Because of requirements to meet engineering standards and requirements of ADA, some temporary and permanent easements will be necessary to construct the trail. Easement descriptions will be handed out on Monday, May 13, 2002 along with a copy ofthe proposed condemnation resolution. While staff will try to avoid condemnation if possible, it is necessary to approve the resolution if the project is to be kept on its current schedule in case a negotiated easement agreement cannot be reached. It is also preferable to have the easements settled as soon as possible so that the Council will know the total project costs prior to awarding the construction contracts, c: Joel Rutherford, HTPO g:\eng\public\97-12·3\easement acquisition cc staffreport.doc The City of Chanhassen .
