Before the City would agree to this, it is necessary to identify the current condition of the existing roadway. If defi- cient from City standards for new construction, necessary repairs would be required to bring the roadway up to standard. 1 In order to accomplish this, the following steps would need to be completed before staff could recommend public ownership to the City Council: 1 A. CHANHASSEN STREET STANDARDS ARE 7-TON MINIMUM FOR RESIDENTIAL ROADWAYS 1 The construction plan of Deerfoot Trail developed by Schoell & Madson, Inc. does not clearly state the amount of gravel placed under the bituminous surface. To be assured of a _ 1 7-ton street, it will be necessary that a Road Rater analysis be made to determine what was actually built. The Road Rater is a vehicle that can calculate street deflection by non- destructively testing the roadway with an oscillating 1 hydraulic weight applied to the road surface. Through electronic sensors a pavement deflection is measured and thereby pavement strength is determined. The cost to perform this service would be approximately $1 ,000 and will be at the homeowners ' expense. Additional bituminous surfacing, if any, necessary to comply with the 1 standard 7-ton street will also be at the homeowners ' expense. 1 1 Alan Dirks I February 21 , 1989 Page 2 B. ROADWAY WIDTH/LIABILITY Due to its narrow width (18 feet) , Deerfoot Trail does not 1 meet City standards for carrying two-way traffic as a public roadway. It will therefore be necessary to post this road for one-way (counter-clockwise) travel . ' In addition, the roadway would need to be posted for no parking on both sides of the roadway. If the homeowners association wanted street parking, a portion of Outlot A would have to be reconstructed to allow parking. The cost to install the necessary signage would be at the ' homeowners ' expense. Likewise, Outlot B, which encompasses the road right-of-way, would need to be dedicated to the City. C. EXISTING STORM SYSTEM The existing storm water drainage facilities are not in accordance with City standards in that overland and/or sheet drainage is utilized. While we would not require any changes at this time, it is important to clarify that the City will not assume with the transfer of ownership any liability for any storm sewer problems within the neighborhood. If correc- tions or alterations would be encessary in the future to address erosion and/or storm water problems of the sub- division, this would be undertaken at the expense of the benefitting property owners . The estimate to establish the new exit came in at $1800 and Steve Kirchman will be staying on top of this. Lakeview Hills: Building A should receive a citation or formal ' complaint for violation of the orders written by Steve Kirchman. Building B, also in violation of code, has been given 30 days , which is rapidly approaching the deadline. Again, Steve will be ' staying on top of this one. Sprinkler Permit: Sprinkler permit fee notices have been sent to "ost of the sprinkler companies letting them know about our new ordinance. Fire Alarm Permit: Mark is working on a fire alarm permit and ' will be getting back to us when prepared. NEW BUSINESS ' Building Numbers : Apparently the Chanhassen Inn does not have any building numbers . Scott will be looking into this . ' Help for the Inspection Department: Although possibly under old business, we are continuing to look at our potential needs for help in the Building Inspection Department not only at present, ' but on an on-going basis. Steve Kirchman and Ron Julkowski will be getting the stats together the best they can and fitting it in in their spare time, which they have none of. They will then be submitting their proposal and report to Scott Harr. ' First Aid Training: On February 22 and 23 from 12 : 00 p.m. to 4 : 00 p.m. on both days, there will be first aid training held at U City Hall in the Council Chambers. This training is being offered by Waconia Ridgeview Hospital and all City employees are invited to attend. BOX 147 • CHANHASSEN, MINNESOTA 55317 (612) 937-1900 1__ MEMORANDUM TO: Mayor and City Council 1 _ Public Safety Commission FROM: Jim Chaffee, Public Safety Director ' DATE: February 21, 1989 SUBJ: Donation of a Public Safety Vehicle On Friday, February 17, 1989, Sheriff Al Wallin, City Manager Don 1 Ashworth, and myself met with Tom Redmond, Sr. and his staff of Redmond Products. The topic of discussion was the donation of a vehicle to the City of Chanhassen. It was our desire, based upon 1 the suggestion of Mayor Don Chmiel at the Commission meeting, to resolve some of the confusion that surrounded the donation of the vehicle. After explaining the circumstances leading up to our meeting, Tom Redmond, Sr. was very understanding and agreeable. He stated that they intended to do something like this on an on-going basis 1 and suggested that next year the County receive the vehicle. Upon further reflection, we suggested that in fact the County should receive the vehicle this year with- the second vehicle 1 donated..by Redmond Products going to the City next year. This compromise was reached to avoid any of the controversy that here- tofore has been surrounding the donation of the vehicle to the ^ity of Chanhassen. : By working out this compromise, we were able I to buy time, if:youu will, to work out the precise details that would go along- With the donation of the vehicle. The meeting was upbeatand constructive and I firmly believe a 1 workable compromise was reached where all parties came out win- ners. II 29 , March 25 and June 3 , 1987 ) on the proposed "Concept Layout" . The City Council then approved "Concept Layout 3A" , with the addition of a proposed T.H. 101 interchange, at their June 29 , 1987 meeting. IThis layout is essentially the same except we have made the following additions : I - Areas needed for ponding and or wetland replacement have been shown on the layout . - Approximate construction limits have been shown on the layout. Improved connections to existing TH 101 in the Chanhassen Hills area have been added to the layout. I - A frontage road was added left of approx. Sta. 1080± and 1090 . The City has made payments through and including the most recent pay request, i .e. Partial Pay Request No. 12 , and has no outstanding pay requests 1 in our possession on this project. You may wish to confirm this with your prime contractor, Shafer Construction, who is respon- sible for ultimately making payments to you as subcontractor. 1 I am aware that our consultant, BRW, and Shafer are in the pro- cess of preparing Partial Payment No. 13 for this project. You may wish to talk with Shafer Contracting concerning what items ' will be included on Partial Payment 13 . This I would anticipate will be processed in March after the City Council approves Change Order No. 2 for the project. As you are aware, this project, including all contractor pay requests, is governed by MnDOT standard specifications for construction. In light of your allegations, I have asked BRW to review the current status of the project, in particular, addressing Specification Section 2571 - Plant Installation, and Specification Section 2575 - Turf Establishment as it relates to ' your current pay status on this project. Their findings indicate that the City has paid approximately $179 ,824 .00 to Shafer for the complete landscaping elements of the project, based upon the unit bid prices of the contract. 1 ' Mr. Henry Sandbulte February 16, 1989 Page 2 BRW confirms that this is a current figure and that application ' of the MnDOT specifications indicate that the amount actually due is less than this; therefore, if anything, the City has overpaid on these pay request items . We are confident that our findings are correct in this matter. I ' am sure you understand that the City is required and will con- tinue to make payments in accordance with the specifications which govern this project. Attached is their February 15 , 1989 report on the results of this sample which , in their opinion, is not septic in nature and which they believe to be the result of a 1 natural occurring spring that has started flowing to the surface. We concur with this conclusion. State statutes require that II amendments to the Master Plan be addressed by a Solid Waste Ad- visory Committee that is made up of one third solid waste haulers, one third interested citizens, and one third elected of- ficials. Carver County is in the process of choosing a resource I recovery/processing facility to send solid waste to rather than landfilling it. Selection of such a facility will require amend- ing the Solid Waste Master Plan. Thus we need an active Solid I Waste Advisory Committee to recommend changes to the County Board. Attached is a public notice that will appear in all local papers I this week. It further explains the Committee and the application process. I call your attention to it for two reasons. One, as al- ready mentioned, we will need three or four elected officials to serve on the committee. A copy of your letter, as well as this response, will be forwarded to the City Council. As you are aware, the City of Chanhassen has urged the State to 1 upgrade Trunk Highway 5 for many years . We have an excellent working relationship with the Minnesota Department of Transportation (MnDOT) and I am confident that they will attempt to respond to the needs of our City and citizens to the extent possible. ' However, it must be remembered that State Highway 5 is exactly that - a State highway. Accordingly, safety and the ability to effectively move vehicles through Chanhassen continues to be pri- mary objectives of MnDOT. To this end, they will make final decisions on highway design considerations/safety. 1 Where do I start? Your letter touches on innumerable subjects. I will attempt to respond in the order listed, i.e: - Ability to Connect to Sewer/Water: Municipal water 4,4 ;:.- currently exists adjacent to the southerly right-of-way line of Highway 5 . The costs of tunneling under Highway 5 for a singular service is not practical. The likelihood of 1 a line being constructed along the north right-of-way is not foreseen. The large ravine adjacent to you would make this construction very difficult. It is nice to know that water service would be available, albeit expensive, should 1 your well fail. Your property currently lies outside of the Metropolitan 1 Urban Service Area (MUSA) . Accordingly, the Metropolitan Council ' s policies would not allow for the connection of your home to the sanitary sewer recently constructed under 1 Highway 5 to the west of your property. The Metropolitan Council has made exceptions to this policy where existing 1 Mr. & Mrs . Ray Notermann ' February 22, 1989 Page 2 homes have septic system failures . Similar to the water issue, connection to the sanitary sewer would be costly given the length of the run and the depth of the sanitary sewer. Again, similar to the water, knowing that it is available if a failure occurs should provide some comfort. - Proposed Median: The State' s desire to see a median built from County Road 17 to Audubon Road is not new. When the Chanhassen Lakes Business Park was created (approximately 11 1978) , the State allowed for the connection at Park Drive. That approval was clear in that any roadway to the north of Highway 5 would have to intersect Highway 5 at Park Drive and therefore allow that intersection to become a full intersection at some point in time. The plan showed a median for the entire length of Highway 5 between County Road 17 and Audubon Road. The plan also noted the necessity of the City to relocate the Lake Ann entrance road to Park Drive. Accordingly, future users of Lake Ann Park would take Highway 5 to Park Drive, proceed northerly on new Park Drive to the new park entrance, and then proceed westerly to gain access to the various parts of the park. Although the question has never been posed, I would anticipate that the City would be willing to work with you in potentially allowing your driveway to connect into the frontage road which would go back to Park Drive. The reason cited by the State in requiring the Lake Ann entrance to be relocated was safety. Visibility at the current park entrance, as well as your own property, is very poor. The chances for a serious accident continue to rise. The dangers can be significantly reduced by a relocated park entrance road. Park Drive may at some point in time be signalized - a possibility that could not occur without the relocation. You mentioned that you do some daycare. As a parent myself, I would be very concerned with having my family drive in and out of your driveway in its current condition. With increasing traffic volumes on Highway 5, the condition will only worsen. Having the alternative of potentially having a safe entrance via a frontage road from Park Drive should be highly considered to insure the safety of children using your property. ' - Poor City Planning: Of all of the points raised, this item was the most disheartening. The City has the right to require streets/right-of-ways/sewers/etc. , as a condition of plat approval. Once platted, the individual purchasing a lot can reasonably expect to be able to use the property in conformance with City ordinances. The City cannot "take" your land without compensation. Even though the 1 I Mr. & Mrs . Ray Notermann February 22, 1989 Page 3 City had virtually no ability to require any of the devel- opments along Highway 5 to either give lands to the State or to move their structures to greater setbacks than required by ordinance, the City has consistently notified the State/all other affected agencies of each and every proposed development. In the case of the Roos storage facility, we did, again, contact the State prior to that permit being considered by the Planning Commission/City ' Council. Even though no authority existed, the developer did move the structure to the south to accommodate the request for such from MnDOT. Similar to yourself, I have ' recently heard the rumor that a portion of that structure will be removed. That is disheartening recognizing the efforts that the City put forth to insure that that type of thing would not occur. I firmly believe that the City' s efforts are commendable and assuredly do not deserve the label of "poor planning" . 1 During the hearing process , we too heard the rumor that the roadway was moved to the south versus the north "because of bureaucracy involved using park land" . This rumor may be true. The current Lake Ann Park site (original 60+ acres ) was paid via city/state/federal monies . The initial grant process gains input from approximately five to six dif- ferent agencies at both the state and federal level. The rankings of each of the agencies are used to determine which projects on a state or federal basis should be funded. To dispose of properties obtained through state/ ' federal monies requires the same check-off system that was required on the initial grant and can take one to two years to process. One factor that the State may not be considering is the fact that the recently acquired 24 acres lying east of Lake Ann Park was purchased solely through City dollars. The ' City has previously been successful in disposing of proper- ties-purchased by state/federal dollars if we prove that the properties being eliminated would be replaced with ' similar acreage meeting similar needs as were considered in the original. grant. This option would require acquisition of -your parcel. Reconsideration of this decision by the Minnesota Department of Transportation may be possible. The-question posed to you is- - do you wish the City to pur- sue this option knowing the likely consequences of such? - Previous Purchase Options : Al Klingelhutz was on the City Council at the time that the Lake Ann Park property was purchased. I once asked him why the City did not acquire the farm site. He responded by saying that the committee had attempted to do exactly that and had offered to allow the purchase to be in the form of a life estate. I am unaware of any offer to sell the property to the City. Although I am aware of the fact that the City' s financial position was not strong in the early 1970 ' s, I am unaware of any time that the issue was even discussed. Your last paragraph answers the question posed above regarding your desire to see the City working with MnDOT to potentially purchase your property. By this letter, I am asking the Minnesota Department of Transportation to respond to you if any points brought out in this letter are incorrect. Further, either Gary Warren or myself will be meeting with MnDOT to further explore the option of moving the highway to the north side. I am attaching a copy of the lease I agreement which currently exists between the City of Chanhassen and St. Hubert' s Church. That agreement expired on December 31, 1988. It would appear as though we were also tardy in 1983 as 1 the formal renewal of that document did not occur until February, 1984 . My reading of the document would be that the agreement would stay in effect until either of the two parties request to officially cease such. To the best of my knowledge, neither the I City nor St. Hubert ' s Church are interested in cancelling the agreement. This statement is being made on the basis of previous discussions I have had with Fr. Barry and members of St. I Hubert' s Church. Fr. Barry did discuss with me the option of using the old St. Hubert' s Church building as a museum for church artifacts. However, with Fr. Barry' s sabbatical and time I required to study/formalize/budget for that type of function, it will assuredly be well into 1990 before that option could be a reality. Accordingly, I am moving ahead with a sub-lease agreement to the Colonial Church at Heritage Square for a one I year period, i .e. from January 1, 1989 through December 31, 1989. My previous conversations with Fr. Barry had unveiled that Fr. Barry would not like to see the City sub-lease the old St. I Hubert' s Church so as to assure the Church the ability to move forward with the museum concept. Unfortunately, we were never able to achieve a potential time schedule and/or agreement as to how operational costs would be paid, maintenance achieved, etc. I Recognizing the significant costs of leaving the building vacant for a one year period of time, this office believes that it had no choice but to consider sub-lease for the one year period. Our I conversations with the representatives of the Colonial Church at Heritage Square have been to the effect that the one year lease may not be renewed. They are in hopes that they may be able to 1 stay two to three years ; but recognize St. Hubert' s desires and do know that movement will be required if the museum concept can become a reality by the end of this year. I • Mr. Robert Wagner ' February 9 , 1989 Page 2 I apologize for presenting many significant points in such a con- densed letter. You may wish to share this correspondence with the Church attorney. I know that Fr. Barry had previously stated that Mr. Larkin was being consulted on various items that were worked on during the course of 1988. An additional resource for you may be Al Klingelhutz who served on the Chanhassen City Council during the early days in which the original leases were considered. I believe that Al is also aware of Fr. Barry' s thoughts regarding a potential artifacts museum. ' Although I believe it is important to consummate a new five year lease agreement, burdening Fr. Barry with the administrative work necessary to do such will assuredly not be in keeping with the purpose of why the sabbatical is being taken. I leave that deci- sion to you. However, it would be my suggestion that consum- mating the lease agreement simply be delayed until Fr. Barry returns. If it would be his desire to see the lease agreement then backdated to January 1st or dated August 1, 1989 through 1994 would be at his discretion. He may also wish to see the term reduced, i.e. from August, 1989 through December 31, 1990. Again, the "do nothing" option does appear to provide Fr. Barry and St. Hubert' s Church with the greatest amount of discretion. If I do not hear from you, I will assume that the existing lease is simoly being extended for whatever period of time is necessary for Fr. Barry to return and to negotiate a new lease agreement. Please note that, by not hearing from you, does not mean that either the Church or the City are agreeing that the existing lease is being automatically renewed for a five year period. By contrast, no correspondence shall mean that both the City and Church desire to see a new sub-lease agreement be established and that the terms and conditions of that new lease agreement are to be developed during 1989 for whatever effective period jointly agreed to. During the time frame that the City negotiates that new lease agreement, the existing lease agreement shall remain in force. ' Thank you for your consideration. I indicated this to Todd Hoffman when he, I, and Scouting coordina- tor Janine Ringdahl met at old St. Hubert's on January 5. We met in order to talk about the needs of the Boy Scout Troop in the building and to establish the use they would make of the building. M We chose to donate the items we owned which we decided not to use 1 in our new facility. In that way we avoided having to promote a .basement sale -- and the Boy Scouts had requested tables and chairs for their use on Monday evenings. Disposition and use of those furnishings is the Boy Scouts' res- ponsibility. The Community Center Task Force felt that my letter was too vague and 1 did not provide adequate assurances that an agreed to price could be achieved between the City and Eckankar if either the community center or the middle school aption was chosen. Specifically, they are concerned with I taking these items back into the community and seeking citizen support of a referendum only to find that the amount of the referendum and/or other terms and conditions I of a potential sale were not acceptable to either of the two parties. Although one commission member had asked that a confirmation be put in the form of an option I agreement, this office feels that such a request would be overkill at a point in time that preliminary planning is just beginning. [ I was not at the commission meeting where the comment was made and therefore did not have an I opportunity to state staff' s position. ] To meet the com- mittee' s request, however, potentially Eckankar' s response could be in the form of an anticipated amount per acre; 1 and - Community Park: At least two members of the City Council would like to explore the possibility of purchasing the 1 entire Eckankar site as a community park. I have no way 1 1 Mr. Peter Beck 1 February 23 , 1989 Page 2 of knowing whether this thought would be endorsed by the entire Council or if it would be considered by Eckankar. The general rationale, as I understand it, would be to make a portion of the site available for middle school/ community center, a portion of the site available for park purposes , and a potential resale of a portion of the property to respond to the significant value of the par- cel - including future tax revenues from such. The propo- sal would also consider that, as churches are permitted in the unsewered area, that Eckankar could purchase another site, having acreage more closely paralleling the church' s needs, at a fraction of the cost per acre of the current parcel. ' I have been asked to place this proposal in this letter so as to afford Eckankar an opportunity to consider such and potentially reply in advance of the church' s presentation before the City Council.
