City Council approval requires a simple majority vote of those present. BACKGROUND The drainage and utility easement on Lot 18, Block 1, Colonial Grove at Lotus Lake was recorded with the final plat of Colonial Grove at Lotus Lake (see attached). PROPOSAL The current residents are planning to build an addition onto their house with a roof that will overhang into the easement. Permanent residential structures cannot be built in a drainage and utility easement, so the residents have requested the City vacate the easement. Gopher State One Call has confirmed that no private utilities are located in this easement. Likewise, the City has no utilities located in this easement. The City does not plan to install utilities in this easement in the foreseeable future. Therefore, staff recommends granting the vacation of drainage and utility easement over Lot 18, Block 1, Colonial Grove at Lotus Lake (7018 Dakota Circle). Attachments: 1. Plat of Colonial Grove 2.
