Authorize Acquisition of Easements and Initiation of
Condemnation Proceedings for the Highway 101 Trail
Project 97-12-3
REOUESTED ACTION
Authorize acquisition of easements for the construction of a trail adjacent to
Highway 101 north of Highway 5, Authorize Legal Services and Land Appraisals
necessary to acquire the easements, and Authorize Condemnation proceedings to
acquire the easements if they cannot be acquired in a timely manner through
normal negotiations with the property owners,
DISCUSSION
The City Council has directed staffto prepare plans and specifications for
construction of a trail in the Highway 101 right-of-way north of Highway 5, The
plans have been prepared and will be presented to the City Council on Monday,
May 13, 2002. Because of requirements to meet engineering standards and
requirements of ADA, some temporary and permanent easements will be
necessary to construct the trail.
Easement descriptions will be handed out on Monday, May 13, 2002 along with a
copy ofthe proposed condemnation resolution.
While staff will try to avoid condemnation if possible, it is necessary to approve
the resolution if the project is to be kept on its current schedule in case a
negotiated easement agreement cannot be reached. It is also preferable to have
the easements settled as soon as possible so that the Council will know the total
project costs prior to awarding the construction contracts,
