Unlike the Planning Commission or other advisory com- missions, the Board of Adjustments and Appeals is governed by the requirements in the Zoning Ordinance and not a set of bylaws. I The Zoning Ordinance provides that the City Council shall appoint members to the Board of Adjustments and Appeals on an annually basis with a term beginning in January and extending until mem- bers are reappointed. While the ordinance does not stipulate if a member from City Council should site on the Board, it has been Council policy to appoint one of the Council members . The Council has the following options: I1 . Advertise for the three positions . I 2 . Reappoint the existing Board of Adjustment members (Willard Johnson, Carol Watson, and Dale Geving) . All have indicated their interest to continue on the Board of Adjustment for another year. IThe City Council should also appoint an alternate. Currently, Mayor Hamilton has served as the alternate. In accordance with City Ordinance 70-B, Section 3 .02 , commission members shall hold office Iuntil their successors have been appointed and qualified. I have discussed the expired terms with the Public Safety I Commission Chairman and Mayor Tom Hamilton. It was suggested that the two commissioners with expired terms be presented to the Council for reappointment. IRECOMMENDATION: The ordinance remains silent on selecting commission members I for expired terms and as such I am recommending two (2) options: I 1 . Advertise for the positions and go through the Council appointment process, or 2 . Reappoint both Candy Takkunen and Richard Wing Ito two (2) year terms consistent with the wishes of the Public Safety Commission Chairman and Mayor Tom Hamilton. I 1 I I I CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA ORDINANCE NO. 70-B ' AN ORDINANCE ESTABLISHING A PUBLIC SAFETY LIAISON COMMISSION FOR THE CITY OF CHANHASSEN ' THE CITY COUNCIL OF CHANHASSEN ORDAINS: SECTION 1. ESTABLISHMENT OF COMMISSION. I 1.01 . A Public Safety Commission for the City of Chanhassen is hereby established. The Commission shall be a public -safety coordinating agency advisory to the City Council. As used in this ordinance the term "Commission" shall mean the Public Safety Commission , "Council" shall mean City Council of Chanhassen, and I "Police Agency" shall mean the Carver County Sheriff 's Department or such other law enforcement agency as may be designated by the Council from time to time to provide regular public safety services to the City of Chanhassen . ' SECTION 2. PURPOSE. 2. 01 . The purpose of the Commission is to enhance public ' A. safety within the boundaries of the City and to promote com- munication among the citizenry, the City Council, and the Public Safety Agency then serving the City. SECTION 3 . COMMISSION COMPOSITION, TERMS AND VACANCIES. 3 . 01 . Composition . The Commission shall consist of five voting members . Four of the five members shall be appointed and may be removed by a four-fifths vote of the Council . One of the five Commission members to be appointed the Council (hereinafter the "Council Member") shall be chosen by by the Council from among its own members . Four of the five Commission members to be appointed by the Council (hereinafter the "Citizen Members ") shall be residents of the City of Chanhassen who are neither City officials , employees of the City of Chanhassen, or employees of the Policing Agency. 3 . 02 . Terms and Vacancies . The term of the Council Member of the Commission shall be two years, or such shorter period of time as may coincide with his or her term of office as a member of the City Council. All Commission Members shall be appointed ''for two year terms . ' Commission Members shall hold office until their suc- cessors have been appointed and qualified. Each vacancy in an unex- ' pired term shall be filled in the same manner in which the original appointment was made. 1 1 I 141' SECTION 4. ORGANIZATION AND MEETINGS. 1 4. 01 . The Commission shall elect a chairman from among its Ar Members for a term of one year. The chairman shall preside at all I meetings of the Commission and at each meeting, the chairman shall submit such recommendations and information as he may consider proper concerning the business , affairs and policies of the I Commission . The City Manager or his/her designee, shall act as secretary to the Commission , but shall not be a member . 4. 02. The Commission shall hold at least one regular I meeting each month. It shall adopt rules for the transaction of business and shall keep a record of its resolutions , transactions and findings , which record shall be a public record. On or before I July first of each year the Commission shall submit to the Council a report of its work during the preceding year . On or before August first the Commission shall submit to the Council a budget for pro- posed expenditures during the next fiscal year . Expenditures of the I Commission shall be within amounts appropriated for the purpose by the Council . ISECTION 5 . PROGRAM OF WORK. 5 . 01 . The Commission shall assist the Public Safety 1 Director in preparing a work program outlining activities it proposes to undertake; said program may include: a . Needs and prioritization of available public safety Ipersonnel hours to best meet those needs . b . The facilitation of improved city/public safety communications . Ic . The recommended action of changes in present police services contract rate program and the monitoring of I the cost of other public safety protection alternatives . d . City Planner U` --) - DATE: February 2 , 1988 Y2-/' ,/S-S' ISUBJ: Resignation from the Southwest Metro Transit Commission - Tom Hamilton IThe Southwest Metro Transit Commission directs the Southwest Metro transit system serving Eden Prairie, Chanhassen and Chaska. Each city has two members on the commission. The two Chanhassen I members are Dale Geving and Tom Hamilton . Due to meeting conflicts on the third Thursday of every month, Mr. Hamilton is resigning as Commissioner of the Southwest Metro Transit I Commission. Therefore, the City Council must appoint a new member to the commission. I It is not required that the Commissioner be a Council member. The City Council can either nominate another City Council member or can request staff to advertise for a replacement. I The Commission meets once a month on every third Thursday at 7 : 30 p .m. in the Chanhassen City Hall Conference Room A.
