SUBJ: Accept Donation of Outlot B, Bluff Creek Corporate Center
PROPOSED MOTION:
"The City Council accepts the donation of Outlot B, Bluff Creek Corporate Center from
Family of Christ Lutheran Church."
Approval of this item requires a super majority (4/5) vote of the City Council.
BACKGROUND
Family of Christ Lutheran Church is interested in donating Outlot B of the Bluff Creek
Corporate Center to the City of Chanhassen.
The parcel includes Bluff Creek, a riparian wetland, and some prairie, as well as a
storm water pond. It is contiguous with the Chanhassen Rec Center and Bluff Creek
Elementary School property and contains a City trail.
The acquisition is consistent with the Bluff Creek Management plan to acquire green
space and consistent with the Bluff Creek TMDL implementation plan.
The land is being donated to the City, is presently tax- exempt, and there is no loss of
property tax revenues. It is maintained as a natural area and maintenance costs are
expected to be minimal.
The Water Resources Coordinator conducted a historic aerial review back to 1979 and
USGS topographical review back to 1901 and found that the data indicates the land has
always been used in agriculture or natural state. The City thus declined to conduct a
Phase I environmental review.
RECOMMENDATION
Staff recommends approval of the Resolution accepting the land donation.

RESOLUTION ACCEPTING DONATION OF REAL PROPERTY
WHEREAS, the Family of Christ Lutheran Church, a Minnesota non - profit corporation is
the fee owner ( "Owner ") of real property located within the City of Chanhassen ( "City ") legally
described as follows:
Outlot B, Bluff Creek Corporate Center, Carver County, Minnesota,
excepting therefrom that part of Outlot B, Bluff Creek Corporate Center,
shown as Parcel 215B on Minnesota Department of Transportation Right of
Way Plat Numbered 10 -08 as the same is on file and of record in the office
of the County Recorder in and for Carver County, Minnesota.
(the "Church Property "); and
WHEREAS, Owner desires to donate the Church Property to the City; and
WHEREAS, such donation will benefit the citizens of the City; and
WHEREAS, Owner has executed a Quit Claim Deed for the purpose of transferring its
ownership interest in the Church Property to the City, and the Quit Claim Deed will be recorded
upon adoption of this Resolution at the sole expense of the City; and
WHEREAS, Minnesota Statutes Section 465.03, requires that donations of real property or
personal property be accepted by a resolution of the City Council adopted by a two - thirds majority of
its members.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF CHANHASSEN, MINNESOTA:
1. The City Council hereby accepts the donation of the Church Property by Owner.
2. The Mayor and City Manager are authorized to execute any documents which, in the
opinion of the City Attorney, are necessary to effectuate this transaction. The City
Clerk is specifically designated as the person who can sign IRS Form 8283.
