From the beginning, Rick Novak has always been cooperative in keeping the job sites as clean as possible. Dumpsters are provided at each I new home under construction. Labor crews clean the job site daily and as needed along the silt fence and pond. Recently, complaints have been received about the litter in the pond. On Wednesday, June 15th, I spoke with the job superintendent at Chan I Vista about the litter in the pond. That same day his laborer was sent to clean all litter in and around the pond. As of June 13 , 1988 , Rick Novak has hired a full time laborer, his sole job I will be to keep the subdivision clean. Hopefully, this will stop further complaints from residents about the trash in and around the Chan Vista subdivision. Try to remember that along with construction, there will always be some litter, muddy streets , I dust and noise. I will continue to check on the clean-up not only at Chan Vista but all new developments and construction sites . This Department 1 will monitor the radiochemical levels in your water supply and inform you of any actions necessary. Timberwood Estates Cemetery Lot Attached please find correspondence received from the City Planner regarding a proposal from Mr. Hartung (also attached) . IOutlot A of the attached drawing was required to be dedicated as public right-of-way as a part of the County' s review of this sub- ' division. Accordingly, the City did not request or make this a condition of local approval except to note required agency con- ditions . I was aware of the 75 ft. outlot from many years back, but had not believed that such was being used for cemetery pur- 1 poses . The current map appears to indicate that such is being used for cemetery purposes . To the best of my knowledge, the 75 feet shown for Outlot A is not being used for cemetery purposes, I but does act as a parking area in the front of the cemetery pro- perty. it should be noted that this parking area has existed in its current condition for the past 100 years (corner stones in the front of the property and front grave sites appear similar I in age to the oldest portions of the cemetery itself) . The line marked "fence" currently acts as the easterly boundary for I the cemetery. it would appear as though there was an original surveying error which lead to the entire cemetery having a description which was approximately 50 ft. to 75 ft. east of the Iactual location of the cemetery. What is our legal position on this issue if suit were to be ini- tiated? Please call so that we can discuss such. You may wish Ito precede your call with a telephone conversation with Barbara regarding the history of the site and/or conditions of the County. l 1 . Mr. Roger Knutson ' May 23 , 1988 Page 2 ' II. West 78th Street Detachment Attached please find correspondence received from Roger ' Gustafson, County Engineer, regarding the West 78th Street Detachment Project. As can be seen from the attachments, Mr. Burdick is currently questioning the procedures followed by the County in not allowing for the private right-in/right-out on the ' existing West 78th Street alignment and the requirement for the cul-de-sac in this area. With the County' s action to delete the right-in/right-out comes the question as to what procedures the ' City should follow in moving forward with our West 78th Street detachment. Gary Warren notes that the issue of the right-in/ right-out was one of the allowance of a private driveway and not ' an issue which is addressed in the feasibility study for West 78th Street detachment. Accordingly, the two issues could be separated and thus allow Mr. Burdick and/or the City to pursue the right-in/right-out issue separately from the detachment. As ' we previously discussed, the City did retain Harvey Swenson to consider whether the detachment issue presented a potential liability or damage position for the City. As you may recall, ' Mr. Swenson' s position was that such was not the case as the new roadway would serve all of the proposed lots and, although incon- venience may be claimed, such was only being done to insure that safe and adequate access was achieved, i .e. if the City did not ' make the improvements, West 78th Street would fail and with it could come a claim for damage because of inaction. ' To insure that you, Gary, and myself are all working from the same play book, I would ask that you set up a time to review the files and feasibility study. Following your review, I would like ' to have the three of us meet to discuss whether the City needs to formally request that the feasibility study be modified; that a new public hearing on the detachment be held; that the two pro- jects be separated with a hearing then being held on the driveway ' question; other? III. Natural Green - Old Railroad Depot Building ' I have not heard anything on this issue for quite some time. What' s up? ( see attached older correspondence) IV. We have been told that you are aware of this problem and we would ' like to resolve it as I ' m sure the city would also . The following proposal is being offered for your consideration and approval as a solution to resolve this problem . We propose to offer a quit claim deed to the cemetary , encoachment ' to the West and North , in exchange for approving Outlet C as a buildable lot . We believe there is plenty of land available for building and drainfields on the lot . ' If our proposal is accepted , the city would be receiving approximately 30% additional cemetary space without any additional expenses . ' We thank-you and hope we can come to a satisfactory agreement on this matter. I went out with our Assistant City Engineer, Larry Brown to take a look at the 1 concrete flared end section behind 6240 Near Mountain Boulevard. Mr. Brown will be meeting with the Public Works Director, Gary Warren, to see if a safety grate is warranted for that location. 1 I have also sent a memo to Gary Warren to see what can be done about the debris in the holding pond behind 6228 and 6226 Cascade 1 Pass . I will let you know as soon as I hear anything from Mr. Warren. One of the members at the association meeting asked who she could 1 contact at the DNR that might be able to advise her regarding the algae growth on the holding ponds . Two names were suggested to me, Judy Boudreau and Mike Peliquin with a phone number of 1 296-7523 . I would suggest contacting either one of those people at the DNR and hopefully they would be able to advise what reme- dies to take to eliminate the slime and algae conditions of the ponds. - 1 Slow children signs are prohibited by MNDOT and would not be recommended by the City. My favorite discussion that night regarded the speed limits on the streets in your neighborhood. I was most intrigued with the 1 vote requesting a 17 mph speed limit. Although I do not know how feasible this would be, I did discuss it with our Assistant City Engineer, who was also interested. I have drafted a letter to our City Attorney to find out what requirements we have to 1 fulfill as a City to post and enforce lower speed limits on cer- tain identified roads . I will keep in touch and let you know what I find out. 1 I Mr. Jim Wehrle June 14, 1988 Page 2 ' One of the other requests that night regarded the plantings of wild berry bushes and other landscaping along the berm behind Mountain Way. I have checked with various departments in the City and I have been advised that would be okay. I have referred the weed complaints on the vacant lots, specifi- cally Near Mountain Boulevard and Trappers Pass, to our Deputy ' Weed Inspector, Scott Harr. He will drafting a letter to the owners of the lots to mow them before they become unsightly and noxious . ' Regarding the lights that never seem to work on your streets, I will be sending a letter to NSP asking that they come up with a ' solution to the problem once and for all and that regular main- tenance be conducted to prevent the lights from malfunctioning. The question on when the new park will be completed was answered ' by the Park and Recreation Coordinator, Lori Sietsema, who states that the grading is presently done and that work will continue throughout the summer. ' Concerning the roof inspections on the list that was given to me by Deb Wolfe, every Tuesday from 9 to 10 a.m. , my building offi- cial and a representative from Lundgren Bros. checks some of the ' houses on the list. To date, 20 to 25 homes have been inspected and three have been found to have minor problems . All three have now been corrected, and on one occasion, the factory rep came out ' to inspect the roof that may have had some warranty problems with the shingles. • ' I hope this answers some of the questions that were brought to me the night of your meeting. I have explained to the callers that there are restrictions that we have 1 to abide by when creating a speed limit for a particular roadway. I think I am correct when I tell them that by state law the lowest speed limit that can be placed on a roadway is 30 mph. However, I go on to tell them that under certain situations lower 1 speed limits may be mandated, these include bike paths on road- ways, school zones and by order of the state commissioner of transportation after an engineering review of the roadway in 1 question. I do sympathize with most of these callers and I would like to 1 see lower speed limits placed on some of the roadways . Would you explain the process in which this City may lower the speed limits on certain residential roadways , i .e. Near Mountain Boulevard, Pleasant View Road, Kings Road, and Lake Riley Boulevard. On a side note the Near Mountain Homeowners Association recently 1 voted to lower the speed limit in their residential area to 17 mph. It was suggested by the group that a very unusual speed limit such as 17 mph would certainly, if nothing else, grab the attention of the potential violator . I checked on the tent that is on Outlot 12 , a blue and yellow one and it is there illegally. I have contacted the Frontier Trail Homeowners Association advising them to remove the tent. I also ' checked on the old Carver Beach access and although I could see no evidence of boat launching taking place, I have been informed by other neighbors that there is , in fact, boat launching taking ' place at that location. I will be working with the park and recreation department to provide some sort of barrier to prevent boat launching from taking place. In response to the mooring of the boats off park property, as I indicated, there is no city ' ordinance nor is there a DNR regulation that would prevent it. The speed boat that is beached on park property near the old ' access is in violation of city ordinance if it is there over night. I have run the registration and have learned that the boat belongs to the house directly in front of where it is ' beached. When I knocked on the door to inform them that they were in violation of city code, there was no answer. 1 will send a letter to the owner advising them of the code violation. ' It is nice to stay in touch with the citizens and listen to their concerns. We want to respond in a timely manner with whatever resources are available. At first I thought it might be just start up problems with the newness of the assigned tasks , however, it now appears to be a communications breakdown. Periodically, I put 1 out police pass-ons indicating certain problem areas in the City that we wish to have the deputies keep a close eye on. These pass-ons also include certain specific details that we wish to have them accomplish. Some of these details include opening and 1 closing the gates at Lake Ann and the South Lotus Lake boat access. Other details include special traffic or radar enforce- ment requests , park checks, and, of course, the ever important 1 sprinkling ban. For the most -part we have good compliance, however, ( I suspect ' due to the constant changing and substituting of personnel working in Chanhassen) some of the details are not getting taken care of . The main problem appears to be the gates at Lake Ann - and South Lotus Lake boat access. They are just not getting 1 opened at 6 a.m. as we have requested which prompts irate fisher- man to call this office wondering what is going on. We have established a procedure to communicate these requests to the 1 deputies . As always the primary communication tool is by word of mouth and verbal request by me to the specific deputy. However, as an insurance measure, I do periodically put out police pass- ons that I referred to earlier. I make a copy of the pass-ons and put them in each Chanhassen deputies tray at City Hall. I also post one in the police pass-on on book which each deputy is to read through and keep up with what is happening in the City of 1 Chanhassen. In addition, I send one down to your office to let the dispatchers and the supervisors know what is going on. Somehow, though, the word is not getting through and some of the 1 - ' Sheriff Al Wallin June 14, 1988 Page 2 details are not getting done, specifically the gate openings to ' Lake Ann and South Lotus Lake boat access . On a similar note, it appears there is a communications breakdown ' in regards to our new CSOs that we hired. Scott Harr made arrangements through Jim Castleberry to have our CSOs ride with individual deputies during their training period. Jim Castleberry stated to Scott that everything would be arranged and that the CSO would just call and the deputy would pick him up. This weekend one of our new CSOs came in and called for a ride- a-long and it was refused because no prior approval had been ' granted. The purpose of this letter is, hopefully, to open up the lines of communication a little better than they have been. If, at your ' staff meetings, you could stress the need for communicating these requests and passing on some of the information such as the new CSOs, then, hopefully, these breakdowns can be avoided and we will have a much smoother running operation. It is my understanding that the Chamber is looking at the potential of renaming one or more streets within the downtown area. Their work would be solely that of an advisory board as the City Council is the only body which can create or rename streets . Thank you again. Sincerel , Don Ashworth City Manager DA:k June 16 , 1988 To The Honorable City Council or To Whom It May Concern Chanhassen City Hall 690 Coulter Drive Chanhassen, MN 55317 I am writing this letter in the form of a request that consideration by the City Council or those in authority be given to name a street in the City of Chanhassen to incor- porate the name "Pauly" , preferably in the area which was once the old village. As an example, "Pauly Place" , "Pauly Drive" or some other form using the name "Pauly" . My great grandfather, Nikolaus Pauly, and his bro- thers Henry and John, were the first homesteaders in this area, having come from Germany in the year 1853. My grandfather, Henry Pauly (who was named after his uncle) , was born in 1855 and was the first recorded white child born in Chanhassen Town- ship. Of the very earliest settlers to come to this area, ancestors of the original Pauly families ( of which there are a number of us) are the only remaining ones. Consequently, our roots are the deepest of anyone in the area. My great , great uncle, Henry Pauly, donated a sub- stantial amount of land to the church where the old church and cemetery are located, as well as the land south of this area which was later sold by the church. The Paulys were very active in laying the foundation for a community, later in the incorporation of the village, and throughout the years of its growth. It is my sincere belief, as well as that of the other Paulys in this community, that it would be most appropriate for a street to be so named, especially in view of the fact that streets have been named after families who settled long after the arrival of the Paulys. Any consideration to this matter will be greatly appre- ciated. BOX 147 • CHANHASSEN, MINNESOTA 55317 (612) 937-1900 MEMORANDUM TO: Park and Recreation Commission and City Council FROM: Todd Hoffman, Recreation Supervisor �/V/ DATE: June 23 , 1988 SUBJ: 4th of July Chanhassen' s 1988 4th of July celebration is going to be bigger than in past years thanks to the continued support of Chanhassen' s businesses and some new involvement of two local civic organiza- tions. The celebration is scheduled for the three day weekend of July 2, 3 , and 4 . Saturday' s events include the return of the Men' s Softball Tournament and the addition of a co-rec softball and volleyball tournament, an adult fishing contest and sailboard demonstrations . The Chanhassen Rotary will be operating two concession stands, one for the tournaments and the other at the beach. Sunday is family day at the park with the return of the kid' s fishing contest, family games and innertube races . New events include fire truck tours, horse rides, sand castle building and a Ronald McDonald show. The Chanhassen Women of Today will also be providing carnival games and the Rotary will be back with concessions . Monday night includes the return of the street dance featuring 50' s and 60 ' s music by the Hi-Topps, the community picnic and the largest fireworks display ever presented in Chanhassen. New attractions include caricature artists, a face painter, a mime, a juggler, Chanhassen Women of Today carnival games, Chanhassen Rotary concessions and beer garden and a huge red, white and blue balloon release. The location of Monday night' s events will be the south half of the Chanhassen Dinner Theatre parking lot. This location was chosen for two reasons. It provides us with an opportunity to introduce the residents to the redeveloped down- town area and for the lack of a reasonable alternate location. Banner Fireworks Display Company will no longer launch the fireworks in the City Center Park area and Lake Ann Park is limited by parking capacity and congested traffic patterns . The location for the 1989 celebration is an issue which has yet to be decided. The downtown lighting ceremony will include a speech by Park and Recreation Commission June 23 , 1988 Page 2 Mayor Hamilton, concluding with the lighting of the new street lights and twinkle lights in the boulevard trees, complete with the launching of a burst of fireworks. The celebration location will include a 40 ' x 80 ' lighted circus tent, seating for 500 people, a stage and dance area, a beer garden, concessions, car- nival games and satellites . The entire area will be roped off with red, white and blue banners and decorated with festive balloon bouquets. I urge you to pass the word about this years 4th of July celebra- tion. If you are able and willing to assist in any of the events taking place over the three days, please let me know. You do not need to commit yourself for an entire day. Any assistance you can provide on a particular event is needed and would be appre- ciated. The Park and Recreation Department is the driving force behind this celebration, with the continued support of those already involved and with new groups becoming involved each year, this celebration is becoming a tradition residents look forward to.
