ISUBJ: Establish Public Hearing Date for Tax Increment District #2
1 BACKGROUND
The City Council established May 9 , 1988, as the public hearing
1 date for Tax Increment #2 at the March 28 , 1988, meeting. However,
because of the issues pertaining to tax increment statutes now
pending in the legislature, it was determined that preparation of
the plan for this particular district should wait until the
1 legislature takes final action.
ANALYSIS
ITherefore, it is suggested that the Council establish a new public
hearing date of May 23 , 1988 . Attached is the resolution which
'1 should be amended to reflect the new public hearing date.
RECOMMENDATION
I it is recommended that the City Council establish May 23 , 1988 , as
the public hearing date for Tax Increment District #2 and that
Resolution No. 88-24 be amended to reflect the new date.

RESOLUTION CALLING FOR A PUBLIC HEARING ON THE ESTABLISHMENT
OF A DEVELOPMENT DISTRICT NO. 2 AND
TAX INCREMENT FINANCING DISTRICT NO. 2-1 ,
WHEREAS, the City Council of the City of Chanhassen wishes to
promote development within a portion of the City not currently
developed by establishing a Development District pursuant to
Minnesota Statutes, Sections 469.124 through 469.134 and a Tax
Increment Financing District pursuant to Minnesota Statutes,
Sections 469.174 through 469 .179 . '
NOW, THERFORE, BE IT RESOLVED, by the City Council of the
City of Chanhassen as follows:
1. LeFevere, Lefler, Kennedy, O' Brien & Drawz , P.A. is hereby
authorized and directed to prepare a Development District
Program (Program and Tax Increment Financing Plan (Plan) for
the project.
2. The City Manager is hereby authorized and directed to submit
the Program and Plan to the school board and to the Carver
and Hennepin County Boards for comment.
3 . The City Manager is hereby authorized and directed to submit '
the Program and Plan to the City Planning Commission for
review and comment.
4 . The City Manager is authorized and directed to prepare a
notice for publication in the official newspaper setting a
public hearing before the City Council on the 9th day of May,
1988, at 7 : 30 p.m. in the Council Chambers on the Program and
Plan and that such notice be published ian the newspaper at
least 10 but not more than 30 days prior to the public hearing.
Passed this 28th day of March, 1988 , by the City Council of
the City of Chanhassen, Minnesota.

ISUBJ: Approve Resolution Authorizing Public Hearing For TID #2
In accordance with state law, the City Council must pass a resolu-
I tion establishing a public hearing date for the creation of a tax
increment district. Ron Batty, from LeFevere, Lefler, has provided
a resolution establishing May 9 , 1988, as the public hearing date
I for Tax Increment District #2 on the McGlynn site. Staff will
also keep open the possibility of establishing a separate
district to include the American Legion and the parcel directly
east of the Legion. This is being done on a two fold basis:
I1 . Per Council instructions to look at other potential tax
increment areas to be considered prior to state law
Ichanges; and
2 . Should the state legislation not extend TID #2 to help
with relocated TH 101 costs , some form of subsidary
Ifinancing needs to be considered.
The Planning Commission as required by state law will review the
Iproposed tax increment plans on April 20 , 1988 .
RECOMMENDATION
IIt is recommended that the City Council adopt the resolution as
represented in Attachment #1.
