On June 13 , 1988 , the City Council approved the preliminary
I assessment roll for the Trunk Sanitary Sewer Improvement Project
No. 86-13 . The attached June 9 , 1988 staff memorandum reviews
the particulars of the project and the assessment criteria. The
I preliminary assessment roll was modified as indicated in the pre-
liminary roll to reflect 32 units for the West Village Townhouse
properties. The total assessment amount has therefore been
increased to $370 ,200 versus the $343 ,200 in the preliminary
I roll.
On July 13 , 1988 , special assessment notices were mailed to all
I properties on the approved preliminary assessment roll.
Likewise, the assessment hearing notice was published in the
official newspaper on July 21 , 1988 .
II have received only minor administrative questions concerning
the roll and there have been no formal written objections filed
with this office as of the writing of this staff report. It is
I therefore recommended that , providing there are no unresolved
objections to the roll resulting from the public hearing , the
City Council adopt the attached assessment roll dated July 13 ,
II1988 and authorize certification of the roll to the County.

IISUBJ: Approve Preliminary Assessment Roll for Trunk Sanitary
Sewer Project No. 86-13 and Set Public Hearing Date
Project No. 86-13 involved the installation of trunk sanitary
sewer in the Chanhassen Lakes Business Park north to Highway 5 to,
in general , service the Eckankar , Burdick, James and a portion of
the Saddlebrook (Kerber ) property (see map) . With the exception
of some minor site cleanup, the project was completed last fall .
Since this is a trunk sanitary sewer installation, the feasibi-
lity
study proposed the funding of the project from the use of
trunk funds. Attachment No. 2 shows the assessment area for the
project and the attached prelimnary assessment roll was prepared
utilizing current ownerships of property in this area. Since the
majority of this property has not been subdivided, unit densities
were defined based on zoning criteria to arrive at a represen-
tative number of units for the unpiatted property. If the pro-
perty develops at a higher density than that which was calculated
for the assessment roll , these additional units will be collected
as a part of the building permit process . The density factors
utilized in preparation of the assessment rol are 3 . 25 units per
acre for R-12 zoning , 2. 25 units per acre for GB zoning and 1
unit per RSF. The unit assessment is $600/unit which is the
City' s current sanitary sewer hook-up change. I
The construction cost for the project was $218 , 945 . 65 . Indirect
fees totaled to $38 ,267 . 87 for a total project cost of
$257 , 213 . 52 . The total dollar amount assessed utilizing the
assessment criteria above is $343 ,200 . 00 , which is $85 , 986 . 48
more than the total project cost. This excess will be collected
into the sanitary sewer expansion fund ( 401 ) to cover other
operating expenses of the sewer utility system.

It is therefore recommended that the attached preliminary
assessment roll for Improvement Project 86-13 dated June, 1988
be approved for distribution and that an assessment hearing date
be set for July 18 , 1988. In accordance with the bond maturity
schedule, an interest rate of 8% and a term of 8 years is recom-
mended for those who choose not to pay the assessment in full.

NOTICE OF ASSESSMENT HEARING
CITY OF CHANHASSEN, MINNESOTA
NOTICE IS HEREBY GIVEN that the Chanhassen City Council will
meet at 7:30 p.m. on Monday, August 8 , 1988 , at the City Hall
Council Chambers to pass upon the proposed assessment for the
Trunk Sanitary Sewer Improvement Project No. 86-13 . The project
includes the installation of trunk sanitary sewer facilities.
Properties located within the service area and deriving benefit
from this project are proposed to be assessed. Specifically,
properties to be assessed include the following parcels:

The proposed assessment is on file for public inspection in
the office of the City Engineer . The total project cost
including legal , engineering , administration and fiscal costs is
$257 ,213 .52 . The amount proposed for assessment is $370 , 200 . 00 .
Written or oral objections will be considered at the meeting. No
appeal may be taken as to the amount of any assessment adopted
unless a WRITTEN NOTICE signed by the affected property owner is
filed with the City Clerk prior to the assessment hearing or pre-
sented to the presiding officer at the hearing. The Council may,
upon such notice, consider any objection to the amount of a pro-
posed individual assessment at an adjourned meeting upon such
further notice to the affected property owners as it deems advi-
sable.
An owner may appeal an assessment to the District Court pur-
suant to Minnesota Statute Section 429. 081 by serving notice of
the appeal upon the Mayor or Clerk of the City of Chanhassen
within thirty ( 30 ) days after the adoption of the assessment and
filing such notice with the District Court within ten (10 ) days
after service upon the Mayor or Clerk.

Residents who are 65 years of age or older, or retired by
reason of permanent and total disability may apply to have payment
of the assessment deferred. The application shall be made to the
City Clerk within thirty ( 30 ) days after the adoption of the
assessment roll by the City Council.
