May I, 2000 Kennel Permit for 7431 Windmill Drive Pat and Hans Petruska have applied for renewal of their kennel permit. Chanhassen City Code requires a kennel permit when a property owner has more than 2 animals (any combination of dogs and/or cats). The Petruskas own 6 dogs in a residential neighborhood at 7431 Windmill Drive and have had a kennel permit since 1998. After publication in the Chanhassen Villager, staff has received several complaints regarding the renewal of the Petruska's kennel permit. City Code requires that the City Council review the kennel permit when complaints have been received (see attachment #1). Staff has inspected the property and certifies that the kennel is maintained in a neat, orderly, and safe condition (see attachment #2). I have also attached pictures of the Petruska backyard showing a four-foot fence and locks on all gates. City Manager From: Jackie Glaser, Community Service Officer Date: January 19,2000 Re: Kennel Permit Recommendation I recently have received numerous complaints regarding the renewal of a kennel permit. The complainants wish to remain anonymous if further action is taken but they all live in the same neighborhood of Windmill Drive in Chanhassen. The subjects of the complaint are Pat and Hans Petruska, 7431 Windmill Dr., Chanhassen. Their kennel permit needs to be renewed but the neighbors would like the City to reconsider the renewal. The Petruskas own 6 dogs in a residential neighborhood which include three greyhounds, one Creole dog, one Rat Terrier dog and one mix dog. The neighbors believe that six dogs do not belong in a small neighborhood where there are small children. According to the complainants, the Petruska residence has a fenced area for their dogs but it has a gate that has been left open on several occasions. The dogs have not injured or hurt anyone in the neighborhood but the residents believe the dogs are a threat to their children and do not want anything bad to happen. Follow-up I spoke to one of the residents on 01-12-00 and she stated that the greyhounds have threatened her small children along the fence line by growling and showing their teeth. She stated that she has spoken with Pat Petruska about the dogs and nothing has been corrected. Another nearby resident stated that the dQgs bark constantlY and that it is a . nuisance to the neighborhQod. . On 01-19-00, I spoke with another one of the nearby residents and she stated that the dogs bark a lot and she can hear them fÌ'om where she lives 4 houses down the block. She stated that the dQgs have been outside the fence line in the past. She has very small children and the dogs have growled and barked at them before. She stated that the dogs seem veryìmapproachable and they travel in packs which makes her even more concerned for her children. She is opposed to the renewal of the kennel permit. On 01-19-00 at 12:45pm, I spoke with Pat Petruska. She told me that all of her dogs are indoor dogs and are only let out to go to the bathroom. She said that all Qfthe gates are padlocked and the dogs never go outside of the fence line. She also stated that she had no idea that the neighbors felt the way they do because she has never been talked to about her dogs. On 01-19-00 at 1:30pm, I went to visit the Petruska residence to evaluate the situation. Nobody was home. They have about one and a half acres of land behind their house that is enclosed by a 4-foot fence. The fence does have gates but they were padlocked and chained. I did not see or hear the dogs so I was unable to make contact with the dogs. After talking with Pat Petruska and visiting their home, I do not see any reason why their kennel permit should not be reissued to them. Their fence is seems very secure. The dogs have adequate shelter, food, and their surroundings are kept neat and clean. The residents would like the City of Chanhassen to reevaluate the kennel permit. Enclosed is a copy of their kennel permit and the complaint form with names, addresses, and phone numbers of the complainants. I have not received any complaints about these dogs previous to the kennel permit renewal. Also enclosed is a copy of the city ordinance regarding kennel permits. The ordinance states that ifthe city receives complaints about a kennel permit, the city council must approve the permit. Hopefully this letter will provide some guidance towards this issue. COURT REF. · § 5-16 CHANHASSEN CITY CODE Private kennel means any place where more than two (2) dogs or cats over six (6) months of age are kept or harbored, provided such animals are owned by the owner or lessee of the premises on which they are kept or harbored. Sterilized means neutered in the case of male dogs or cats, or spayed in the case of female dogs or cats. Under restraint means under control by means of a leash not exceeding six (6) feet in length, or within the property of the owner's premises. (Ord. No. 24-C, §§ 1, 19,7'12-76; Ord. No. 24-D, § 1,8.2-82) Sec. 5-17. Interference with enforcement. It shall be unlawful for any person to break open the pound or to attempt to do so, or to take or let out any dog or cat therefrom, or to take or attempt to take from any officer any dog or cat taken up by him in compliance with this article, or in any manner to interfere with or hinder such officer in the discharge of his duties under this article. (Ord. No. 24-C, § 14,7-12.76) Sec. 5-18. Kennel license. (a) No person shall maintain a private or commercial kennel in the city without securing a license therefor from the city council. The fee for the license shall be as established by resolution. No license shall be required for a private kennel consisting of cats, if the kennel is located on a tract or parcel of land being used for agriculture as that term is defined in the zoning ordinance, and if the cats are kept for rodent control purposes incident to the agricul- tural use of the tract or parcel of land. (b) Kennel licenses shall expire on the April 30 next following their issuance. Upon application for renewal of a kennel license, an authorized city employee shall inspect the kennel of the applicant. The employee shall submit to the city clerk either an aftlrmative certification that the kennel is maintained in a neat, orderly, and safe condition, or a negative certification that said kennel is not so maintained. The city clerk may issue a renewal kennel license provided that: (1) The certificate is afñrmative; and (2) No complaints have been received by the city. In all other cases, the kennel license shall be renewed only Upon city council approval. (Ord. No dog or cat shall be allowed by its owner to run at large. The pQlice or animal control officers of the city shall take up and impound any dog or cat found at large in violation of this section.
