IDATE: January 7 , 1988 - � fji / _. I SUBJ: Consideration to Extend Plat Approval Deadline for Rural Subdivisions A. Peterson/Laurent 1 On February 9 , 1987 , the City Council extended the deadline for the Peterson/Laurent subdivision until January 1, 1988 1 (Attachment #1) . The extension was granted to permit the TH 212 alignment to be determined and approved as part of the official map. The proposed location of TH 212 divides the subject prop- erty approximately in half. MnDOT has nearly completed the final 1 alignment for the TH 212 corridor at which time the City Council will hold a public hearing to approve the official map. The official map should be approved by spring of 1988 . Staff recom- 1 mends that July 1 , 1988 , be established as the final deadline for preliminary plat approval. B. Robert Buresh II On May 12 , 1987 , the City Council approved the extension of the rural subdivision deadline for Robert Buresh (Attachment #2 ) . ' The Buresh property is located south of the Halla Nursery east of Hwy. 101. It was felt that the Buresh subdivision should wait until the Halla subdivision was completed and the street issue 1 had been resolved. Mr. Buresh has provided the necessary soil borings to complete the subdivision application, but since it is now winter and there is frost in the ground, the soil consultants cannot review the soil tests until spring. Therefore staff is II recommending that a July 1 , 1988, extension be approved as a final extension for preliminary plat approval for the Buresh sub- division. 1 C. Lake Riley Woods South I In June of 1987, the City Council also approved an extension for the Lake Riley Woods South subdivision (Attachment #3) . The Lake Riley Woods South subdivision is being proposed by George Nelson I I Mr. Don Ashworth 111 January 7 , 1988 Page 2 and Associates , the same owner of the Lake Riley Woods sub- division. The reasons for the extension were boundary overlays and title problems. The applicant has provided the necessary preliminary plat and fees . Staff is recommending that July 1 , 1988, be approved as a final extension for preliminary plat approval for the Lake Riley Woods South subdivision. RECOMMENDATION The three proposed rural subdivisions cannot be completed until the soil consultants can review the soil borings in the spring. All of the necessary information has been submitted and the sub- divisions should be able to receive preliminary plat approval by July 1, 1988 . Staff recommends that July 1 , 1988 , be approved as the final deadline for preliminary plat approval by the City Council for Robert Buresh subdivision, Peterson/Laurent sub- division and for the Lake Riley Woods South subdivision. Gary Warren: It actually would give you a 24 foot width rural travel surface and we're compromising on putting 3 foot on each side for the drainage ditches so that's where we came up with the 30 feet. Mayor Hamilton moved, Councilman Horn seconded to approve Subdivision Request #86-22 as shown on the preliminary plat dated December 17, 1986 with the following conditions: ' 1. All lots must be serviced by Sunset Trail. 2. Dedication of a five (5) foot street drainage and utility easement along the easterly property line of the plat to expand the right-of- way width to 60 feet. ' 3. Approval of a final grading and drainage plan for Lot 2 at time of building permit application. 4. Locate the building and treatment systems on Lot 2 out of the drainage way. 5. Widening to 30 feet those portions of Sunset Trail which are less ' than 30 feet in width and improvement of the turnaround at the north end of Sunsetn Trail to the 60 foot radius. I/ 6. Drainage and utility easements shall be dedicatediand labeled as necessary along lot lines. 7. Specifically look at Lot 5 per Mr. Machmeier's comments regarding location of the mound system sites and the house site. All voted in favor and motion carried. CONSIDER EXTENDING APPROVAL DEADLINE FOR THE PETERSON/JEURISSEN/LAURENT---w--c- ' SUBDIVISION. Mayor Hamilton stated that this item was looked at some time ago because of the problem with the designation of the TH 212 right-of-way and the problem with subdividing the property when they don't know where the road is going to go. Councilman Horn moved, Councilman Geving seconded to approve, at the time the new Zoning Ordinance goes into effect, the approval deadline for the Peterson/Jeurissen/Laurent Subdivision to January 1, 1988. II VISITORS PRESENTATION: SCHOOL DISTRICT 112, LEAN ON ME PROGRAM, MARJORIE ADAMS. I Marjorie Adams: I am a member of the School Board for District 112 and we are currently having a campaign called the Lean on Me Project and we're wearing II these black and white buttons that I brought for you tonight. This has come out of the whole child initiative and that is a pilot program that is taking place in 10 sites throughout the state. You have probably heard about it. It II was developed because we, in education, have felt that children have such complex lives and problems and issues facing them so we're trying to get the involvement of teachers, parents, the community, to alleviate some of these problems. City Planner 1 DATE: June 23 , 1987 SUBJ: Rural Subdivisions The City Council established a January 15 , 1987, deadline for rural subdivision applications to be accepted with a minimum 2 .5 acre lot area and no density requirements (the one unit per 10 acres which is now in effect) . The applicants were required to receive preliminary plat approval from the City Council by July 1 , 1987 (July 6th City Council meeting) . The city received the following applications: 1 1 . Gagne Property/George Nelson - Lake Riley Woods North Status - Final plat approved 2 . Georgia Jeurissen Status - Preliminary plat approved by City Council 3 . Wallace Otto - Timberwood Subdivision Status - Preliminary plat review by Planning Commission on June 24, 1987 - City Council review on July 6 , 1987 1 4 . Bob Morehouse - Southeast corner of Hwy. 5 & 41 Status - Have not received completed application. No longer eligible. 5 . David Luse Status - Application withdrawn ' 6 . Zimmerman Farm Status - Preliminary plat review by Planning Commission on June 24, 1987 - City Council review on July 6 , 1987 7 . Mike Klingelhutz Status - Preliminary plat approved by Planning Commission with conditions . Gagne Property/George Nelson - Lake Riley Woods South Status - The applicant is working with the soil consultant but application will not be reviewed until July. Staff is recommending an extension to the July 1 deadline. 11. Laurent/Peterson/Jeurissen 1 Status - The property is within the Hwy. 212 alignment and was given an extension to January, 1988 . 12 . Halla - Great Plains Golf Estates Status - Planning Commission will review preliminary plat on June 24 , 1987 - City Council will review on July 6 , 1987. ' 13 . Buresh Status - Property impacted by Halla Subdivision and was given an extension to January, 1988 . 14. Worm - South Bay - Status - Planning commission will review preliminary plat on June 24 , 1987 City Council will review on July 6 , 1987 15 . Don Mezzenga Status - Have not received complete application. No longer eligible. Of the fifteen applications, two have been officially tabled, two have received preliminary plat approval, five are pending and the remaining are either ineligible or requesting extensions. Staff can support extensions for Mike Klingelhutz , Richard Vogel and Lake Riley Woods South since these applications are in the process of review. The Don Mezzenga and Bob Morehouse applications should be considered void since there has been no effort to contact staff or complete the application. Unless directed otherwise, staff will proceed to process the 1 above referenced subdivisions and notify the two applicants which have not met the requirements . Box 147 ' Chanhassen MN 55317 Dear Council Members: I am writing to inform you of our intentions with regard to Lake Riley Woods South. We intend to complete preliminary plat application, complete the platting process, and follow through into construction as soon possible within the constraints of the city. The ' attached schedule is an estimate of our timetable for the project. We have experienced delays in application for several reasons. ' First, there has been overlap in a boundary line which has taken time to resolve. We have also had a title problem with regard to the former railway which is necessary to resolve. Unfortunately, the resolution of these is not solely under our direct control, but rather, reliant on others who work within their own timeframe. We have also spent time trying to accommodate our entrance to ' not only the existing County Road 14 but also to the proposed realignment. We have also had a request from a potential purchaser for a modification in the plat to accomodate the type and style of house he wanted to build. These, among others, have delayed the application portion of the process but not the completion schedule. If I can provide any further information to facilitate this process or help you in your understanding of the project, please let me know.
