' BACKGROUND
The original plat for Carver Beach was platted in 1927 . The
Carver Beach plat contains a series of 20 foot by 100 foot lots .
' This parcel has been under separate ownership prior to the enact-
ment of zoning ordinances in 1972 . The applicants , R and R Land
Ventures have a purchase agreement on the subject property.
' APPLICABLE REGULATIONS
Section 20-72 of the Zoning Ordinance states that lots within the
RSF and R-4 Districts are entitled to a building permit if it has
been a single lot of record prior to February 19 , 1987 , and pro-
vided that it abuts a public right-of-way and the lot width and
' lot area requirements are at least 75% of the minimum require-
ments of the ordinance.
The subject lot does not meet the lot area test and therefore, a
lot area variance is required.
ANALYSIS
Section 20-58 of the Zoning Ordinance requires that the Board of
Adjustments and Appeals may grant a variance if it finds all of
' the following criteria are met.
The Board of Adjustments and Appeals shall not recommend and the
Council shall not grant, a variance unless they find the
following facts :
A. That the literal enforcement of this Chapter would cause
undue hardship and practical difficulty.
* Literal enforcement of the Ordinance would prevent reasonable
' use of the property.
B. That the hardship is caused by special conditions and cir-
cumstances which are peculiar to the land and structure
' involved and which are not characteristic of or applicable to
other lands of structures in the same district.
' * There is no self created hardship in this case. The lot has
been under separate ownership since prior to the enactment of
zoning ordinances in Chanhassen.
C. That the granting of the variance is necessary for the preser-
vation and enjoyment of substantial property rights .
* If the variance is denied, there are no other uses available
to be installed on the property.

D. That the special conditions and circumstances are not a con-
sequence of a self-created hardship.
* The lot is an existing lot of record and has been such since
prior to the effective date of zoning ordinances in Chanhassen.
E. That the variance will not be injurious to or adversely affect
the health, safety or welfare of the residents of the City of
the neighborhood wherein the property is situated and will be
in keeping with the spirit and intent of the Ordinance.
* The lot was intended as a single family lot. The structure on
the lot will have to meet the required setbacks of 30 feet in
the front and rear and 10 feet on the sides. Driveway access
to the property can be achieved and the parcel is served by
water and sewer.
RECOMMENDATION
1
Planning staff recommends that the Board of Adjustments and
Appeals approve Variance Request #88-4 as presented in the survey
dated March 8 , 1988 .
