SUBJ: Approve Vacation of Drainage and Utility Easement over Lot 18,
Block 1, Colonial Grove at Lotus Lake
PROPOSED MOTION
"The City Council adopts a resolution approving the vacation of the drainage
and utility easement over Lot 18, Block 1, Colonial Grove at Lotus Lake,
according to the recorded plat thereof."
City Council approval requires a simple majority vote of those present.
BACKGROUND
The drainage and utility easement on Lot 18, Block 1, Colonial Grove at Lotus
Lake was recorded with the final plat of Colonial Grove at Lotus Lake (see
attached).
PROPOSAL
The current residents are planning to build an addition onto their house with a
roof that will overhang into the easement. Permanent residential structures cannot
be built in a drainage and utility easement, so the residents have requested the
City vacate the easement.
Gopher State One Call has confirmed that no private utilities are located in this
easement. Likewise, the City has no utilities located in this easement. The City
does not plan to install utilities in this easement in the foreseeable future.
Therefore, staff recommends granting the vacation of drainage and utility
easement over Lot 18, Block 1, Colonial Grove at Lotus Lake (7018 Dakota
Circle).

Easement Description for Vacation of Easement
on Lot 18, Block 1, Colonial Grove at Lotus Lake
The point of beginning will be the most easterly point on the south line of Lot 18, Block 1,
Colonial Grove at Lotus Lake; thence going westerly along the south line of Lot 18 a distance of
121'; thence turning northerly perpendicular to the south line for a distance of 10'; thence
turning easterly running perpendicular to the south line until intersecting the easterly property
line; thence turning southeasterly along the east line to the point of beginning.
The lines of said easement shall be shortened, lengthened or prolonged to terminate at the
southerly and easterly lines of Lot 18.
