1 . On December 21, 1987 a building permit for the site located at
540 Big Horn Drive was issued to you contingent upon the approved
grading and erosion control plan as attached.
1 During numerous routine inspections by our building inspector,
you and your contractor were advised to install the appropriate
erosion control measures in accordance with the approved plan
1 prior to further construction on the site. As to date, no
apparent action has been taken to address this matter.
1 Failure to install the appropriate erosion control measures by
Monday, March 14, 1988 will result in a "stop work" order being
posted on the site which would suspend any further construction
1 activities .
I hope this action will not be necessary.

As follow up to a request from Council member Dale Geving, I spoke with Mr.
1 Patrick Cunningham, 865 Pleasant View Road, 474-8377, who is the fee holder for
property abutting to the west of the Jim Hansen property. Mr. Cunningham
questioned the survey markers which appeared to be on the northeast corner of
his property along the roadway. I indicated to him that as a part of the
1 sighting of the driveway access for the Hanson property, that the City had
requested Mr. Hansen to have his surveyors stake the City's right-of-way so
that an appropriate plan could be prepared by his engineers for improving the
1 sight distance along this curve uphill from his proposed driveway access. After
personally observing the stakes in the field, I mentioned to Mr. Cunningham that
in no way did the City intend to remove trees all the way up to these right-of-
way markers; however, we wanted to have it identified so that all parties would
1 be cognizant of its location.
I indicated to Mr. Cunningham that prior to any work being done within the City
1 right-of-way for shaving the side slope, that a plan was to be prepared by the
owner for my approval which would identify tree removal and other aspects of the
sight distance improvement. I assured Mr. Cunningham that we were not looking
Ito remove any more trees than absolutely necessary and that we would keep his
interests in mind and make him aware of any plans that would be submitted. I
indicated to Mt. Cunningham that installation of the driveway on Pleasant View
Road was permitted by the approval conditions of the development and that we
1 were striking a compromise between having this driveway completely on the east
side of the property which would necessitate removal of numerous pine trees
versus "favoring" the east side of the property and trimming a portion of the
IIside slope to the west of the property to achieve sufficient site distance.

I am in receipt of your letter of February 9 , 1988. Your letter

will be forwarded to Mayor Hamilton and all City Council Members .
The City of Chanhassen is also concerned with escalating property II taxes . As can be seen from the attached property tax sheets , the
City of Chanhassen' s total property tax level has remained vir-
tually the same for the past five years . During this same period
of time both the School District and County have increased. The
I
increase for 1988 should have produced an approximate 5% increase
in property tax levels . However, this increase did not occur
equally across all property tax classifications - a fact which II
should be of concern to business people. Specifically, two fac-
tors shifted a greater burden to commercial , industrial, and
other non-residential properties, i .e. :
II
o State Mandated Valuation Increases - in the fall of 1987 ,
the State Revenue Department reviewed the recommendations
of both the City and County Boards of Equalization. The 1
local Boards had approved relatively minor increases in all
property tax classifications to reflect current valuations .
It was the decision of the State that the commercial/
II
industrial valuations in all of Carver County were signi-
ficantly lower than the actual sales occurring in this
area. Both the City and County protested the State' s deci-
sion to increase commercial/industrial valuations by 15%.
II
It was our position that the sales statistics used by State
were not a reasonable sample and that such did not consider
valuation increases that had occurred in cities such as 1
Chanhassen. Our protests were not upheld;

° Change In Method Of Calculating Assessed Value - during
1987, the State Legislature changed the method of calcu-
lating assessed values for residential properties . The
' change appeared relatively minor, but on the average had
the effect of reducing property taxes for residential tax-
payers by approximately 5%. Accordingly, most taxpayers
' within our community did not see a tax increase in 1988 ,
i .e. the 5% increases in taxes were negated by the 5%
decrease in method of calculating assessed value. Please
' realize that the amount of property taxes to be collected
did increase 5%. Not only did businesses see this 5% , but
they also saw an increase resulting from the shift of the
tax burden from non-residential.
' The City' s ability to correct either of the two problems noted
above are limited, i .e. both of the changes occurred at the State
' level. Additionally, it does not appear as though that the
changes occurred uniformly within our commercial/industrial
areas . The City will be analyzing these statistics as we move
into the Board of Equalization and Review meetings set for early
' spring. If there is a means by which we can help provide relief,
we will surely attempt to do so.

I am in receipt of your February 17, 1988 letter concerning the
' desirability of adding an additional 24-inch roof hatch at 180
degrees from the existing hatch to provide better ventilation and
maintenance access . It was my understanding from the discussion
at our preconstruction meeting that this was indeed a good idea
1 and would be undertaken. I am therefore in agreement with
authorizing Hydrostorage to install this additional roof hatch
for a sum of $1, 270 as proposed in their February 5 , 1988 letter.
1 Please prepare any necessary paperwork to accomplish this
authorization.
1 In a related matter, as we discussed on the telephone last week,
the City has distributed paint samples to the surrounding neigh-
borhood as directed by the City Council. We therefore will not
be finalizing the color selection for the paint until March 28 ,
1 1988 . Any color selection made to date therefore is tentative
subject to this public input.
1 For your information, we have been receiving a number of requests
for consideration of painting the tower in a color more com-
patible with sky tones such as the cumulus color (BB82 ) shown in
the Tnemec chromocolors brochure. We then would perhaps be
' looking at the anvil gray (BC22 ) color for the maple leaf
although this would be open to suggestion.

Dear Resident: 1
The City Council at its February 22 , 1988 meeting, requested that
residents in the immediate vicinity of the new water storage 1
reservoir, located at the northeast corner of Lake Lucy Road and
Powers Boulevard, be notified of the color selection for painting
the tank. The 3 .5 million gallon water reservoir will be painted
as soon as weather permits this spring so it can be on-line in 1
time for our peak water demand period this summer.
This is to inform you that the City has chosen a desert sands

paint color which is similar to the paint swatch on the bottom of
this letter. This is similar to a dark beige and is categorized
by the manufacturer as a color which is in harmony with the 1
environment and mirrors the colors found in the earth, vegetation
and geological formations . The entire tank is to be painted in
this color, after which the City' s maple-leaf logo will be
painted in two locations in dark brown. 1
An artist' s rendering of the reservoir site in this color scheme
is on display at City Hall. This will be available for review II
- until March 25 , 1988 . Shortly thereafter, we will be notifying
the contractor of our color choice in order that the materials
can be acquired for painting the tank as soon as weather permits 1
this spring.

This letter is in regard to re-bidding of the Chanhassen Clock Tower and Entry
Monuments.
It looks as though attaching this project to an existing construction contract
is not feasible. Unless you can recommend any alternatives, I suggest that we
begin the re-bidding process as soon as possible. The following schedule is
recommended:
Advertisement for Bids March 11, 18, 25
Accept Bids March 30, 1988
Award Contract April 13, 1988
