BACKGROUND
' On May 20 , 1985 , the property owner of the subject site proposed
a two foot variance to the front yard and side yard setback for
the location of a 23 ' x 22 ' garage attached to the existing home
' ( see Attachment #1) . Staff had recommended denial of the
variance because it was felt that the side yard and front yard
setbacks could be met if the garage was moved back and away from
the side lot line. The applicant wished to have the garage con-
nected to the home and therefore wanted it adjacent to the house
which required it to be 28 feet from front lot line and 8 feet
from the side lot line. The Board of Adjustments approved the
' variance and increased the side yard setback by one foot per-
mitting the applicant to locate the garage 7 feet from the side
yard lot line and 28 feet from the front yard lot line ( see
' Attachment #2) . The variance was approved with the following
condition: That the garage walls shall be lined with
sheetrock.
' The variance from May 20 , 1985 , was valid for one year. If the
garage was not constructed within one year a new variance would
have to be received for the construction of the garage.
ANALYSIS
' The property is now under new ownership with the existing one car
garage still located on the site. The new owner of the property
is requesting the same variance which was approved May 20, 1985 ,
to construct a two car garage. Since the applicant is requesting
' the exact variance approved in 1985 , and conditions of the site
have not changed, staff is recommending that the Board of
Adjustments adopt the following motion:
' "The Board of Adjustments recommends approval of a 2 foot
variance to the required 30 foot front yard setback and a 3 foot
variance to the required 10 foot side yard setback for the loca-
tion of a two car garage at 7725 Frontier Trail with the
following condition:
' 1 . That the garage walls shall be lined with sheetrock. "

Chairman Johnson called the meeting to order at 6:50 p.m.
' MEMBERS PRESENT
' Willard Johnson, Dale Geving and Carol Watson.
STAFF PRESENT

Geving moved, seconded by Watson to table the Koehnen case until
' after the Robert Scholer case. All voted in favor and the motion
carried.
FRONT AND SIDE YARD VARIANCE REQUEST, 7725 FRONTIER TRAIL, ROBERT
' SCHOLER, APPLICANT
Olsen gave a brief overview of the variance request. She stated
' the applicant is proposing to construct a 23 ' x 22 ' garage
attached to their existing home (see site plan) . The garage will
be 28 feet from the front yard lot line and 8 feet from the side
yard lot line. Thus , two variances are required, a 2 foot
'_ variance for the front yard setback of 30 feet and a 2 foot
variance for the side yard setback of 10 feet.
She stated that the existing home lies on the front lot line and
is therefore a non-conforming use. The Zoning Ordinance states
that non-conforming uses cannot be enlarged. There is an
' existing one car detached garage on the property (see
photograph) . The applicant wishes to remove this garage and
replace it with the larger attached garage.
' She stated that the applicant is requesting a 2 foot variance to
the front yard setback. The applicant has stated that this
request is due to the slight slope at the rear of the lot . Staff
' believes the 30 foot front yard setback can be met and should be
enforced.
' Tom Rojina stated that they wanted it 28 feet from the front yard
lot line so that it would connect with an existing rear access of
their home.
Johnson asked if they would be using sheetrock on the garage
walls.
Tom Rojina stated that they would.
Geving moved, seconded by Watson , to grant a 3 foot side yard
variance to allow the garage to be enlarged to a 24 foot width
and to grant a 2 foot front yard variance. All voted in favor
and the motion carried.

the front yard lot line and 8 feet from the side yard lot line. Thus,
two variances are required, a 2 foot variance for the front yard set-
back of 30 feet and a 2 foot variance for the side yard setback of 10
feet.

conforming use. The Zoning Ordinance states that non-conforming uses

Section 7 .05 (1) of the Zoning Ordinance states that adequate
space shall be reserved on the site to allow for the construction
of a two car garage. For the proposed two car garage to meet the
side yard setbacks of 10 feet it would have to be 21 feet wide.
It currently is proposed as 23 feet.
The Board of Adjustments and Appeals shall not recommend and the
Council shall not grant, a variance unless they find the following
fact :
1. That there are special circumstances or conditions affecting the
land, building or use referred to in the application for variance.
2 . That the granting of the variance is necessary for the preservation
and enjoyment of substantial property rights.
3 . That the granting of the application will not be materially deteri-
mental to the public welfare or injurious to property in the area
adjacent to the property for which the variance is sought.
4. That the granting of the variance will be in keeping with the
spirit and intent of this ordinance.
The Board of Adjustment and Appeals in recommending and the City
Council in granting a variance may impose conditions to insure
compliance and to protect adjacent properties.
