ISUBJ: Disaster Preparedness Seminar
Emergency Management Institute
File No. A-120
I ,
As you are aware, April 10 through 13, 1988 , the authors of this
I memo attended a Disaster Preparedness seminar put on by the
Emergency Management Institute of the Federal Emergency
Management Agency (FEMA) in Emmitsburg, Maryland. The enrollment
expense, room and airfare was sponsored by FEMA. The seminar was
I quite well organized and conducted. We have attached a copy of
the class schedule for your information.
I It is easy to come back from a seminar of this nature all "gung
ho” to apply our recently acquired knowledge to the benefit of
the City of Chanhassen' s disaster policies. We all wish we had
I the luxury of time and resources to do this because we do believe
that steps need to be taken to prepare our local emergency pre-
paredness program action plan. The course gave us a good over-
view of the necessary requirements for a good action plan and
I allowed us to "armchair quarterback" a number of disasters such
as the Air Florida crash on the 14th Street bridge in Washington,
D .C. We were provided with formats and checklists to aid us in
I compiling an action plan for our community. It was quite clearly
presented in the seminar that the action plan needs to include
all aspects of involvement from the City Council on through to
I our response people. The value of a properly planned and laid
out emergency operations center (EOC) was highlighted a number of
times throughout the examples . This input will be useful to us
as we prepare the final construction documents for the expansion
Ito the fire station this year.
A couple of key items that struck us from the seminar are as
Ifollows:
II

could be devoted to this task as well as the need to involve a
number of other agencies and individuals from outside of our
' local arena to obtain the necessary support commitments. This
also will involve commitments from the City Manager and City
Council .
' We believe the City' s emergency preparedness action plan should
be updated based on the information we have been provided from
this seminar . We await your direction on how best to handle the
resource commitment for accomplishing this.
Attachment: Class Schedule
MANAGER' S RECOMMENDATION: All work functions require the
designation of a lead agency/individual to initiate the
' process/schedule/and coordinate. In this instance, I believe Jim
Chaffee, with assistance from Scott Harr, should initiate the
EPAP. the scope/objectives should be established first through
coordination of the group attending the seminar. These
' objectives/goals should then go to the Public Safety Commission
and City Council. After adoption, a similar process should occur
for the initial draft stage and final adoption stage.

Dear Mr. Ashworth:
1 The Metropolitan Parks Act requires the Metropolitan Council to make tax
equivalency payments to municipalities and townships. Minnesota Statutes
Section 473.341 provides as follows:
1 Section 473.341 (Tax Equivalents): In each of the four years after
the Metropolitan Council or park district, county or municipality
1 acquires fee simple title to any real property included in the
regional recreation open space system, the Metropolitan Council
shall pay to the municipality or township in which the property is
1 situated an amount equal to the total amount of the taxes levied
thereon for municipality or township purposes for collection in the
year in which title passed, diminished by 20 percent for each
subsequent year to and including the year of payment; provided that
1 for any years in which taxes on the property, or on the privilege
of using or possessing it, are paid this tax equivalent shall not
be paid. All amounts paid pursuant to this section are costs of
1 acquisition of the property with respect to which they are paid.
Pursuant to this legislative directive, please find enclosed our check for the
tax equivalency payment for 1986 due to your municipality or township. The
1 amount has been calculated as follows:
For parcels acquired in 1983: 20 percent of the taxes levied for municipal
1 purposes for collection in 1983.
For parcels acquired in 1984: 40 percent of the taxes levied for municipal
' purposes for collection in 1984.
For parcels acquired in 1985: 60 percent of the taxes levied for municipal
purposes for collection in 1985.
1 For parcels acquired in 1986: 80 percent of the taxes levied for municipal
purposes for collection in 1986.

Thank you for the opportunity to comment on the Bluff Point
Subdivision. The City Council considered this item at their '
April 11, 1988 meeting. The Council' s comments are as follows :
1 . The Council is fully sympathetic with Chaska' s dilemma in
I regards to reserving the new TH 41 corridor. The City will
be evaluating the need to include this corridor in its
upcoming revision to its transportation element of the
I comprehensive plan. The Council felt that priority should be
given to whatever area needs to be preserved for the TH 212
corridor and any potential interchange in the immediate vici-
nity.
1
2 . It is my understanding that Roman Roos made a presentation to
the Hesse Farm Homeowners Association regarding this sub-
1 division. I have also contacted the Homeowners Association
president regarding the subdivision. As of this date, I have
not received any adverse comments. They are aware of the
I Planning Commission and City Council meeting dates on this
item.
3 . The City concurs with the proposed location of a commercial
I area at the intersection of CR 17 and CR 14. The City has
received pressure to locate commercial areas in southern
Chanhassen, however, due to the unavailability of sanitary
sewer and water, Chanhassen feels that commercial areas are
not appropriate in the rural part of Chanhassen.
I 4 . Upon submission of the development plans for the multiple
family areas, the City requests that the Hesse Farm property
owners be notified as well as the City of Chanhassen. The
Council wants to insure that an appropriate transition occurs
1 between the multiple family area and the single family estate
developments of Hesse Farms.

IDear Representative Pauly:
On behalf of the City of Chanhassen, I would like to sincerely
I thank you for your valiant efforts to assist the City with the
extension of its present Economic Development District for the
purpose of providing a source of funding for state highway impro-
II vements. As you are very aware, state highway funding is totally
inadequate and we had hoped that the use of tax increment
financing would solve a major problem for the City of Chanhassen.
I We intended to use 100% of the proceeds from the extended term of
the District to fund improvements to Trunk Highways 101 and 5,
the former of which is one of the most dangerous segments of
roadway in the Metropolitan area.
IWe applaud you for your commitment to highway funding and your
determination to do something about it in spite of opposition to
I the City' s porposal by other members of the Hennepin County
legislative contingent. We very much appreciate your efforts on
our behalf.
ISincerely,

I
On March 23, 1988 , Fire Chief Dale Gregory and I attended a one
I day seminar entitled "AVOIDING CIVIL LIBERTIES FOR THE FIRE
SERVICE" , which was held at the Dakota County Technical Institute
in Rosemount.
IThe lawyer that conducted this class is a very active firefighter
himself, and definitely spoke from experience. He has both
represented and sued municipalities on numerous occasions .
IThe impact from this class came as the instructor clearly
outlined the shift in precedent, which no longer unquestioningly
I supports cities and fire departments . Law suits against fire and
rescue departments are definitely on the rise .
I Dale and I came away from the workshop with several very
constructive ideas to pursue that would help insulate the City of
Chanhassen from potential suits. We were also relieved to know
that the Chanhassen Fire Department' s excellent training program
1
is such that it undoubtedly lessens the risk of being sued.
Additional material covered during the day involved potential
1 liability resulting from building and fire inspections . Again,
this generated considerable thought on how current law applies to
our procedures.
1 Attached is the flyer describing the course. Chief Gregory and I
agreed that this was an excellent experience.

Dear Judge Kanning:
IThis letter is in reference to Mr. O'Connor ' s letter dated March
29 , 1988 (copy enclosed) . The City strongly opposes any further
continuances in this matter. A review of my file indicates
I Mr. Gavert originally appeared July 8 , 1987 on this charge.
The pre-trial was held in August, 1987 , and the matter was
originally scheduled for trial November 10 , 1987 . In November,
I 1987 on the date of trial , the defendant first requested a public
defender, even though he was advised at his arraignment of his
right to an attorney and signed an acknowledgement to that effect
which is part of the Court file. The matter was then set for
I jury trial on December 14, 1987 . At Mr. O'Connor ' s request,
the December 14, 1987 jury trial date was treated as a pre-trial
and a new trial date of January 13 , 1988 was set. On January
I 13 , 1988 , Mr. O'Connor called my home asking for a continuance
for personal reasons. The matter was re-set for trial February
9, 1988. On February 9 , 1988 after discussions with Judge
Kanning, the parties agreed to accompany Judge Kanning to view
I
Mr. Gavert ' s property. At that time, Mr. Gavert was given
additional time to clean up his property.
I It was my understanding that Judge Kanning ordered the trial
be re-set in April for a date certain. The attorneys in this
matter have had two months ' notice of the April 12th trial date.
I Mr. O'Connor has had more than adequate time to clear his
calendar for this trial .
In conclusion, I do not feel Mr. O'Connor ' s request for a

Dear Mr. Mullins :
1 Enclosed please find two initialed copies of the North/South
Connector Agreement originally executed and sent to you January
27, 1988 . It is frustrating to learn of yet another delay in
1 having this Authorization-For-Expenditure underway to say nothing
of the $19 , 441 increase to the estimated cost for the installa-
tion of the crossing and warning devices.
1 You may be interested to know that the City anticipates incurring
over $8 ,300 in additional costs for temporary detouring of traf-
fic at the Great Plains Boulevard railroad crossing because the
1 Soo Line Railroad has not carried through with construction of
this crossing in 1987 as planned. The City' s public safety
director and I are concerned, and I would think the Railroad
' would also be anxious to eliminate this temporary crossing con-
dition and the potential liability risks that exist due to your
delays . I sincerely hope the City will not be faced with a simi-
lar detour condition awaiting the North/South connector construc-
tion when our new Market Boulevard is completed this fall.

DATE: April 18 , 1988
MSUBJ: Attendance of Minnesota Beautiful Conference
I/ On Friday, April 15, 1988, I attended the Minnesota Beautiful
Conference held at the Minnesota Landscape Arboretum.
Registration was at 8 : 00 a.m. A welcome address by Sue
II Hodder, Chairperson of Minnesota Beautiful and Peter Olin,
Director of the Landscape Arboretum, followed. Carolyn Crayton,
Executive Director of Macon-Bibb County Beautification, Macon,
IIGeorgia, was the keynote speaker discussing her longstanding
involvement with the cleaning up of Macon, Georgia and the evolu-
tion of their Cherry Blossom Festival.
II Throughout the day there was opportunity to attend four workshop
sessions, of which I attended the following:
II 1 . Secrets for Successful Beautification Programs, speaker
Carolyn Crayton.
I2 . Promoting Tourism, speaker Colleen Illg.
3 . Outdoor Recreation Grants, speaker Cynthia Wheeler .
I 4 . Recycling: Mineland Reclamation, speakers Frank Catani,
Jerry Grund and Richard Korte.
A lunch and awards ceremony was held honoring this year ' s winners
of the Picture It Painted contest, a beautification project spon-
sored by Valspar Corporation and Minnesota Beautiful. This
I program should be remembered as a possible source of funding if
the Chanhassen Depot were ever to be refurbished. The luncheon
also provided me time to talk with professionals from all parts
of the state in a varety of fields. The conference provided a
I wealth of valuable information pertaining to Minnesota' s natural
resources. This, along with the fact that it is held in our own
City, is more than enough reason to make this conference an
Iannual event.

Dear Becky/Bob:
1 By the time you will have received this letter the legislative
session will have ceased (I hope) . I wish to thank both of you
1 for your efforts in helping Chanhassen attempt to obtain the
legislation we sought this past session as well as potentially
deleting those bills harming us . Frankly, I was amazed that we
1 were able to accomplish as much as we did (you did) recognizing
the general feelings towards tax increment.
Speaking of tax increment, I would like to use this letter as a
1 means to provide an early invitation to both of you to help
celebrate completion of our public improvements within the down-
. town area. Two separate forms of celebration are anticipated:
II ° Recognition Dinner - This event has been tentatively set for
the end of June. State, metropolitan, and County officials
will be recognized for the vital roles each played in helping
1 to make this project a reality. The event is anticipated to
start with a wine and cheese social hour in our "Heritage
Park" , followed by an official "lighting ceremony" . The
1 end of the event will include a sit-down meal with recogni-
tions at the Chanhassen Dinner Theatre; and
Fourth of July Celebration - This event will be similar to
Ic
the event scheduled for the end of June, i .e. a social period
at Heritage Park followed by the "lighting ceremony" . We
will then move to the Dinner Theatre parking lot where hot
I dogs/ pop/chips/beer ( separate concession area) will be
served. This event will be free to the public and everyone
within the community will be invited to join us . At dusk,
1 a fireworks display will occur followed by a street dance.

Re: Joint Powers Agreement, Fire Protection Services, M.A.
Gedney Company
Dear Dave:
This letter is to request your considering entering into a joint
powers agreement with the City of Chanhassen to jointly share
first responder responsibilities for the M.A. Gedney Company. I
would envision the agreement calling for the Sheriff' s Department
to notify both the Chaska Department as well as the Chanhassen
Department of any fire alarm/emergency. Given your close
proximity to the Gedney facility, without question, Chaska will
be first to arrive at the scene. However, such an agreement
should take care of the insurance problems currently being faced
by Mr. Gedney.
1 I would ask that the Chaska City Council consider the above
request as a short term solution to the insurance renewal
problems of Mr. Gedney. By considering this as an interim solu-
tion, hopefully we will eliminate any precedent problems that it
may cause for you. As far as a long term solution, I would
suggest that the Gedney issue continue to be incorporated into
our discussions regarding annexation/deannexation. Contrary to
newspaper accounts , I sincerely believe that an opportunity to
resolve differences that exist can be achieved during the next
two to three month period of time. If I am wrong, we will have
to face that issue at the expiration of the interim agreement ( I
would suggest six to twelve months) .
Unfortunately, our City Council will be meeting on the same date
as your Council . As such, I will not be able to personally
attend. However, I have asked our Public Safety Director, Jim

Dear Don:
Recently I received a letter from M.A. Gedney Co. requesting that the City
of Chaska provide them first response fire service to their pickle
processing facility located in Chanhassen. Attached is a copy of the
letter that I received from Mr. Robert Fadness, Executive Vice President.
Although the City of Chaska may well be willing to provide such first
response service I feel strongly that procedurally the agreement snould
' I be between the City of Chaska and the City of Chanhassen as opposed to
between Chaska and the private company. Consequently, I have informed Mr.
Fadness that he should pursue the matter through his local community and
then the two local communities, Chaska and Chanhassen, could enter into a
Joint Powers Agreement providing such first response services. If you
have concerns regarding such an agreement please feel free to contact me at
your convenience otherwise I will expect to hear from you once
representatives from Gedney discuss the matter further with you or your
staff.
' Chaska sincerely looks forward to continued close cooperation with
Chanhassen. If you have any questions or comments please feel free to
contact me.

Attn: Mr. Clayton T. Johnson
I P .O. Box 100
Chanhassen, MN 55317
IRe: Continuing Role of CHADDA
Dear Clayton:
I This letter is being written as a reinstatement of discussions
you and I have had during the past several months. I believe
that it is vitally important that the role of Bloomberg Companies
I be very distinct when we move from a period of time when CHADDA
is acting primarily in behalf of the Redevelopment Authority to
the period of time where CHADDA or Bloomberg Companies could they
Ithemselves be directly benefitting from redevelopment activities .
As we previously discussed, the role of Bloomberg Companies is
very clear in terms of transactions dealing with Havlik, Riviera
I and Labalo. Bloomberg Companies/CHADDA maintained no ownership -
positions prior to nor after redevelopment transactions were
completed. Bloomberg Companies acted solely as a conduit in
I negotiating for the acquisition of property, carrying out its
acquisition, and helping to see the properties re-sold to a third
party - such not directly benefitting Bloomberg Companies . In
I the above processes, the Housing and Redevelopment Authority did
pay to Bloomberg Companies all costs associated with the acquisi-
tions, closing costs and final deed transfers . In addition, per
the redevelopment agreement entered into between the Housing and
I Redevelopment Authority and Bloomberg Companies/CHADDA, the City
did pay a realty fee for both transactions .
I All costs associated with the downtown redevelopment project,
from Bloomberg Companies standpoint, have been divided into 1/6
shares . Each 1/6 share represents a redevelopment activity which
may or may not directly benefit Bloomberg Companies, i .e. the
1 hotel property, grocery/Gibson property, South 78th Street
retail, and the three projects on the north side of 78th street
(Retail West [Havlik/Riveria] , Retail Central [Labalo,
I _ Modeen/Hendrickson, Hanson] , and Apartment complex) .

MEMORANDUM
ITO: Lori Sietsema, Park and Recreation Coordinator
1 FROM: Todd Hoffman, Recreation Supervisor 4/*
DATE: April 22, 1988
IISUBJ: Report to the Chanhassen Park and Recreation Commission,
Financial Status of Girls Traveling Softball Team
1 At the Chanhassen City Council meeting of April 11, 1988,
Councilman Jay Johnson made a request on behalf of the Chanhassen
I Girls Traveling Softball Team. He asked that the Council con-
sider the possibility of helping fund this group' s first year as
an organized team. The general response from Council members was
that they would not want to set a precedent by funding this
I
group, leaving the gates open for a flood of other requests. The
City Council referred this item to the Park and Recreation
Commision for discussion.
1 In the interim, I had discussions with both Jay Johnson and Gary
Meister, the Girl' s Softball Coordinator. Both Jay and Gary are
I currently fairly comfortable with the financial outlook of the
1988 traveling team. Gary has secured a donation of approxi-
matley $700 in payment in kind from Team Choice Sports of Eden
Prairie. In exchange, Team Choice Sports will be the official
I sponsor of the 1988 team. Gary has also secured approximately
$200 in donations from Chanahssen businesses after a lengthy cam-
paign attempting to find a local sponsor. Another $200 - $300
I has been raised through a Minnesota Sports Federation fundraiser.
Add to this the individual registration fee ( 15 registrants x
$65. 00 = $975. 00 ) and Gary estimates the program will fall $500
$1000 short this year. Gary feels that since 1988 is the Ito
first year of the program, start up costs are significant and
could be made up in future years or with additional fundraising
this year. Therefore, no action from the Park and Recreation
1 Commission is necessary at this time, although discussion of the
initial proposal would be welcome for future reference.

' TO: Community Center Task Force
FROM: Lori Sietsema, Park and Recreation Coordinator
' DATE: April 21, 1988
SUBJ: Formation of New Task Force
' The Chanhassen City Council has indicated that they are still
interested in building a community center in Chanhassen. They
are considering a second referendum in November that will include
the community center and trails. Two new task forces will be
' formed that will study these issues .
It looks as though CHADDA will be exercising their option on the
' downtown site. Therefore, the new task force will be using all
of the information and research gathered by the original group to
come up with alternate sites and plans .
The Council has invited any interested members of the original
task force to join this new group. If you are interested in
being involved, please let me know.

1 PUBLIC NOTICE
1 The Chanhassen City Council is anticipating to put the community
center and the city-wide trail plan on the ballot in November.
They will appoint two task forces to study these issues .
1 The new Community Center Task Force will use the information and
the research from the original task force to determine alternate
sites to be considered for a community center. It is anticipated
1 that the group will begin their study in May and will submit a
recommendation to the City Council by September.
The Trail Plan Task Force will study why this item failed and
1 take appropriate steps to inform the residents of Chanhassen for

however, the majority of their work will occur in September and
1 October.
These groups are open to any resident in Chanhassen. If you are

1 St. Hubert' s Church and School
Attn: Fr. Barry Schneider, OFM
I 7707 Great Plains Blvd.
Chanhassen, MN 55317
Dear Fr. Schneider:
I
Thank you for both your letter of March 15 as well as April 14,
1988 . As we discussed over the telephone approximately one week
I ago, items were backlogged for me as a result of my three week
illness.
I As stated in our telephone conversation, I see no problem in
moving the bells from old St. Hubert' s Church to a site near the
new church building. As you stated, you recognize the need for a
building permit and regulations to meet the structural require-
' ments set by the City. In light of these facts and the points
you raised in your letter of March 15, 1988, I again do not see a
problem in moving the bells . I will forward this correspondence
Ito the City Council so that they are fully aware of the proposal.
Per our discussion, I am enclosing a copy of the current lease
I for the old St. Hubert' s Church facility. I , too, would like to sit
down and discuss options which may be open to both the church and
the city as a result of both the Family of Christ Lutheran Church
moving as well as expiration of the lease itself . As some of the
I options to be discussed will have budgetary impacts , I would like
to meet with you in the very near future. Our budgetary process
begins in July and again, our discussion should occur prior to
I that time frame. After you have had an opportunity to review the
existing lease, please feel free to contact me regarding a poten-
tial meeting date.
IYour letter of April 14, 1988, has been forwarded to our con-
sulting engineers, BRW. By this letter, I am asking that Gary
Ehret, Project Engineer for BRW, respond to the questions you
Iraised regarding the dead spruce tree.

Dear Mr. Ashworth:
IIn completing landscaping and beautification "chores" in
the area of St. Hubert, we wish you would examine the spruce
1 tree on our property on the north-east corner of the inter-
section of Great Plains Blvd. and Hwy. 101 (78th St.) -
directly across from old St. Hubert Church.
IThe tree was alive - in very beautiful condition before the
digging near and around it began last fall. It is apparent the
tree has died. We would like a replacement.
II have heard the tree near the intersection one block west of
the area I speak of needs to be moved. We'd be satisfied with
IIsuch a tree.
Sincerely,

DON ASHWORTH, CITY MANAGER
Chanhassen City Hall
P.O. Box 147
Chanhassen, Minnesota 55317
Dear Don:
Our St. Hubert Parish Community has decided to move the bells
from old St. Hubert Church to a site near our new church building.
Since we are still bound by lease agreement with the City of
Chanhassen, we should like your written approval of this project
to begin sometime in early summer. We would coordinator work
with Pastor Nate Castens of Family of Christ Lutheran Church so
as not to interfere with their activities.
Existing trap doors will allow us to drop the bells straight
down without demolition. However, the plaster ceiling above the
main entry will have to be cut through and properly repaired after
the bell transfer.
The contracting firm will furnish a certificate of insurance
against any liability, and we'll see to it that the ceiling patch
work is done neatly and properly. We would appreciate your speedy
attention to this matter.
Sincerely yours,
TA •Blkieity----
