Mak Sweidan, Engineer (~ ~ June 15,2005 FROM: DATE: SUBJ: Vacation of Drainage and Utility Easements within the Boyer Lake Minnewashta Addition - Vacation File No. 05-01 REQUEST (Simple Majority Vote Required) Staff has received a request from Boyer Building Corp., the developer of the Boyer Lake Minnewashta Addition, to vacate drainage and utility easements on Lots 5, 6, 7 and 8, Block 1, Boyer Lake Minnewashta Addition. BACKGROUND The existing drainage and utility easements were granted to the City as a part of the Boyer Lake Minnewashta Addition plat in 2002. The Boyer Lake Minnewashta Addition plat was approved by the City Council on September 23, 2002. On June 1,2005, the applicant contacted staff to investigate the option of consolidating four lots into three (the homes were too large and the applicant could not meet the hard surface ordinance requirements). DISCUSSION The underlying Lot Nos. 5,6, 7 and 8, Block 1 were originally platted as a part of the Boyer Lake Minnewashta Addition plat. Twenty-foot drainage and utility easements (light shaded) along the lot lines were granted to the City. With the lot consolidation request from four lots (5, 6, 7, and 8) to three (A, B, C), new drainage and utility easements (dark shaded) have been dedicated to the City for the new relocated storm sewer lines. In order to remove the old easement encumbrances on the new Boyer Lake Minnewashta lots, the developer has requested that the City vacate the old easements. Staff has no objection to this since new easements are being granted. RECOMMENDA TION Staff recommends that the City Council adopt the following motion: The City of Chanhassen · A growing community with clean lakes, quality schools, a charming downtown, thriving businesses, winding trails, and beautiful parks A great place to live, work, and play Mak Sweidan June 15, 2005 Page 2 "The Chanhassen City Council approves a resolution vacating drainage and utility easements (light shaded) and dedicating the new public drainage and utility easements (dark shaded) as defined on the attached vacation and parcels A, Band C legal descriptions, with the following condition: Due to the relocation of property lines, existing easements need to be vacated and new easements dedicated.
