J a y 23 , 1989 City Council meeting, as a part of the
I TH 101/TH 5 intersection configuration approval staff was
directed to further review the site access for the Sinclair gas
station located on Dakota Avenue and the Trunk Highway 101
realignment impacts and phasing for the Blue Circle Investment
I Company property previously known as the Q Superette located on
Lake Drive East at Great Plains Boulevard. The attached
correspondence from BRW summarizes our efforts to address the
I concerns raised at the January 23 meeting. As noted in the
attached correspondence, letters were sent to the Sinclair sta-
tion and to Mr . Pat Hallisey to document the results of our
further review.
ISinclair
I Concerning the Sinclair station, staff was able to shorten the
proposed median on Dakota Avenue such that a full access driveway
is maintained for the southerly access at the Sinclair station
I and a right-in/right-out access is provided for the northerly
driveway to the Sinclair station. Also, a new driveway access is
proposed to be constructed off of Lake Drive East to help facili-
tate access by tanker delivery trucks. As of the writing of this
I memo, no further correspondence or discussion has been received
from the Sinclair station and it is our understanding that this
proposal addresses their concerns.
IBlue Circle Investment Company (Total Mart)
We have received the attached letter dated February 17 , 1989 from
I Blue Circle Investment Company. As stated, Mr. Hallisey' s first
choice would be to have Phase III (Lake Drive East) built at this
time. However, as reviewed previously with the City Council , the

estate intentions for development. For the City at this time to
force construction of this roadway would undoubtedly result in '
condemnation procedures for the acquisition of the right-of-way,
adding prohibitive costs to the process and unquestionable objec-
tions from the Ward estate. ,
The phasing program as represented would hold off on any
redesignation of TH 101 until the north leg option of the TH 101
realignment becomes a reality. At that time MnDOT would
undoubtedly require Phase II as shown to be constructed and the
TH 101 designation moved to Market Boulevard. It is proposed,
however, to keep the present TH 101 roadway in service until
Phase III would be built.
While, as noted, to force the construction of Phase III at this
time would be impractical , I believe the attached phasing program
accommodates as best as possible the concerns of Mr. Hallisey.
There are many factors , economic and otherwise, which will affect 1
the progress and development of the roadway system and properties
in this area which none of us are able to predict with 100% cer-
tainty. It is clear to state, however , that staff will continue
to work closely with Mr. Hallisey as more and more of the
unknowns become realities and to remain sensitive to his concerns
as we proceed.
It is therefore recommended that the City Council approve the
site access configuration for the Sinclair station as documented
in the February 9 , 1989 BRW correspondence to Ivan Johnson and
likewise that the City approve the phasing concept for the Trunk
Highway 101 realignment as presented in the attached report from
BRW. ,

Concept Approach

I The Chanhassen City Council at their January 23, 1989 Council meeting, asked
that two specific areas be reviewed relative to the TH 5/TH 101 plans. The
two specific areas of concern are:
I1. Sinclair Gas Station access.
2. The staging of TH 101 relative to the Retail Center (formerly Q Superette).
II As you requested, we have reviewed each of these issues in conjunction with
development of the TH 5 and TH 101 plans and we would like to offer the
following information for your review.
I1. SINCLAIR STATION ACCESS
We have reviewed the Sinclair Station and its access to Dakota Avenue and
Ihave revised the geometrics to accommodate full access to the Sinclair
Station from their south driveway. In addition, we have modified the plan
to reflect a new thirty-foot driveway out the west and back exit of the
I Sinclair Station, this access connecting to Lake Drive East. Revised con-
cept plans for the Sinclair Station were sent to Mr. Ivan Jonnson on
February 9, 1989, for his review and comment. As of this date, we have not
II received any additional input from Mr. Johnson. We are recommending that
the layout, as shown on the attached Figure 1, be approved and be incor-
porated into the TH 5/TH 101 plans. (Copy of correspondence to Mr. Ivan

II2. TH 101 CONCEPT STAGING
I One of the significant concerns expressed by Mr. Hallisey of Blue Circle
Investment Company, owner/operator of the Retail Center, has been access
from the south from the Lake Susan Hills area. In reviewing the staging of
II TH 101, we have identified a three-step staging process which assures Mr.
Hallisey of continuous access between old and new TH 101 and access to his
station from the south. The attached Figure 2 illustrates this staging for

We understand that Mr. Hallisey has reviewed this information and responded to
you in separate correspondence which we assume you will provide the City Council
for their review as appropriate. '
Based upon our current understanding of the relevant issues, this appears to be
the most appropriate approach in addressing Mr. Hallisey's concerns. It is very
important to note, however, that upon removal of the TH 101 designation from the
old roadway, and conversion of old TH 101 to a local access City road to serve
Mr. Hallisey, the City would assume liability for this roadway. We recommend
that prior to utilizing this roadway as a local City street, the City review
this roadway for any safety/liability concerns, and consider taking the
appropriate remedial action to correct any safety deficiencies.
We hope that the summaries above address the concerns of the City Council as '
expressed at the January 23, 1989 meeting. We recommend that the access issues
described above and the staging plans for the TH 101 construction be approved as
submitted. We anticipate being present at the February 27, 1989 City Council
meeting to review these with you and the City Council as necessary.

At the January 23, 1989 City Council meeting, the final intersection geometrics
for TH 5 were reviewed. The final geometrics as they related to your property
(Sinclair Station) were of particular concern. The City Council requested that
we reexamine the layout of the medians as they front your property.
Enclosed is a revised layout illustrating the roadway geometrics for Dakota '
Avenue. Please review this layout carefully, and respond in writing with any
questions or comments you may have. We hope that the revisions we have made
satisfy the access needs that you have. '

Dear Mr. Hallisey:
As a follow up to your meeting on Monday, February 6, 1989, with Gary Warren
and Fred Hoisington, Mr.. Warren asked me to forward to you schematic drawings
which illustrate the TH 101 realignment plans as developed to this point.
Of particular interest to you would be the staging of the improvements. While
this staging plan has not been finalized or approved by either MnDOT or the
City Council , it represents our best estimate of the staging at this point
in the development of the project. Note that this staging plan maintains a
connection between Old TH 101 and New TH 101 at all times thus insuring a contiguous
route to your retail center from the Lake Susan Hills area, which was one of
your concerns.
We hope that this helps you understand the project as it is currently being ,
developed.

We will be reviewing this with MnDOT representatives February 24, 1989 and '
the Chanhassen City Council on February 27, 1989. We would appreciate any

Dear A Ir. Warren:
' We are in receipt of a February 14, 1989 letter and plan from B.R.W. which deals
with the above captioned subject.
' While we have not abandoned our often stated position regarding the realignment
of TH 101, we will not address that subject in this letter.
This letter will only address our thoughts, concerns, and recommendations regarding
the phasing of the subject B.R.W. plan.
Phase 1 of that plan calls for the 1989 construction of what you intend to be the
' future TH 101 from TH 5 to Lake Drive East. This raises two major concerns;
A This piece of road should not be designated as TH 101 until such time as
' the road is completed to the existing TH 101, as should you do so you will
have built a dead end state highway.
B. As soon as you designate some road other than the existing TH 101 as the
official TH 101 you trigger the lease termination right we have previously
advised the City that our major tenant has within its lease.
' Phase II calls for the 1990-1995 construction of what you intend to be the future
TH 101 south of Lake Drive East with old TH 101 remaining open as a temporary connection
to new TH 101.
Phase III calls for the extension of Lake Drive East to the west of our property
and the abandonment of the current TH 101 south of Lake Drive East.
' Our comments regarding Phase II and III are intertwined.
First, while we are pleased that you are at least willing to leave current TH 101
open to the south of Lake Drive East until such time as Lake Drive East is extended
westerly of our property to the road you intend to be the future TH 101. this is far
from what we were promised by prior City officials and, at best, we consider it to be
the least of all evils.

We implore the City to honor its past assurances to us and complete Lake Drive
East as a part of Phase I.
Should the City be unwilling to honor those past assurances we respectfully request
that they delay the implementation of Phase II and the official realignment (redesignation)
of TH 101 until such time as Lake Drive East is completed.
