, the contractor has requested that the hours of operation be extended from 6 : 00 a.m. to 11:30 p.m. This constitutes two 8-hour work shifts. I Staff has reviewed the soil conditions and the various deadlines for the construction season. Due to the clay soils that are pre- sent and the dry weather during this construction season, it is critical that the contractor work in double shifts Monday through II Friday to take advantage of the dry weather to successfully complete the project. The contractor, Imperial Developers, which is the same contractor that the Kerber Boulevard Improvement I Project was recently awarded to, has done similar operations such as the Carlson Company building in the City of Minnetonka, which also required a double shift to complete the project. To II the best of our knowledge, these working hours have been successful I A. i 1 Don Ashworth July 7, 1988 Page 2 within the other cities due to the lack of surrounding residences ' where they have done such operations . The two 8-hour shifts will obviously require that the contractor bring in lighting equipment to maintain working conditions in evening hours . The engineer for the applicant has indicated that the entire earth work balan- ces on site, which means that no fill material will have to be hauled off site, thereby eliminating any truck traffic on the roadways which would affect neighboring properties. Staff is recommending that all the adjacent property owners shall be notified of the hours. Staff will be attentive to this situation and if it causes any problems with adjacent property owners . Fortunately, the closest residents for this area would be in excess of 1 ,000 feet away which would be located in the Timberwood Estates subdivision. In light of the contractor' s previous reputation for working with such conditions in Plymouth and other cities, staff is recommending that the compressed work hours Monday through Friday be approved by the City Council con- tingent upon staff revising these hours if the adjacent property owners submit a legitimate complaint to the City. The grading plan proposes a storm water detention pond located on the southern portion of the parcel. This detention pond has maintained the predeveloped runoff rate and provides adequate storage for a 100-year frequency storm event. In the attached letter from Mark Koegler of Van Doren Hazard Stallings dated July 6 , 1988 he has indicated that Bob Obermeyer with the Riley Purgatory Watershed District has stated that the revised grading plan may fall under the approval of the previous grading plan submitted. A formal letter shall be sent to the office to con- firm his verbal comments (refer to Attachment No. 1) . It is recommended that any construction trailers or construction structures or any kind that are to be placed on site shall be approved by the City Engineer prior to the placement of these structures . The contractor shall be responsible for on and off site cleanup resulting from the construction of this site. Attached is the "generic" grading permit which will be modified for this site (refer to Attachment No. 2) . Page SC-8 of the specifications indicates that the storm sewer appurtenances shall be constructed of corrugated metal pipe ver- sus the plans which show reinforced concrete storm sewer pipe. The specifications should be revised to reflect that the storm sewer system shall be constructed out of reinforced concrete pipe (RCP) to remain consistent with the City' s standards for urban construction. All erosion control measures shall be in place prior to the commencement of any grading and once in place shall remain in place throughout the duration of construction. The developer shall be responsible for periodically checking all erosion ' controls and making any necessary repairs promptly. 4 . Wood fiber blanket or equivalent shall be used on all disturbed slopes greater than 3 :1. 5 . The developer and contractor shall agree that the hours of opera- tion shall be 6 : 00 a.m. to 11:30 p.m. until such time as the ' City deems that these hours of construction are a disturbance to adjacent property owners , at which time the applicant and contractor agree to abide with any revisions to these hours of operation determined by City staff or City Council. 6 . The developer shall clean daily dirt or debris from the streets or surrounding property that has resulted from construction work by the developer, its agents, or assigns. 7 . All construction trailers or structures shall be approved for placement by the City Engineer prior to the commencement of placement. ' 8 . All burning or disposal permits shall be approved by the City of Chanhassen and the Minnesota Pollution Control Agency prior to the commencement of any disposal. ' 9 . All lighting devices shall be placed on site such that it does not create a hazard or nuisance to adjacent property owners or traffic along Audubon Road or State Highway 5 . ' 10 . If for any reason access is deemed necessary from State Highway 5 , this access shall be approved by the Minnesota Department of Transportation prior to the construction of such a temporary access . If an extension is granted, it shall be conditioned upon updating the security posted by the Developer to reflect cost increases and the extended completion date. 5 . Erosion Control. Plan A shall be implemented by the Developer and inspected and approved by the City. The City may impose additional erosion control requirements if they would be beneficial . All areas disturbed by the excavation and back- filling operations shall be reseeded forthwith after the comple- tion of the work in that area. Except as otherwise provided in the erosion control plan, seed shall be rye grass or other fast- growing seed suitable to the existing soil to provide a temporary ground cover as rapidly as possible. All seeded areas shall be mulched and disc anchored as necessary for seed retention. The parties recognize that time is of the essence in controlling erosion. If the Developer does not comply with the erosion control plan and schedule or supplementary instructions received from the City, the City may take such action as it deems appropriate to control erosion. The City will endeavor to notify the Developer in advance of any proposed action, but failure of the City to do so will not affect the Developer' s and City' s rights or obligations hereunder. If the Developer does not reim- burse the City for any cost the City incurred for such work within thirty ( 30) days, the City may draw down the letter of credit to pay any costs . I 6 . Clean up. Security. The bank and form of the letter of credit ' shall be subject to the approval of the City Administrator. The letter of credit shall be for a term ending September 1, 1989. 8. Responsibility for Costs. ' A. Except as otherwise specified herein, the Developer shall pay all costs incurred by it or the City in con- junction with the grading and erosion control , including but not limited to inspection expenses incurred in connection with appro- val and acceptance of the permit. B. The Developer shall hold the City and its of- ficers and employees harmless from claims made by itself and third parties for damages sustained or costs incurred resulting ' from permit approval and work done in conjunction with it. If the bills are not paid on time, the City may halt all work and construction. ' 9 . Developer' s Default. Is that important? il Brown: Yes . i Chairman Conrad opened up the meeting for the public hearing . II Mark Koegler : Not surprisingly the length of our presentation has been shrinking . Let me just introduce the people who are here and then we ' re II here to respond to any questions that you might have. First of all for the record I 'm Mark Koegler with VanDoren , Hazard & Stallings and with me from our firm is Bob Sellers . Our role in the project is project II planners , engineers and landscape architects . The architectural firm that ' s involved in the project is Setter, Leach & Lindstrom. Dick Erickson on the end and Jim in the back. Both are very familiar with the building aspects and will address those questions . I guess last but not II least, certainly not least from our point of view is our client . Michael McGlynn who is president of McGlynn Bakeries. Michael is very knowledgable , obviously with business aspects . I think between all of us II we can certainly field any questions you might have. If you 'd like further clarification on the Arboretum Road thing, we certainly can supply that. II Headla moved , Emmings seconded to close the public hearing . All voted in favor and motion carried. Ellson : I 'm the same way. I don' t have any questions . I thought it was easy to read and understand. I like it too. I Batzli : I just want to know if they' re going to have a retail outlet so I can buy rolls. A question for Larry, was the 12 foot fire lane, was II that in your condition 5? Do you have that? II Planning Commission Meeting ' March 16 , 1988 - Page 63 I Brown: That was addressed by the Public Safety. Batzli : So the second sentence in condition 5 . . . rOlsen : Should be removed and it should state that the level 2 sprinkling, that it should provide level 3 sprinkling system throughout the building . Batzli : I don ' t have any other questions . ' Headla: On your bulk storage of flour and sugar, do you require special wiring switches? ' Michael McGlynn : For the bulk sugar? Headla: For the bulk flour . Michael McGlynn: Different type of wiring? Headla: If there is bulk flour, the first thing I think about is explosions . Michael McGlynn : Possibly there are items on the market such as what ' s IIL nicknamed as the exploded proof wiring. Headla : Now, if they need that , are our inspectors trained? Do they know what to look for and work with the customer on this? ' Brown: We can certainly add it to a condition. ' Olsen: It will have to meet State Code. Headla : Okay, and our inspector can , he ' s trained in? To me this would be special that he hasn' t done before in Chanhassen. Brown: At present we have a mechanical inspector on temporary assignment P y gnment that can probably do that, yes . ' Headla : Okay, so we can do that and work with them. Mark, you had the landscaping. I didn' t see anything there with our landscape Arboretum, ' some of the things they develop. Mark Koegler: Any of their specific hybrids? ' Headla : Right . We went through that earlier . Conrad: Four hours ago Mark we were on that subject . Headla : They' ve developed so many beautiful things and when I drive by there and I look at the whole southwest bank, I think what a beautiful place for that . That ' s all I have. I wanted to know. Do you have any ' other chemicals that are going to be used in there? i.ng Commission Meeting ch 16 , 1988 - Page 64 , Michael McGlynn: Other than the standard baking ingredients? Headla: I 'm not sure what ' s standard. You have flour and sugar but are there any particular chemicals that will be used there for either baking 11 or cleaning? Michael McGlynn : There certainly are chemicals used in cleaning . Not many of them are hazardous types. Our sanitation people are trained in the use of hazardous chemicals but we have very few in our facility. Headla: What kind of hazardous chemicals? Michael McGlynn: The caustic cleaning chemicals or maybe the grease from our donut frying operation or something like that. Headla : That ' s what you 're referring to more just a clean-up type of thing. Michael McGlynn: Yes . In fact the chemicals ' mzcals that we call hazardous are probably not the same as what a layman would. For us it' s because of their proximity to food . Brown: I think if you go upstairs in the coffee room of City Hall , there' s a label of hazardous chemicals that we use routinely and they've been labeled hazardous just because they do pose a hazard if misused . It covers a wide range. I understand your concern and I think that a possible area for storage or some sort of addressing of this matter may be necessary not knowing what chemicals they are storing . Headla : You ' ll look at that then? Brown: We can, yes . Conrad : Okay Larry, tell me what tax increment district has to do with our proposal at this time? I guess I 'm really lost in terms of how that affects this particular motion. Brown: First I ' ll explain that the tax increment district will allow the II future access road that was shown in the plans to be constructed and then those assessments may be put against the property and waived due to the tax increment district. I really don ' t think we need to get into the nuts and bolts of the increment district . However , I think Brian worked out an acceptable statement as far as action being taken on this . Olsen : If you want , Mark Koegler can explain it to you. Mark Koegler : Your timing on everything is never perfect and this is a good example . On February 22nd at 4 : 30 we had to have plans in . At 7: 30 II that night the Council met and decided that this is a good candidate for a tax increment site . The only impact that has , first of all it has no impact on the site itself. The only impact it has is on the form of the access . What we' ve proposed right now is the 220 foot , what we' ve internally called a glorified driveway. It' s a 36 foot wide City street re- I • Ir .0 //arming Commission Meeting I - March 16 , 1988 - Page 65 really but we weren ' t proposing to dedicate it . Initially it was being built as a driveway thinking that when the property is platted later , that would be dedicated as public street , it would be added to serve the Ibalance of the property. When the discussion of the upgrading of Audubon Road came into play, that was the new wrinkle at kind of the 11th hour and as I said, a decision had to be made at the time the plans were 1 turned in. So this assumes that Audubon Road , if it' s going to be upgraded, is simply going to be probably an overlay. It' s a 7 ton road now. It would maybe go to a 9 ton. That ' s still a viable option. The I other alternative that' s being addressed is to put in a full urban section street . Curb and gutter , street lighting and so forth and improve that entire stretch from probably TH 5 down to the railroad tracks . If that' s done , certainly some of the utilities along that same I right-of-way corridor as well as the entry road as Larry outlined, could be part of the tax increment project as well which could be a public improvement project at that point done by the city and assessed back to I the property rather than a private improvement project that we' re looking at right now. So it really is simply an issue of who ' s going to be doing what. McGlynn ' s management has been meeting with Don on several I occasions and is totally cooperative with whatever the City wants to pursue in that regard . It ' s just a matter of not knowing tonight how the tax increment issue is going to sort out. Either way, the access is the same. It ' s a matter of who does it and who pays for it. =C Conrad: Thank you Mark. That ' s a little bit clearer. Okay, now Larry, you tell me what that has to do with the site plan . Although I I understand what Mark just said , do we still need that contingency in here that this site plan is basically approved giving the tax increment? Brown: We can condition that if the City Council creates a tax increment I district for this area , that the proposed access , the 220 foot access , be extended to the west to the future driveway as shown on page 2 of the plans dated February 22 , 1988 . Olsen : Just to further explain our reason for that , and correct me if I 'm wrong, is because that extension would also be partially paid for by I the tax increment district and we would prefer to have that . Batzli : The proposed added condition would be that in the event the current tax increment district is approved by City Council , then the I applicant shall submit plans to the City Engineer for approval for future roadway access to the westerly parking lot access . r IHeadla: There's not going to be any retail out of this is there? The three Hackberrys proposed along the west side of Audubon Road shall be replaced with three evergreens at lesat 6 feet in height . 2. Additional evergreens , at least 6 feet in height , shall be located along the easterly boundary of the large employees parking lot . 3. One additional handicapped parking space shall be provided . 4. An elevation of the easterly berm and landscaping used to screen the easterly trucking area shall be submitted for staff approval prior to • .issuance of a building permit. 5. Fire hydrants shall be installed completely around the building and 300 feet apart. Level 3 sprinkling system shall be provided throughout the building . 6. The developer shall enter into a development contract with the City and provide adequate financial sureties to guarantee proper installation of these improvements . 7. Wood fiber blankets or equivalent shall be utilized to stabilize all II disturbed slopes greater than 3: 1. 8. Plans and specifications for the construction of the sanitary sewer , watermain , storm sewer and sanitary services shall be submitted for approval by the City Engineer prior to the final site plan review. 9. All erosion control measures shall be in place prior to the commencement of any grading and once in place shall remain in place throughout the duration of construction. The developer is required to review erosion control periodically and make the necessary repairs promptly. All of the erosion control measures shall remain intact until an established vegetative cover has been produced , at which time removal shall be the responsibility of the developer . 10. The applicant shall obtain permits and comply with all conditions from the DNR, Watershed District and any other appropriate regulatory agency. , ! 11. Conrad: So staff is real comfortable that this is not setting a precedent? Chairman Conrad called the public hearing to order . ' Mark Koegler : Let me make a couple of introductions and then brief comments. To my left is Bert and Mike McGlynn. Obviously, of McGlynn Bakeries . . . .Just a response to a couple of things that Larry brought up. First of all in terms of the overall plat, the attempt is , as shown as Lot 1 and Block 1 will be retained under McGlynn Bakeries ' ownership. Ultimately there will be a second phase going essentially to the west of that. It will be kind of part of a campus type environment that will exist there. The only issue that really has surfaced of recent is the right-of-way requirement from MnDot along TH 5. We had a couple of concerns initially. One was the useability of what I 've shown as Outlot A. We don' t have any major concerns in that regard because the property is between about 420 and 490 feet deep right now. Somewhere in the neighborhood of 60 feet, hopefully no more than that , is not going to impact that. We get into another issue II about what is reasonable for MnDot to require withour them actually providing compensation back to the owner but that ' s not really an issue to this body this evening. We were satisfied after meeting with Evan Green from MnDot yesterday that we can work with that. We will provide him with II some additional grade information which is going to have some impact on the appropriate right-of-way that they need . With regard to the intersection setback from TH 5, as Larry mentioned, the MnDot standard is 600 feet. We have 590 feet . Again, . . .prefectly adequate for putting in an intersection there so our intent is to get that loop road in. The reason that 590 foot point is set is because , I 'm sure you notice that lines up with Paisley Park 's center line right-of-way just right across the street which is obviously a very good site in terms of us . That ' s likely in the future, at least from MnDot ' s thinking, could be the primary entrance to Paisley Park. If the City follows their recommendation and puts a median in Audubon, it would shut that first entrance effectively off for any left turn movements in so. . . Other than that , the recommendations in the staff report are perfectly agreeable. We are certainly willing to work with the City and the consultant on the Audubon Road project to make sure everything falls into place. If you have any questions of me, I 'd be glad to answer them or the owners . Wildermuth moved, Erhart seconded to close the public hearing. All voted in favor and the motion carried . Headla : I 'm looking at sheet 2 and I still don' t understand the 600 feet and Mark has said something with the 585. As I look at this one drawing, I think I 'm looking at the right one , I don ' t come close to that . What am II I reading wrong on it? Mark Koegler : The dimension that we ' re talking about is essentially center line to center line. TH 5 to what is labeled now as Buttercup Road , this entrance point . That is the distance that on this plan is 590 feet and that' s the standard that MnDot says should be around 600. Headla : Larry, on sheet 2, doesn ' t that look like 335? Mark Koegler : That' s the frontage just to this point right here. Headla : Right and then you' ve got half the road . I . Mark Koegler : It' s 590 on our scale and on MnDot' s scale. IBrown: Center line to center line. IHeadla : Oh, to the center line of the highway? Mark Koegler : Yes, that' s how we measure. I Headla : Okay. My questions were directed to that . I don ' t have any others . IWildermuth : I have no questions on the subdivision. Ellson: Nothing here. IEmmings : I have basically no questions . I 'm just a little confused . When I look at sheet 2, just because there ' s something called Block 1 and there ' s nothing called Block 2 and there ' s something called Lot 1. Is Illf that all of Block 1? I can' t tell where things stop and start and why it ' s done exactly the way it is . Mark Koegler : The reason it' s set up, Outlot A and Outlot B will subsequently be subdivided at a later date. Emmings : I understand those I think. IMark Koegler : It will become Block 2 of Lots such and such, in the case of B. All of Block 1 eventually will wrap around , unless we have some I interruption that we don' t envision right now, this will become Block 2 in the future . Right now they' re platted as outlots . We essentially have one lot and one block for this entire parcel . Emmings : Okay, so the fact that Lot 1 is written inside that easement doesn' t mean that you' re. . . IMark Koegler : That line is right there . Emmings: Yes, and goes where from there? Mark Koegler : Lot 1, Block 1 is all this . Outlot B is this piece and Outlot A is the piece that wraps around here. IEmmings : So right now, just so I understand , Lot 1 and Block 1 are . . . If— Mark Koegler : Correct. Erhart : The intent here is that we ' re going to put an entrance sign similar to the one just to the east Larry? On Audubon Road? Erhart : Or a little median in there with an industrial park entrance sign II or what was the island you' re referring to? Brown : At this point there is not a proposed island written into the , feasibility. However, if traffic volumes were to increase due to the future development, an island is certainly something that we shouldn' t rule out. ' Erhart : But didn' t you mention an island in your presentation? Brown: I did. As I stated before, if the future traffic volumes do -' warrant an island , we would certainly have to consider that and because that is still a possibility in the future, we wouldn' t want to set up a plat here that would limit, if we could at all help it, a full movement intersection into the park so that was staff ' s concern. Erhart : Okay, and that' s the purpose of having it directly across from Paisley Park? Brown: Correct and maintaining the 600 foot distance that we use as a guideline. , Erhart : Where does Park Road enter from the opposite side? Is that relative? Brown: A little bit south . Erhart : The applicant owns the entire parcel correct? And like in the Opus , the other industrial park, who owned all that property? Mark Koegler : Originally that was owned by Dunn and Curry prior to the time that Opus bought it. There may have been a series of property owners. Erhart : But generally when it was developed into a park, Opus owned the ' property. Who did the streets in there then? Did they do that or did the City do that or was it shared? Mark Koegler : I don' t honestly recall . Erhart : Who ' s paying for the street improvement here? ' Mark Koegler : That' s to be determined by the feasibility study. The proposed , at least the thinking right now is that a certain portion of that cost would be offset by the economic development district . A portion II of that cost would be assessed to the properties thinking that' s what . . . in the study. Planning Commission Meeting July 20, 1988 - Page 13 C ' Erhart : The thinking is that the City will somehow pay for some of this street even though it may be the intent of the owner to sell some of these . . .sell some of the areas to other businesses? IMark Koegler : The feasibility study itself, as Larry says , the exact. . . is being defined right now but what it appears is you have a series of I priorities. Priority number one is to get Audubon Road improved and hopefully to get that southern lane of Buttercup Road into the entrance of McGlynn as a part of one public improvement project. From there the I alternatives are to put in additional utilities and streets . One option might be, not necessarily as a part of that same funding mechanism but part of the same public improvement project. . . That hasn ' t been determined yet but in the third tier is the utility connections to go down I to the south . Whether or not those will be put under the same contract . . . Right now it's just being defined as kind of a hierarchy and see what the costs are . IErhart : Okay. So in looking at this proposal tonight, actually the street isn' t that concrete. That ' s all the questions I 've got. IConrad : I have no comments . Larry, because things are not absolute , what are you going to be doing between now and when this hits City Council? Will you have tied down the thing, the need with MnDot before it gets to Ilir City Council? Brown: Right now, yes we are hoping that MnDot will give us a prompt I reply over the next week here and by the time these plans hit City Council , we hope to have the feasibility study complete and that will address all these questions. IConrad : Jo Ann , there' s nothing in the motion right now that really, in terms of the subdivision, that talks about the openess of roads and where the streets go based on. . . IOlsen : Number 2 I think states that they will be required to meet whatever . . . IConrad : Okay, that covers it . Olsen: As far as TH 5, I don ' t know. IConrad : When this gets to City Council , we ' ve got 5 conditions right now. Are there going to be more that staff is going to recommend between now Iand then or is there something that you'd like us to word in ther now? Brown: I 'm sure there will be a couple more conditions added once we find out MnDot ' s position . I Conrad : Jo Ann , when you send a staff report to the City Council , under I what circumstances can you add conditions that we haven' t seen? Olsen: Right . Conrad : Any other questions? Ellson: Is that a problem? Conrad : Well , I get bothered when I don' t see what ' s going to City Council. I 'm comfortable sending this along because I think people know, I think we know what' s going on here. It' s not that we need to clarify anything any further. McGlynn folks have their opinion and MnDot has theirs and I think City Staff will arbitrate this thing and take care of it. I don' t think I need to see it anymore . Emmings : Sort of like the storm sewer situation in the last one on the Reed property. It' s kind of a technical issue that has to be resolved somehow. Conrad : It' s got to be resolved and all I do here is I make sure that we always have the alternative to bring it back. So we see exactly, we have that right to see exactly what goes to City Council . In this particular case, I 'm comfortable personally that we don' t need to see this. That things can be resolved between now and then but typically I 'd like to see what' s going there. Olsen : If they ever change the plat , if they need the 80 foot right-of-way or whatever and they would have to rearrange the road or Outlot A going into there. . . Wildermuth : What would you do there Mark? Let ' s say if MnDot said they needed the full 80 feet, would you slide the whole plat, the whole subdivision down to the south? 1 Mark Koegler : No. There is adequate depth there still for the type of uses we potentially. . . ' Conrad : The big concern would be compensation . Headla moved , Wildermuth seconded that the Planning Commission recommend approval of Subdivision Request #88-13 as shown on the plat stamped "Received June 13 , 1988" and subject to the following conditions : , 1. The applicant shall enter into a development contract with the City and provide the City with the necessary financial sureties to guarantee the installation of these public improvements . 2. The applicant will work with the City to provide the necessary easement or improvements which are required as a result of the feasibility study for the upgrading of Audubon Road and McGlynn Park. Mark Koegler : The site plan is generally the same as the previous one. liflThe modifications were made to reflect the change in building in the manufacturing operation. I would ask at this point, if you have questions on the buildings, we have representatives here or on the operation itself, Iwe ' ll be glad to handle it in that manner . Conrad: What product did you change from? Before the site was intended to produce what versus what is it producing now? II Bert McGlynn: Originally it was going to be part retail stores for the area which we also have a frozen operati.on . . . is the fastest growing Isegment of our business . . . Conrad : Corporate headquarters will be where then? IIBert McGlynn: It will out here. Conrad : I 'm sure happy to have you out here. Tim, do you want to start? IErhart: I don ' t really have any questions . IEmmings : I don ' t either . Ellson : I loved it. I like to see when people go above and beyond . II Those that put in extra screening and things like that. I thought about the Lyman thing when I was reading this , about having a dock here and they seem to be doing more than is required. IfWildermuth : I see part of the building designated as freezer , are you going to be using liquid nitrogen for freezing? Are the compressors going to be outside or inside? McGlynn' s Architect : Some out. A portion of them will be outside. . . Wildermuth: There isn' t going to be any special noise requirement is there Jo Ann? I like the layout . It is like a campus . Headla : What color is it? Is it going to be like the White Castle. McGlynn' s Architect : They' ll use primarily. . . it will be natural colors . Headla: More like MTS ' s in Eden Prarie on TH 5? Is that the type of structure you ' re thinking of? McGlynn' s Architect: It won' t be bone white but it will be a very light color , natural concrete. . . Headla : It' s going to be pretty well seen from the south. , McGlynn ' s Architect: The precast will have. . . A, Headla : Jim brought up a point . I see the Fire Department did not review this or I missed the letter in here. Olsen : They did review it and it met all the conditions . There was an original memo from the Fire Inspector and he had stated a lot of requirements that will be met with the Building Inspector when the building plans come through so the Public Safety Director wrote another memo which removed all those and said they weren' t necessary at the time. That he meets the UBC Code. Headla : On your refrigeration system, how many ton are you talking about? II McGlynn's Architect: I 'm not sure we've got that totally figured out yet. I Headla : Give me a ballpark. Are you talking 50 ton? McGlynn 's Architect: In the ballpark of 300 tons . Headla : And you use ammonia? If they have a fire in that building, shouldn' t the Fire Inspector , or how do you handle that? If you've got 300 tons and you' ve got ammonia in there , and a fireman' s going in to fight a fire, they've got a real problem. McGlynn ' s Architect : . . .refrigeration piping . . .the pipes will be on the outside attaching on the roof so the outside of the building handles it . Headla : So Larry, do you look at that type of thing with the safety people? Planning Commission Meeting July 20, 1988 - Page 17 C ' Brown: This will be reviewed again by the Public Safety Director . To the best of my knowledge, as Jo Ann has eluded to, right now it only has to be concerned through the site plan review. They will however , have concerns when it goes through the actual building permit, constructural review. Headla : So this might be a little premature for them to get that ' involved? Brown: Correct . Part of the new system that we are starting up will ' address some of the concerns of the Public Safety Department, are that a reduced sets of plans will be submitted to the City indicating any danger zones such as the one you 've just mentioned and we will be kept in a command vehicle so if there is an emergency out here, they will have that information readily available to them. Headla : Okay, that' s fine. Mark, before I thought you did a good job on ' that landscaping. I tried to get a little bit, not trying to put in some of the Arboretum stuff, how do you feel about the recommendation 1 (a) ? Do you think that' s appropriate? Mark Koegler : We don' t have any problem complying with that . Headla: That' s too bad because I 've got problems with it. I though you'd go the other way. Deciduous isn' t a dirty word and I really would like to see deciduous trees there. I think they' ve got a lot of aesthetic value and they can . . . ' Olsen : We like them too . It ' s just the ordinance requires 50% opacity. Headla: How did you measure the cross section of a deciduous tree? That ' really breaks it up too and I don ' t see , you can go to one type of conifer and that' s got a different opacity than another one. I 'm not sure you' re measuring that right . . . .and I think it should be deciduous trees . ' Olsen: All deciduous trees? ' Headla : No . I think what Mark has in here now is great. I hate to see it go to anymore conifers . You know where you talked about putting conifers around the parking lot. I 'd like to see that deciduous. I think that would be very appropriate . Conifers aren ' t really native to this ' area as much as the others and I just think deciduous fits in much better . If you can make them maples , that ' s all the better . ' Conrad : I don' t understand that. You ' re screening in the wintertime is what we' re talking about and you ' r:- saying deciduous greens and I don' t understand that at all . Headla : In 10 years from now, do you know how high they grow? ' Conrad: We're talking wintertime. Headla : I just think that' s , there ' s a long value there . Then , I think you talked about working two 8 hour shifts? Olsen : I think they' re going to be open 24 hours . ' Headla: Did you notify the people around there if there's any real concern? Olsen : They were notified that the property was up for subdivision. They weren't notified of the site plan. The trucks , it' s all going to be internal and the truck traffic , from what I ' ve heard . . . Headla: That' s what you wrote but with the lights going and everything, I II just wondered , I really don' t see a problem but did you really look at it good? Are you satisfied that there 's very little probability of a problem? Olsen: Yes . . . Brown: If I might make the comment . In sitting through the last meeting with Lyman Lumber and now I hear the same issue coming up regarding the noise . The Commission should be advised that the Public Safety Director has recently put in for an order for a decimil meter and is working on the Noise Nuisance Ordinance, that ' s what it' s been nicknamed right now. I think if these problems do crop up at inappropriate hours, then people are obviously going to complain to the Public Safety Department. They' re going to go out there and have a meter , have a way of monitoring it and take appropriate actions from there . Conrad : I don ' t have any questions . I think it' s a good plan . I think McGlynn and staff have done a nice job. It's fun to see plans like this where we have very little comments . This is not typical . This is not typical at all so this is a real pleasure. The builder there has been working with the staff, as far as I know. As you go by there now, he has literally racked the land . Brought in bulldozers, he' s got huge piles of wood, the land is totally Istripped . 21 year old Austin Pine has been cut down . 50 to 60 year old Black Walnut. Serveral Red Cedars and they' re the oldest Red Cedars in it- that whole area and we have our Red Cedar Point where we have hardly any Red Cedars . He ' s totally changed the character of that particular part of Minnewashta Parkway. Those Red Cedars and the other stuff on the west I .
