I FROM: Dale Gregory, Fire Chief iPi Todd Gerhardt, Administrative Assistant 91 Jim Chaffee, Public Safety Director IGary Warren, Director of Public Works DATE: April 18 , 1988 ISUBJ: Disaster Preparedness Seminar Emergency Management Institute File No. A-120 I , As you are aware, April 10 through 13, 1988 , the authors of this I memo attended a Disaster Preparedness seminar put on by the Emergency Management Institute of the Federal Emergency Management Agency (FEMA) in Emmitsburg, Maryland. The enrollment expense, room and airfare was sponsored by FEMA. The seminar was I quite well organized and conducted. We have attached a copy of the class schedule for your information. I It is easy to come back from a seminar of this nature all "gung ho” to apply our recently acquired knowledge to the benefit of the City of Chanhassen' s disaster policies. We all wish we had I the luxury of time and resources to do this because we do believe that steps need to be taken to prepare our local emergency pre- paredness program action plan. The course gave us a good over- view of the necessary requirements for a good action plan and I allowed us to "armchair quarterback" a number of disasters such as the Air Florida crash on the 14th Street bridge in Washington, D .C. We were provided with formats and checklists to aid us in I compiling an action plan for our community. It was quite clearly presented in the seminar that the action plan needs to include all aspects of involvement from the City Council on through to I our response people. The value of a properly planned and laid out emergency operations center (EOC) was highlighted a number of times throughout the examples . This input will be useful to us as we prepare the final construction documents for the expansion Ito the fire station this year. A couple of key items that struck us from the seminar are as Ifollows: II ' Don Ashworth April 18, 1988 Page 3 could be devoted to this task as well as the need to involve a number of other agencies and individuals from outside of our ' local arena to obtain the necessary support commitments. This also will involve commitments from the City Manager and City Council . ' We believe the City' s emergency preparedness action plan should be updated based on the information we have been provided from this seminar . We await your direction on how best to handle the resource commitment for accomplishing this. Attachment: Class Schedule MANAGER' S RECOMMENDATION: All work functions require the designation of a lead agency/individual to initiate the ' process/schedule/and coordinate. In this instance, I believe Jim Chaffee, with assistance from Scott Harr, should initiate the EPAP. the scope/objectives should be established first through coordination of the group attending the seminar. These ' objectives/goals should then go to the Public Safety Commission and City Council. Minnesota Statutes Section 473.341 provides as follows: 1 Section 473.341 (Tax Equivalents): In each of the four years after the Metropolitan Council or park district, county or municipality 1 acquires fee simple title to any real property included in the regional recreation open space system, the Metropolitan Council shall pay to the municipality or township in which the property is 1 situated an amount equal to the total amount of the taxes levied thereon for municipality or township purposes for collection in the year in which title passed, diminished by 20 percent for each subsequent year to and including the year of payment; provided that 1 for any years in which taxes on the property, or on the privilege of using or possessing it, are paid this tax equivalent shall not be paid. All amounts paid pursuant to this section are costs of 1 acquisition of the property with respect to which they are paid. The Council' s comments are as follows : 1 . The Council is fully sympathetic with Chaska' s dilemma in I regards to reserving the new TH 41 corridor. The City will be evaluating the need to include this corridor in its upcoming revision to its transportation element of the I comprehensive plan. The Council felt that priority should be given to whatever area needs to be preserved for the TH 212 corridor and any potential interchange in the immediate vici- nity. 1 2 . It is my understanding that Roman Roos made a presentation to the Hesse Farm Homeowners Association regarding this sub- 1 division. I have also contacted the Homeowners Association president regarding the subdivision. As of this date, I have not received any adverse comments. They are aware of the I Planning Commission and City Council meeting dates on this item. 3 . The City concurs with the proposed location of a commercial I area at the intersection of CR 17 and CR 14. The City has received pressure to locate commercial areas in southern Chanhassen, however, due to the unavailability of sanitary sewer and water, Chanhassen feels that commercial areas are not appropriate in the rural part of Chanhassen. I 4 . Upon submission of the development plans for the multiple family areas, the City requests that the Hesse Farm property owners be notified as well as the City of Chanhassen. The Council wants to insure that an appropriate transition occurs 1 between the multiple family area and the single family estate developments of Hesse Farms. As you are very aware, state highway funding is totally inadequate and we had hoped that the use of tax increment financing would solve a major problem for the City of Chanhassen. I We intended to use 100% of the proceeds from the extended term of the District to fund improvements to Trunk Highways 101 and 5, the former of which is one of the most dangerous segments of roadway in the Metropolitan area. IWe applaud you for your commitment to highway funding and your determination to do something about it in spite of opposition to I the City' s porposal by other members of the Hennepin County legislative contingent. IThe lawyer that conducted this class is a very active firefighter himself, and definitely spoke from experience. He has both represented and sued municipalities on numerous occasions . IThe impact from this class came as the instructor clearly outlined the shift in precedent, which no longer unquestioningly I supports cities and fire departments . Law suits against fire and rescue departments are definitely on the rise . I Dale and I came away from the workshop with several very constructive ideas to pursue that would help insulate the City of Chanhassen from potential suits. We were also relieved to know that the Chanhassen Fire Department' s excellent training program 1 is such that it undoubtedly lessens the risk of being sued. Additional material covered during the day involved potential 1 liability resulting from building and fire inspections . Again, this generated considerable thought on how current law applies to our procedures. 1 Attached is the flyer describing the course. The City strongly opposes any further continuances in this matter. A review of my file indicates I Mr. Gavert originally appeared July 8 , 1987 on this charge. The pre-trial was held in August, 1987 , and the matter was originally scheduled for trial November 10 , 1987 . In November, I 1987 on the date of trial , the defendant first requested a public defender, even though he was advised at his arraignment of his right to an attorney and signed an acknowledgement to that effect which is part of the Court file. The matter was then set for I jury trial on December 14, 1987 . At Mr. O'Connor ' s request, the December 14, 1987 jury trial date was treated as a pre-trial and a new trial date of January 13 , 1988 was set. On January I 13 , 1988 , Mr. O'Connor called my home asking for a continuance for personal reasons. The matter was re-set for trial February 9, 1988. On February 9 , 1988 after discussions with Judge Kanning, the parties agreed to accompany Judge Kanning to view I Mr. Gavert ' s property. At that time, Mr. Gavert was given additional time to clean up his property. I It was my understanding that Judge Kanning ordered the trial be re-set in April for a date certain. The attorneys in this matter have had two months ' notice of the April 12th trial date. I Mr. O'Connor has had more than adequate time to clear his calendar for this trial . The City' s public safety director and I are concerned, and I would think the Railroad ' would also be anxious to eliminate this temporary crossing con- dition and the potential liability risks that exist due to your delays . Registration was at 8 : 00 a.m. A welcome address by Sue II Hodder, Chairperson of Minnesota Beautiful and Peter Olin, Director of the Landscape Arboretum, followed. Carolyn Crayton, Executive Director of Macon-Bibb County Beautification, Macon, IIGeorgia, was the keynote speaker discussing her longstanding involvement with the cleaning up of Macon, Georgia and the evolu- tion of their Cherry Blossom Festival. II Throughout the day there was opportunity to attend four workshop sessions, of which I attended the following: II 1 . Secrets for Successful Beautification Programs, speaker Carolyn Crayton. I2 . Promoting Tourism, speaker Colleen Illg. 3 . Outdoor Recreation Grants, speaker Cynthia Wheeler . I 4 . Recycling: Mineland Reclamation, speakers Frank Catani, Jerry Grund and Richard Korte. A lunch and awards ceremony was held honoring this year ' s winners of the Picture It Painted contest, a beautification project spon- sored by Valspar Corporation and Minnesota Beautiful. This I program should be remembered as a possible source of funding if the Chanhassen Depot were ever to be refurbished. The luncheon also provided me time to talk with professionals from all parts of the state in a varety of fields. The conference provided a I wealth of valuable information pertaining to Minnesota' s natural resources. I wish to thank both of you 1 for your efforts in helping Chanhassen attempt to obtain the legislation we sought this past session as well as potentially deleting those bills harming us . Frankly, I was amazed that we 1 were able to accomplish as much as we did (you did) recognizing the general feelings towards tax increment. Speaking of tax increment, I would like to use this letter as a 1 means to provide an early invitation to both of you to help celebrate completion of our public improvements within the down- . town area. Two separate forms of celebration are anticipated: II ° Recognition Dinner - This event has been tentatively set for the end of June. State, metropolitan, and County officials will be recognized for the vital roles each played in helping 1 to make this project a reality. The event is anticipated to start with a wine and cheese social hour in our "Heritage Park" , followed by an official "lighting ceremony" . The 1 end of the event will include a sit-down meal with recogni- tions at the Chanhassen Dinner Theatre; and Fourth of July Celebration - This event will be similar to Ic the event scheduled for the end of June, i .e. a social period at Heritage Park followed by the "lighting ceremony" . We will then move to the Dinner Theatre parking lot where hot I dogs/ pop/chips/beer ( separate concession area) will be served. This event will be free to the public and everyone within the community will be invited to join us . I would envision the agreement calling for the Sheriff' s Department to notify both the Chaska Department as well as the Chanhassen Department of any fire alarm/emergency. Given your close proximity to the Gedney facility, without question, Chaska will be first to arrive at the scene. However, such an agreement should take care of the insurance problems currently being faced by Mr. Gedney. 1 I would ask that the Chaska City Council consider the above request as a short term solution to the insurance renewal problems of Mr. Gedney. By considering this as an interim solu- tion, hopefully we will eliminate any precedent problems that it may cause for you. As far as a long term solution, I would suggest that the Gedney issue continue to be incorporated into our discussions regarding annexation/deannexation. Contrary to newspaper accounts , I sincerely believe that an opportunity to resolve differences that exist can be achieved during the next two to three month period of time. If I am wrong, we will have to face that issue at the expiration of the interim agreement ( I would suggest six to twelve months) . Unfortunately, our City Council will be meeting on the same date as your Council . As such, I will not be able to personally attend. The general response from Council members was that they would not want to set a precedent by funding this I group, leaving the gates open for a flood of other requests. The City Council referred this item to the Park and Recreation Commision for discussion. 1 In the interim, I had discussions with both Jay Johnson and Gary Meister, the Girl' s Softball Coordinator. Both Jay and Gary are I currently fairly comfortable with the financial outlook of the 1988 traveling team. Gary has secured a donation of approxi- matley $700 in payment in kind from Team Choice Sports of Eden Prairie. In exchange, Team Choice Sports will be the official I sponsor of the 1988 team. Gary has also secured approximately $200 in donations from Chanahssen businesses after a lengthy cam- paign attempting to find a local sponsor. Another $200 - $300 I has been raised through a Minnesota Sports Federation fundraiser. Add to this the individual registration fee ( 15 registrants x $65. 00 = $975. 00 ) and Gary estimates the program will fall $500 $1000 short this year. Gary feels that since 1988 is the Ito first year of the program, start up costs are significant and could be made up in future years or with additional fundraising this year. Therefore, no action from the Park and Recreation 1 Commission is necessary at this time, although discussion of the initial proposal would be welcome for future reference. HUBERT'S CHURCH 1 SUBLEASE AGREEMENT CITY OF CHANHASSEN - FAMILY OF CHRIST LUTHERAN CHURCH 1 THIS AGREEMENT, made and entered into as of the first day of November, 1983 , by and between the City of Chanhassen, a 1 Minnesota municipal corporation ( "City") and Family of Christ Lutheran Church of Chanhassen ( "Church") . WITNESSETH, that the City and Church in consideration of 1 the mutual covenants herein contained, hereto recite and agree as follows: 1 SECTION 1 RECITALS 1 .01 Lease. The City has heretofore under date of December 31, 1978, leased the premises commonly known as Old St. 1 Hubert' s Church ( "Premises") from the Church of St. Hubert's of Chanhassen for an initial term of five years with a renewal for an additional five year term from December 31, 1983; that a true 1 and correct copy of said lease together with a copy of the proposed 1983 renewal lease are attached hereto as Exhibit A and made a part hereof. 1 1.02 Sublease. The Family of Christ Lutheran Church of Chanhassen desires to sublease said premises from- the City for use as a place of worship, including facilities for church com- mittee meetings, church office space, Sunday school, choir prac- tice and related church activities. 1.03 Consent of City. The City agrees to the sublease of the premises upon the following terms and conditions. SECTION 2 SUBLEASE TERMS AND CONDITIONS i2 .01 Term of Sublease and Rental. The term of the writ- ten sublease shall be for a period of 5 years from December 31, 1 1983 , to December 31, 1988, the Church paying therefor the rent of One Dollar ($1 . 00 ) per year or fraction thereof, payable in advance on the first day of November of each year of the term of the lease. This lease will be subject to cancellation by the 1 Church upon submission of a written notice of the intent to vacate one year in advance of said action, and the Church shall be responsible for all rental and other obligations contained 1 herein up to and including the actual date the premises are vacated. 1 2.02 Additional Rental. In addition to the rental hereinabove set forth the Church shall pay additional rental in the following manner. 1 1984 - $2 , 000 1985 $2,500 1986 - $3 , 000 1 1987 - $3 ,500 1988 $4 ,000 1 ' • ' ( _ The above sums shall be payable in quarterly installments due on the first business day of each quarter. Said quarterly rental installments shall be deposited in a special bank account with the City and shall be used for the making of capital improvements to the structure as shall be deemed necessary by mutual agreement of the Church and the City. Any funds remaining in said account at the termination or cancellation of this sublease shall be disposed of as follows: a. Utilized for such purposes as may be mutually agreed upon between the Church and the City in the event the sublease is renewed, or - b. - If the lease is not renewed or is cancelled, then 40% of the fund paid over to the City, and out of • the remaining 60%, the City shall be paid any and all sums owed by the Church hereunder and still unpaid. To assume all utility costs including heat, electri- city, sewer and water, and costs of grounds maintenance including grass cutting and snow removal, which are to be considered also part of the rental due under this lease. 2 . To provide office space of no smaller than square feet for Church of St. Hubert's Youth Activities Director under terms with St. Hubert's. 3 . To retain the historical value of the sanctuary to the City and Church of St. Hubert' s, and not to remodel or redecorate the same. 4. To provide public liability and structural physical damage insurance covering said premises, insuring the interests of the City, the Church, and the Church of St. Hubert 's of Chanhassen for the costs of insurance coverage expended by it in insuring said premises at full insurable value of said premises; the Church shall furnish evidence of such paid up insurance to the City in advance of every year of the term of this lease. 5 .
