And, Adoption of the attached Findings of Fact and Recommendation." City Council approval requires a simple majority vote. EXECUTIVE SUMMARY The Carver County Parks Department is requesting a wetland alteration permit for wetland impacts as a result of the proposed Lake Minnewashta Regional Park Improvements Project. This is a revision to the original application, dated July 24, 2014. The revision includes the addition of 806 square feet of impact to one additional wetland (Lake Minnewashta).The proposed project consists of reshaping and resurface of the current gravel surface access roads within the park to bituminous surface, tail realignment, and construction of a bypass lane and turnaround at the park entrance (see Figure 1 below). Construction for the proposed project is expected to begin in September, 2014, with substantial completion by October 31, 2015. The proposed project will result in impacts to three wetland basins, which will result in a total of .07 acres of permanent wetland impact. The original application called for only .05 acres of impact. However, an addendum was submitted by the applicant on August 26, 2014, identifying additional impact to an additional wetland totaling 806 square feet. This addendum has been included in the application. PLANNING COMMISSION SUMMARY The Planning Commission held a Public Hearing on August 19, 2014 to review the wetland alteration permit for the proposed road improvement project. The commission voted seven to zero on a motion recommending approval of the wetland alteration permit and wetland replacement plan. No individuals spoke at the public hearing. RECOMMENDATION Staff recommends adoption of the following motion approving the Wetland Alteration Permit and Wetland Replacement Plan: "The Chanhassen Planning Commission recommends that City Council approve Wetland Alteration Permit #2014 -23 and WCA Permit Number 2014 -03 to impact .05 acres of wetland and the wetland replacement plan under MN Rules Chapter 8420 which utilizes the purchase of .1 acres of wetland credit from bank #1375 for the purpose of the proposed Lake Minnewashta Regional Park Improvements Project; and authorize the Water Resources Coordinator to sign the joint water resource application for approval of wetland replacement as shown in plans dated July 22, 2014, subject to conditions within this staff report. If the City finds that all the applicable wetland alteration permit standards are met, the permit must be approved. This is a quasi-judicial decision. This wetland bank is located in the same Bank Service Area (BSA 7) and Major Watershed (19 -South Fork, Crow R.) as the proposed project. Therefore, the impacts are required to be mitigated for at a 2:1 ratio, resulting in the purchase of .1 acres of wetland credit from bank #1375. This is consistent with Chapter 8420.0522 of the Wetland Conservation Act (WCA) Rules. BACKGROUND Carver County Parks has received grant funding from the State of Minnesota, through the Legacy Amendment, for the proposed improvements to Lake Minnewashta Regional Park with the purpose of improving public amenities within the park and providing safer access for the public. The park experiences over 147,400 visits throughout the year. Many of these users are recreationalists who utilize the park's two boat launches, as they provide the only public access to Lake Minnewashta. Lake Minnewashta Regional Park currently consists of 341 acres of forest, wetland, prairie, shoreline habitat, and developed parkland, and includes two boat accesses, 4 picnic shelters, a beach area, creative playground, 5 miles of trail and a fishing pier. All access roads within the park are currently gravel surfaced, including Scenic Drive, the main roadway through the park. The park's roadways have been experiencing unsafe conditions and erosion due to washouts, frost boils, and irregular road surfaces. Lake Minnewashta Regional Park has also at times experienced backups onto Highway 41 at the entrance of the park, creating unsafe conditions for motorists and users. The goal of the project is to improve safety and accessibility, and reduce erosion. Additional project information can be found in the memorandum, permit application, and its attachments dated July 22, 2014. The need for the project is also identified in the State Park Road Account Program grant application, and the Carver County's Park Master Plan. The proposed Lake Minnewashta Regional Park Improvements Project includes trail improvements, roadway improvements, access road improvements, boat launch improvements and expansion, and construction of an entrance turnaround. The project will disturb a total of 10.37 acres of land, and increase the existing impervious surface within the park by .45 acres. Trail improvements include construction of a new bituminous trail as part of the trail realignment, as well as demarcation of a cross- country skiing trail. The road improvements include resurfacing the current gravel surface roadway to a 22 -foot wide rural bituminous surface with gravel shoulders. This includes the access road to the dog park, and the creation of a 250 -foot bypass lane at the park entrance. The proposed project also includes the reconstruction and expansion of an existing boat launch to accommodate additional boat traffic at this location. The boat launch area currently consists of 10 parking stalls. The proposed boat launch area would be expanded to accommodate 45 vehicles. The existing boat launch is currently in need of repair, and the applicant sought to design the boat launch to meet Minnesota Department of Natural Resources (DNR) requirements. As a result, the boat launch does not require a MN DNR permit. The delineations were reviewed on site by city staff in October of 2013, and the boundary was approved by the City of Chanhassen on July 24, 2014. The delineation identified four wetland areas within the proposed project areas. The Joint Permit Application for wetland replacement dated July 22, 2014, was received and noticed on July 24, 2014. The proposed improvements will result in permanent impacts to two wetlands, shown in Figure 6 below, and described as follows: Wetland G: Wetland G is classified as a type 2, fresh (wet) meadow wetland according to Fish and Wildlife Service Circular 39. This wetland is not yet classified under the City's wetland inventory. This wetland would be eliminated as part of the proposed project. The proposed impact to this wetland is approximately 979 square feet. WETLAND BUFFERS The applicant has chosen to meet The Minnehaha Creek Watershed District (MCWD) Wetland Protection Rule. This rule is more stringent than the City's Wetland Protection Ordinance; therefore, the proposed plan brought forth by the applicant also meets the requirements of the City's Wetland Protection Ordinance by default. The MCWD requires that any project that activates the MCWD's Wetland Protection or Stormwater Rule, such as this one, provide a buffer `on that part of the wetland edge that is down - gradient from the activity of construction and around each wetland that will be disturbed' - MCWD Wetland Protection Rule, 5.(a). As a result, a buffer will be created for five wetlands associated with the project, according to the District's wetland assessment and buffer width requirements. The applicant then must list and explain why the option described in the application was chosen over these alternatives. The following alternatives were presented in the Joint Water Resource Application submitted by the applicant: Alternative road alignments were considered to avoid wetland impacts to the greatest extent practicable. Initial design of the road at the entrance to the park resulted in impacts to Wetland A. The design was changed to include a retaining wall in this location to completely avoid wetland impacts to this wetland. Road alignments were also designed to avoid impacts to Wetlands B, C, E, and F. Alternatives to impacts associated with the boat launch reconstruction included additional impacts to the wooded area north of the parking lot and completely realigning the road to the south. This was regarded as an impractical option, and would result in a loss of a large amount of woodland habitat, thus impacts to Wetland G were considered unavoidable. Wetland H is proposed to be impacted as a result of the trail relocation, just south and east of its current location. The existing trail currently bisects Wetland H. The proposed project will involve the removal of the existing trail and realigning the trail so that it skirts along the edge of Wetland H. Approximately 383 square feet of wetland area in Wetland H will be restored as a result of the trail removal. Credit is not being sought for this restoration activity; however, the applicant is asking that it be recognized as a minimization effort. Planning Commission Lake Minnewashta Regional Park Improvements Project Wetland Alteration Permit Planning Case #2014 -23 August 19, 2014 Page 10 of 17 Impact Minimization and Avoidance The Wetland Conservation Act requires that if avoidance is not an option, the unavoidable impacts are minimized to the greatest extent practicable. Efforts have been made by the applicant to minimize the proposed wetland impacts by restoration of wetland resulting in the realignment of the trail, as previously stated, as well as constructing the trail as close to grade as possible, to minimize impacts resulting from slopes. A retaining wall was also included in the final design, as previously discussed, to avoid impacts to Wetland A, and reduce the overall impacts of the proposed project. STORMWATER MANAGEMENT A series of infiltration basins and a stormwater pond are proposed within the proposed boat launch parking lot to provide water quality treatment for the additional .45 acres of impervious surface that is to be created as a result of the proposed project. The MCWD Stormwater management rule requires that phosphorous control and rate control be provided for the resulting net increase in impervious surface. Because the increase in impervious surface is almost solely due to the construction and expansion of the proposed boat launch, the stormwater treatment features that are to be installed are concentrated in this area (See Figures 7 and 8 below). These features will be designed to meet local and state water quality standards. The replacement plan proposes that .1 acres (.05 ac at a 2:1 ratio) for the proposed Lake Minnewashta Regional Park Improvements Project be purchased by the County, using wetland bank credits from wetland bank account #1375, located in the same Bank Service Area 7, and Major Watershed 19 (South Fork - Crow River). OTHER AGENCIES The applicant is responsible for obtaining any permits or approvals from the appropriate regulatory agencies and compliance with their Conditions of Approval. FINDINGS The Planning Commission shall recommend a Wetland Alteration Permit and the Council shall issue such Wetland Alteration Permit only if it finds that: a. The proposed project will not be detrimental to or endanger the public health, safety, comfort, convenience or general welfare of the neighborhood or the city. FINDING: The proposed wetland impacts that will occur with the Lake Minnewashta Regional Park Improvements Project have not been found to pose danger to public health, safety, comfort, convenience or general welfare. The goal of the proposed project is to improve the amenities of the park for residents and recreationalists. b. The proposed project will be consistent with the objectives of the City's Comprehensive Plan and the Zoning chapter of the City Code. FINDING: The proposal is consistent with the objectives of the City's Comprehensive Plan and City Code. It complies with all City, State and Federal requirements. The boat launch improvements, road improvements, and trail construction will improve safety and ease congestion within the park and where the park entrance intersects with Highway 41. c. The proposed project will be designed, constructed, operated and maintained so to be compatible in appearance with the existing or intended character of the general vicinity and will not change the essential character of that area. Project Description: Carver County Parks has received grant funding for proposed improvements to Lake Minnewashta Regional Park that incudes; road reshaping/paving (5657 linear feet), an access road to the dog park (15 87 linear feet), boat launch improvements, some trail improvements (500 linear feet realigned), and construction of an entrance turnaround. The purpose of this project is to improve the public amenities within the park as well as provide safer access along the road for the public. The project is within the Minnehaha Creek Watershed District (MCWD). The Riley- Purgatory Bluff Creek Watershed District (RPBCWD) has indicated the project is not within their boundaries. In total, the project will disturb 10.37 acres of land. The existing impervious surface is 6.04 acres and the proposed impervious is 6.49 acres for a net increase of 0.45 acres. This includes 500 linear feet of trail improvements, the reconstructed boat launch, reconstructed parking area for the boat launch, and entrance turnaround area. With the trail, new bituminous trail is being constructed as well as demarcation of a cross - country skiing trail. The road within the park will be resurfaced from gravel to bituminous and a bypass lane at the park entrance will be constructed. The 2011 wetland boundaries are shown on the project plans. Additional wetland was delineated by WSB in September 2013. A complete delineation report was submitted to the City of Chanhassen as the LGU for WCA on February 21, 2014. Wetlands and Buffers Wetlands have been avoided to the extent practical and the project anticipates 2191 sf (0.05 acres) of wetland impact. About 0.383 sf (0.009 acres) of trail will also be removed from a wetland. The attached wetland application addresses wetland sequencing. Wetland impacts are proposed to be mitigated by purchase of wetland credits, anticipated through the purchase of 0.1 acres from the Jeff Richards bank # 1375 in Carver County. The purchase agreement will be submitted under separate cover. The MCWD requires wetland buffers for projects that trigger the wetland or stormwater rule, as this project does. A buffer on public land, as is the case with this project, can be documented by written agreement with the District and the County. This is the County's preferred route. The buffer width is based on the District's wetland assessment. Stormwater Management As stated, this project involves paving approximately 1 -mile of the existing gravel entrance road from Hazeltine Boulevard into Lake Minnewashta Regional Park. Additionally, the existing gravel boat launch parking lots (Appendix D) will be removed. The southerly lot will be replaced with an expanded parking lot and new boat launch (see plan set in Appendix B). Existing conditions land use is park land. The increase in impervious is entirely due to the proposed boat launch parking lot; therefore BMPs have been focused in this location. Rate Control: MCWD requires that applicants demonstrate that their discharge rates have not increased from the pre - development for the 1 -year, 10 -year, and 100 -year critical storm events. There is no increase in impervious surfaces for the proposed entrance road and therefore no change in discharge rate. The existing culverts are proposed to be replaced in -kind. The existing and proposed discharge rates to Lake Minnewashta from the proposed boat launch parking lot are listed in Table 1. Wetland A Is located at the entrance to the park Initial design of the road included the road slope Impacting this wetland. However, the design has been changed to Include a retaining wall in this location to completely avoid the wetland impact Otherwetlands, including Wetland E, F, B, and C have also been completely avoided, Wetlands G and H include the only Impact on the project for a total of 2191 sf. Wetland G is impactsfrom the boat launch parking lot reconstruction. To avoid additional Impacts to the wooded area north of the parking lot or completely realigning the road on the south, Impacts to this wetland are unavoidable. Wetland H will be impacted from moving the trail in this location. Currently, the existing trail bisects the wetland. The project will remove this existing trail and move It to skirt along the side of the trail. Approximately 383 sf of wetland will be restored with the removal of the trail in this location. Credit is not being sought for this removal, but should be recognized with minimization efforts. There is an existing boat launch within the project that will be reconstructed to accommodate the additional boat traffic at this location. This boat launch design is in conformance with ©NR requirements and as such, does not require a DNR permit. Minimization. Both the CWA and the WCA require that all unavoidable impacts to aquatic resources be minimlted to the greatest extent practicable. A permit application for wetland impacts was submitted to the City as the LGU and to the US Corps of Engineers on July 22, 2014. While the plans have not changed, we discovered some additional WCA impact above the OHW of Lake Minnewashta associated with the boat launch and storm sewer outfall. This adds 806 sf of additional impact. This area is currently the boat launch area and consists of the sand and gravel area of the launch with some vegetation adjacent to the launch area. Wetland impacts will be mitigated through the purchase of wetland credits via the same wetland bank proposed.
