CC 2014 06 09 CHANHASSEN CITY COUNCIL REGULAR MEETING JUNE 9, 2014 Mayor Furlong called the meeting to order at 7:05 p.m. The meeting was opened with the Pledge to the Flag. We’re glad that you joined us this evening. At this time I would ask if there are any modifications or changes to the agenda by the members of the council or requests for such. If not, without objection we’ll proceed with the agenda as published. We’ll start with our consent agenda items. CONSENT AGENDA: Councilman Laufenburger: Mr. Mayor? E(8). APPROVE RESOLUTION ACCEPTING THE ANGEL OF HOPE STATUE, WILLIAM’S WING’S FOUNDATION. Councilman Laufenburger: Thank you Mr. Mayor. I just, as I was reviewing this regarding the Angel of Hope statue, I just think that it’s a wonderful contribution to the city and I also made note that today is th June 9 and I know this is probably an emotional time for the family but I believe that William was actually born tomorrow, is that correct? Todd Luecke: That is absolutely correct. Councilman Laufenburger: And I just think that, I saw the design of this Angel of Hope statue and it’s just, it seemed to be worthy of mention further than just a consent agenda item so on behalf of the council I just thank William’s parents and the family and their foundation for making this contribution and I wish them best success as they move forward so, that’s all I had Mr. Mayor. Mayor Furlong: Thank you Mr. Laufenburger. Todd and Misty Luecke are here so thank you for being here. I don’t know if there’s anything you want to address the council on since we’re discussing it separately. If you could step up to the microphone please so people at home can hear you. Todd Luecke: Specifically I’d just like to thank you for your comments. Very kind and for speaking up. Very thoughtful so thank you for that. Tomorrow we will be celebrating his, what would have been his third birthday and that will be a special time and then come this week from today we will have our second annual golf tournament to raise funds to further our mission so if there are any other questions at the 2 Chanhassen City Council – June 9, 2014 appropriate time we can take those with regards to the statue but other than that thank you for your time and consideration. Mayor Furlong: Absolutely. Thank you and thank you for working with our park and rec staff to find this location and with the design it looks like it’s going to be a nice place so. Todd Luecke: Just one other comment. Todd has been very good to work with so I would like to thank him publicly for all of his help as well. Mayor Furlong: Very good. Thank you. Any other comments? Just I would move that the council approve the resolution accepting Angel of Hope statue donation from the William’s Wings Foundation. Councilwoman Ernst: Second. All voted in favor and the motion carried unanimously with a vote of 5 to 0. VISITOR PRESENTATIONS. Mayor Furlong: If you’d like to address the council this evening under visitor presentations, please come forward to the podium. State your name and address for the record. Rick Dorsey: My name is Rick Dorsey, representing PPB Holdings and ownership of property at 1551 Lyman Boulevard. I’m here to update the City Council with respect to an issue I brought forth about 6 weeks ago at a council meeting related to the road construction of Lyman Boulevard. With respect to that, back at that time I brought forth that there was a number of issues dealing with water drainage and planning for that that had not been done. Part of it has been at least moved forward. Here today I got notice from the County that the City had agreed to diagonal pipe which would change the direction of the culvert so I appreciate that. With respect to a couple of the other, the two other items that were there, they have not been resolved yet. One is dealing with, there’s an embankment along the road here. It’s about a 30-40 foot tall embankment and it has a 3 to 1 slope going down to the ground. It’s been designed with a, because the ditch has been identified as a wetland, has been mitigated just to the toe of slope. There’s nowhere for the water to run and be contained coming off the hill. The area that it’s going into has expanded over the years. The original road back in, before the current was built in 1981 was way back over in here and water has been, and the embankment pushed further into the property. With respect to that currently the situation as well is that the taking through eminent domain was to this line right here yet the project has a temporary easement back to here and the embankment is going halfway through that area. While the temporary easement was obtained through the eminent domain process by the County and City project the area that the slope is on is not within the right-of-way and the water that’s coming off that slope is not within the right-of-way and so there’s still an issue that is there. It’s not resolved. The third issue that has not been resolved was a request for a right-in/right-out access into the parcel in this corner of the property. The County was found that going back 3 years that that would be an acceptable location from the County’s perspective. At this time we’re not looking to build a road into the property but with the guidance for the property from the City and the future outlook pressuring to see development in the area, that that access point had been determined by many consultants to be a necessity and that 3 Chanhassen City Council – June 9, 2014 being the case we requested to have a right-in/right-out at that location and a right turn lane to be built with the project. The objective of doing it with the project would eliminate the need to tear it up again in a matter of not too distant future and in doing so shorten the life of the road as well as added cost to having to build something, tear it up and then re-build it to gain 8 feet of space. It had been suggested that if I paid for it this could be done. I agreed to pay for it. For the up sizing of it to cover the added cost to that lane and we’re not able still at this point to get it taken care of. The road is under construction. These issues have not been resolved. I would like them resolved. The City’s involved in the project. I would like the City to work with the County and myself. As I said at the last meeting that I was here I would be available at a moment’s notice, the next day if necessary. That didn’t happen unfortunately but we have had some communication and some progress. The biggest thing is, I’d like to get this done because the road is under construction and if decisions aren’t, can’t be made immediately it will not be done and then it’s an added cost and potential other issues as to whether it will even be built. We do have a representative from KleinBank, Mr. Dykhoff is here tonight and Mitch Johnson from our Park and Rec Department so gentlemen please, come forward. I’d like to hear about the summer concert series coming up. Mitch Johnson: Good evening Mayor and council. The Chanhassen Park and Rec Department, the entire city along with KleinBank of Chanhassen is excited to announce the opening night of our 2014 th KleinBank Summer Concert Series which is this Thursday, June 12 at 7:00 p.m. right here in City Center th Park plaza. Right out by the library and 78 and Market Boulevard. We have a great line up. We have 9 th concerts this year. All on Thursdays including two kids concerts. The series runs through August 7 and it’s a free event throughout the summer. Great way to bring your family out. Enjoy you know music in the park and with that I’d like to introduce Scott Dykhoff from KleinBank of Chanhassen. Scott Dykhoff: Well thank you. Really the thanks go to all of you for creating this event. We’re here to support it but it’s the work of Mitch and the Mayor and council members, thank you for helping make it happen. It’s a wonderful event and it’s a pleasure to be able to share with our customers and the citizens that we have such a unique and fun event. I’ve had some new customers lately I shared it with and they were just so thrilled that the opportunity to get out, and I think after this last winter, with technology and all these great things we have, it’s just fun to have something to get the community out and about and we’ll knock on wood for another 9 days of sunny and 70’s or 80’s so thank you very much. Mayor Furlong: You have a check to present, and how many years has KleinBank been sponsoring this concert series now? Scott Dykhoff: Many years. Mayor Furlong: Quite a few. Maybe come on this way and we’ll get this. Scott Dykhoff: It’s great to live in a city that’s safe that I can carry this large check all the way over here. Mayor Furlong: Alright, very good. Mayor Furlong: Alright. Thank you. Any other visitor presentations this evening? Thank you very much. ARBOR COVE, LOCATED AT 3121 WESTWOOD DRIVE, APPLICANT: DOGWOOD ROAD, LLC. OWNER: WESTWOOD CHURCH. A. CONSIDER APPROVAL OF FINAL PLAT, DEVELOPMENT CONTRACT, AND PLANS AND SPECIFICATIONS. B. PUBLIC HEARING FOR VACATION OF EASEMENTS. Councilman Laufenburger: Mr. Mayor, just because of my involvement with the planning and preparation for this I’m going to recuse myself from this particular item. Mayor Furlong: Thank you very much. Why don’t we start with a staff report please. This was a final plat request, development contract, plans and specifications which is not subject to a public hearing. Public hearing was held by that at the Planning Commission and we also received public comments I think if I recall correctly at the council meeting when we dealt with the preliminary plat but be that as it may, there are vacations of easements that are required and there will be a public hearing on that item. However unless council objects or it becomes apparent that we need to separate these, I think we can deal with both items in a single motion when the time is appropriate. So with that let’s start with a staff report please and start, Ms. Aanenson. Kate Aanenson: I’ve got it. Thank you Mayor. Mayor Furlong: Thank you. Kate Aanenson: Thanks for giving the introduction. Mayor Furlong: Certainly. Kate Aanenson: And I just want to note that I do have it on both screens so we’re off to a good start. Mayor Furlong: Good. Kate Aanenson: As you mentioned this is a final plat and development but also includes a vacation which th does require a public hearing so we’re going to give an overview of some of the actions. So on May 20 the Met Council did approve the Land Use Amendments and that’s for the lots on the back of the subject th site. And then on May 12 you approved a development contract for grading so here tonight we are th following through on your action from April 28 for the rest of the conditions of approval for the final plat and the development contract. So again the actions tonight are the public hearing for the vacation of the road easement, the final plat of the 56 acres creating 5 lots. One of those lots is for the church and the other 4 are the home sites. You’re also approving a development contracts and the plans and specifications. So the public hearing portion would be these easements shown here in red, and those th easements were actually with the construction of Tanadoona and West 78 Street and those were construction easements so now with the plat being recorded we’re changing those construction easements into right-of-way so we’re vacating the construction easements. So that would be the hearing portion of it. And then the final plat, the 4 lots being created here. And then a larger illustrative showing of that. 5 Chanhassen City Council – June 9, 2014 We are recommending that the council approve those after you hold a public hearing. The vacation and the final plat with the conditions in the staff report and the development contract and the plans and specifications so I’d be happy to answer any questions you have and recommend that you open the public hearing on the vacation. With that then let’s open the public hearing and invite all interested parties to come forward to the podium stating their name and address who would like to speak on the issue relating to the vacation, or proposed vacation of the easements. Seeing none then we’ll close the public hearing and bring it back to council for discussion. I think the applicant’s here. Anything that you need to add or want to add at this point? Todd Simning: I do not Mr. Mayor. Mayor Furlong: Okay, thank you. With that any comments or discussion from the council? Fairly straight forward. Appreciate staff’s work and the developer’s work too on bringing, making the modifications between the time we approved the preliminary plat and now so thank you for your continued efforts there. With that I would entertain a motion to, relating to items G-1(a) and (b). Councilwoman Ernst: Mr. Mayor. Mayor Furlong: Councilwoman Ernst. Councilwoman Ernst: I make a motion that City Council approve the final plat for Arbor Cove subject to the conditions in the staff report, the development contract for Arbor Cove and the plans and specifications. The vacation of the roadway easements, the final plat for Arbor Cove subject to the conditions in the staff report, the development contract for Arbor Cove and the plans and specifications for Arbor Cove. Thank you. Mayor Furlong: Thank you. Are there findings of fact on this one or were those handled at the first preliminary? Kate Aanenson: Those were with the preliminary. Mayor Furlong: Preliminary. Hearing none we’ll proceed with the vote. the Councilwoman Ernst moved, Councilman McDonald seconded that the City Council approve final plat, development contract and plans and specifications prepared by Otto Associates, dated April 23, 2014 and April 18, 2014 respectively, for Arbor Cove subject to the following conditions: Parks & Recreation 1.Full park dedication fees of $23,200.00 shall be collected prior to recording the final plat. Building 6 Chanhassen City Council – June 9, 2014 1.Final grading plans and soil reports must be submitted to the Inspections Division before building permits will be issued. 2.Engineered design and building permits are required for retaining walls exceeding four feet in height. 3.Each lot must be provided with a separate sewer and water service. 4.Demolition permits must be obtained before demolishing any existing structures. Natural Resources 1.The applicant shall plant a total of 29 trees in the development. 2.Prior to any grading, the applicant shall install tree preservation fencing using metal stakes around tree #33 on Lot 4. The fencing shall be placed at the dripline or the furthest point possible from the trunk and no closer than 20 feet. Within the fencing, the applicant shall spread a 3 to 4-inch layer of woodchips to protect the root zone. These protections shall remain in effect until construction is completed. 3.A tree preservationeasement shall be recorded east of the grading limits on Lot 1,over the rear 85 feet of Lots 2 through 3 and over the rear 75 feet of Lot 4. The applicant shall supply a legal description for the easement. 4.Easement signage shall be placed on the lot lines at the point of intersection with the easement on Lots 2 through 4. Signage shall be placed at points of directional change on Lot 1. Signs shall be approved by the city. Engineering 1.No slope shall besteeper than 3:1. 2.The EOF shall be noted with arrows showing the direction of the overflow. 3.Include a lot benching detail in the plans. 4.Draintile service must be provided for Lots 3 and 4, which have drainage flows from the back to the front of the lot. 5.Proposed stockpile areas must be identified in the plans. 6.All existing easements shown in the plans must be properly referenced with the document number or plat they were dedicated under. 7.A preservationeasement shall be dedicatedalong the back of Lots 2, 3 and 4 as well as the east corner of Lot 1. 7 Chanhassen City Council – June 9, 2014 8.A drainage and utility easement shall be dedicatedover the filtration basin and the channel on Lot 1 whichwill provide the City access to these stormwater facilities. 9.The following retaining wall materials are prohibited: smooth face, poured in place concrete (stamped or patterned is acceptable), masonry, railroad ties and timber.. 10.Grading must include a swale at the top of the retaining walls for drainage. 11.The topography shown must include elevation contours for Dogwood Road adjacent to the proposed lots. The centerline gradients must be labeled. 12.At the time of final plat, the Dogwood Road improvements assessment must be paid or reassessed. 13.Partial water and sewer hookup fees must be paid at the time of final plat. 14.The driveway slope from Lot 4, Block 1 shall be revised to a grade between 0.5% and 10%. Water Resources 1.The filtration feature shall be constructed prior to the construction of any houses.It shall be called out on both grading plans that steps shall be taken to prevent compaction and siltation of the area resulting from construction activities on the site 2.The underdrain shall be smooth walled and have a tracer wire. 3.The feature shall be kept offline until the vegetation has been established. Plans and the SWPPP must include this information and describe the methodology to be used to achieve this. 4.A detailed planting plan and schedule must be developed and included in plan set for approval. 5.The in-situ soils shall be ripped to a depth of 12 inches prior placing the amended filtration soils. 6.The developer shall be responsible for the construction of the biofiltration feature and shall make assurances that the plant materials, mulch and side slopes into biofiltration feature are maintained throughout the life of the feature. This is most typically accomplished though a Homeowners Association. The city will be responsible for maintenance of the underdrain, outlet pipe and inlet protection device at the curb. An operations and maintenance manual shall be developed describing how the feature will be maintained and by who will be responsible for the maintenance. This shall be recorded against the property. 7.The SWPPP as well as the erosion control plan must indicate how the conveyance from the wetland will be permanently stabilized. 8 Chanhassen City Council – June 9, 2014 8.A detail of the rock checks must be included. This shall be consistent with Technical Supplement 14C to Part 654 of the National Engineering Handbook. 9.Surface water management connection fee of $14,066.50 will be due with the final plat. 10.The plans must meet all requirements set forth by other agencies with authority over the site. The applicant is responsible to procure all necessary approvals and permissions. This includes, among others, the MN Pollution Control Agency and the Minnehaha Creek Watershed District. 11. The Construction Sequencing section of the SWPPP must discuss the following elements: a.Channel grading and stabilization; b.Timing of the curb cuts; c.Installation of the rain guardian. 12. The SWPPP must indicate who is responsible for the maintenance of the permanent stormwater management practices on the site and a maintenance plan to assure performance of the practice as listed in Part IIIA 5 k. The developer must assume responsibility of the maintenance initially. This can transfer with property ownership but must be disclosed to any subsequent owner in writing. Planning 1.Lots 1 through 4 are the only lots included in the land use map amendment from Public/Semi-Public to Residential Low Density. 2.Lots 1 through 4 are the only lots included in the rezoning from Office Institutional District to Single-Family Residential. All voted in favor and the motion carried unanimously with a vote of 4 to 0. Resolution #2014-44: Councilwoman Ernst moved, Councilman McDonald seconded that the City Council adopts a resolution approving the vacation of drainage, utility and roadway easements described in the attached legal description. All voted in favor and the motion carried unanimously with a vote of 4 to 0. Councilman Laufenburger rejoined the council for the remainder of the meeting. COUNCIL PRESENTATIONS. Mayor Furlong: That completes our items of business this evening. Is there council presentations? Comments from council members. Mr. Laufenburger, anything? Councilman Laufenburger: Yes Mr. Mayor. I’m pleased to report that the Red Birds are off and running, or pecking. The baseball team. Mayor Furlong: Are they hitting and scoring runs? 9 Chanhassen City Council – June 9, 2014 Councilman Laufenburger: They’re hitting and scoring runs. Mayor Furlong: Excellent. Councilman Laufenburger: In fact this weekend they had a, they swept a doubleheader in two different cities from two different teams. The first game was scheduled at 2:00 in Henderson and lo and behold it went 15 innings. The Red Birds finally won 6 to 5 but the second. And they finished the game just in time to get over to Le Sueur, home of the Le Sueur Braves and they clobbered them. Well they beat them 4 to 1 so it was a doubleheader. They’re now 2 and 2 in league play and things are moving swimmingly. We have a game this Friday night and then again on Father’s Day so Red Birds are off and running. Mayor Furlong: Great, thank you. It was nice to see the recognition and thank the Red Bird organization for using the game against the Chaska Cubs, the Bountiful Basket. There was a substantial portion of food and funds raised for local food shelves so it’s always nice to see. Councilman Laufenburger: Yeah. That was good. That was last Friday night. The Border Battle for Bountiful Basket and one of our marketing interns, Sarah Hess did a wonderful job in organizing all of the events and activities for that and over 300 pounds of food was donated and over $150 contributed to Bountiful Basket and I noticed Mr. Redmond had a nice letter in the Chanhassen Villager thanking the organization so we, like KleinBank we want to be part of the fabric of the community and we’re working hard to do that. Mayor Furlong: Well and thank you too for opening up the gates for the city employees at the game this last week as well. It was nice to get out there on a nice, warm evening and watch a little baseball. Councilman Laufenburger: Yeah and I do want to correct one thing. There was a trivia associated with that and contrary to popular belief the acreage inside the perimeter of Chanhassen is not 23.78 acres but 23.78 square miles so it was Assistant City Manager who made it very clear to me, and I just simply mis- quoted that so. So we got a little pution sized city for just one night. Mayor Furlong: Yes. I think we should look at wards within that 23 acres. Councilman Laufenburger: Yeah. It would make serving the city very easy wouldn’t it? How many miles of road could you have in 23 acres? Not very many. Mayor Furlong: Not very many. Well thank you. Councilman Laufenburger: By the way I’m sorry that, I’m sorry our City Manager couldn’t bring home a victory over the Shakopee Indians so now we’re going to have to say, we’re going to have to call that bridge that’s being built, it will be the bridge to Shakopee as opposed to the bridge to Chanhassen. Todd Gerhardt: Well you can thank the mayor for such a beautiful night. Councilman Laufenburger: Absolutely. Enough about the Red Birds Mr. Mayor, okay? Mayor Furlong: Thank you. Time to go. ADMINISTRATIVE PRESENTATIONS. 10 Chanhassen City Council – June 9, 2014 Todd Gerhardt: Just one item. It’s kind of a bittersweet day here for city staff and council and commissions that Carol Dunsmore put in her resignation today. She is retiring from the City of Chanhassen after 26 1/2 years of service and Carol is the stable of our building department. She makes sure that all the building permits are followed up on and processed correctly and Carol also helps out in our animal control so she is kind of a vital link to that department and she’s going to be sorely missed by everybody over there and all city staff so, but we are happy for Carol. She’s going to spend more time with her husband and family and she is also an avid, has an avid hobby farm and enjoys riding her horses and so she’s going to spend a lot of time doing that too so we’re happy for Carol in her retirement. th Mayor Furlong: Good. Thank you and she will be here August 15, is that correct? th Todd Gerhardt: Yes. August 15 will be her last day and she’s asked for no parties or cake but I think we’ll probably have to have something. Mayor Furlong: Good luck with that, yeah. Okay. Thank you. Any questions for Mr. Gerhardt or his team? CORRESPONDENCE DISCUSSION. Mayor Furlong: Any comments on the correspondence packet? Councilman Laufenburger: Just one. Mayor Furlong: Councilman Laufenburger. Councilman Laufenburger: Yeah. I was pleased to see the letter from LuAnn Fransen regarding Carver County WeCAB and this is a subject that came up with the Senior Center and I would hope that somebody on the Senior Center is connected and will be at that event, whatever that is. It was encouraging to see that in fact they’re following through much faster than I had originally anticipated so good for Barb Nevin and her group over there. Mayor Furlong: And just on that comment too the letter here is looking for people to get involved…to th learn more about it. There’s a meeting coming up on June 24 at the Chaska Community Center from 1:30 to 3:00 p.m. and would certainly encourage people to attend that meeting and learn more about their organization. I understand they are up in the Mound area currently, is that correct? And in and around that area and helping people with rides that need them and so thank you Mr. Laufenburger for bringing that up. I think here’s an opportunity for residents and businesses to get involved in something from the th ground floor and learn more about it on the 24 so look forward to seeing people attend.
