PROPOSED MOTION
"The City Council approves a Consultant Agreement with Kimley -Horn and Associates
in the amount of $ $265,610 for TH 101 Environmental Documentation and Preliminary
Design between Pioneer Trail (CSAH 14) and Flying Cloud Drive (CSAH 61) Project
No. 14 -08.
City Council approval requires a simple majority vote of the City Council present.
BACKGROUND
In 2007, an environmental scoping study was completed for TH 101 from Lyman Boulevard
to the Scott County line that evaluated several alignment options, safety improvements and
environmental review for potential improvements. The study was a partnership between
MnDOT, Carver County and the City of Chanhassen. Since this study, the section of TH 101
from Lyman Boulevard to Pioneer Trail has been reconstructed to four lanes, and the section
south of Flying Cloud Drive over the Minnesota River is currently under construction and
will be completed in 2015 to a four -lane design. The section of TH 101 from Pioneer Trail to
Flying Cloud Drive is the last section of TH 101 needing improvements south of TH 5. In
2009, MnDOT resurfaced this section of TH 101; however, this work did not address most of
the safety or capacity issues along the corridor.

grades /challenging topography, poor sight distances and blind intersections, limited right -of-
way, and possible historic and cultural resource impacts. The roadway has many blind

especially during inclement weather. As the city and the region develop, more traffic is

expected to use this corridor and the accident rate is only expected to increase. Numerous
accidents have occurred on this section of roadway over the past several years.

The City completed a Corridor Land Use and Utility Study this year along Flying Cloud
Drive to see if land use should be changed, gage level of interest in private development or
redevelopment and see if City services can be extended to this corridor economically. The
study indicated utilities can be extended to this corridor economically under the right market

conditions. TH 101 north of Flying Cloud Drive was identified as the main utility corridor to provide services
to this area. In order for properties along Flying Cloud Drive to develop to the highest and best use, TH 101
north of Flying Cloud Drive needs to be upgraded.
DISCUSSION
The objective of this project is to identify a "preferred build" alternative, gain local support for the project,
obtain environmental approval of the project, generate a staff - approved layout, and develop documentation of
right -of -way needs. Final design and construction administration work is not part of this contract. The
corridor can be officially mapped once this project is completed.
TH 101 is a roadway of regional significance with direct connections to the TH 101 Minnesota River
Crossing, which is currently undergoing expansion from two lanes to four lanes. TH 101 north of Pioneer
Trail is complete as a four -lane roadway. TH 101 is classified as a minor arterial; however, existing safety,
capacity, and continuity issues keep it from fulfilling its role in the regional roadway network. Its ability to
function as a minor arterial will improve as these remaining issues on the last segment of the corridor are
resolved.
A combination of existing demands, local development, and regional growth contribute to a long -term travel
demand that cannot be safely and efficiently served by the existing roadway. The opening of TH 212 through
Chanhassen in 2008 and the completion of the four -lane expansion of TH 101 from Lyman Boulevard to
Pioneer Trail this year are important steps in addressing the future traffic demands. Growth in Scott County
also is anticipated which will add demand on the TH 101 River Crossing to and from the city of Shakopee.
The character and condition of the existing roadway does not safely and efficiently serve existing and future
needs. The existing roadway has segments with very narrow shoulders and steep ditch slopes and
embankments. Many off -road hazards are protected by guardrails adjacent to the travel lane. Warning signs
inform drivers of sharp curves with 15 -30 miles per hour (mph) advisory speeds. Blind intersections and
substandard stopping sight distances are prevalent. Crash analysis performed as part of the Corridor Scoping
and Environmental Screening Study (2007 Scoping Study) identified crash and severity rates more than twice
the average for two -lane rural highways. The predominant crash type has been "run- off -the road ", a symptom
of the poor sight conditions, tight curves, and undulating terrain through the project area.
In order to help secure funding for reconstruction, environmental documentation and preliminary design work
should to be completed at this time. This work is necessary with or without federal funding. The City of
Chanhassen, Carver County and MnDOT again intend to partner to complete the environmental and
preliminary design work. The cost for this work will be split equally between the three agencies. MnDOT is
currently drafting the joint powers agreement however the agreement is not ready at this time but should be
ready in the next six weeks. Federal funding applications are due at the end of November. Project readiness
points are given to projects that are currently being studied or designed. Also some information for the study
will be used in the federal application if the City Council authorizes sending in an application.
Public involvement will be an important component of the project. One of the most significant steps of the
preliminary design study will be to "set the course" for the project with the public, including the completion
of a very thorough and thoughtful alternatives analysis. The public's support for making improvements will
be critical. Communication of the project's purpose and need is critical to moving the project forward. Of
equal importance is building trust from those impacted by proving that the design has been tailored to achieve
project objectives while being responsive to the environmental, property access and right -of -way issues
brought forward by the stakeholders. The project anticipates many on -site meetings with property owners and

at least two public open houses are planned for the project. A website will be updated on a regular basis with
study information, project schedule and contact information.
Utilities are planned to be extended to this area along with the future roadway improvements. The study will
identify a preferred utility alignment.
CONSULTANT CONTRACT COSTS AND FUNDING
Staff sent out three requests for proposals to consultants for this work. The partnering agencies decided to
send proposals to consultants that had worked in the area in the past on similar projects and were in good
standing with the agency partners. The three consultants who were sent a proposal were SRF Consultants,
SEH, Inc. and Kimley -Horn and Associates. SRF Consultants decided not to submit a proposal due to their
existing workload. Kimley -Horn and Associates and SEH, Inc. decided to partner and submit a joint
proposal. On October 2, 2014, the City received one proposal for the work.
The proposal cost submitted from Kimley -Horn and Associates /SEH is $265,610.
Representatives from MnDOT, Carver County and City of Chanhassen reviewed the proposal. Based on the
information submitted in the proposal, the agency partners recommend Kimley -Horn and Associates be
awarded the contract for this work.
In 2010, Kimley -Horn and Associates completed the environmental documentation and preliminary design
for the section of TH 101 from Lyman Boulevard to Pioneer Tail. That project was very similar to the work
planned for this project. For reference, the City received four proposals in 2010 for the environmental
documentation and preliminary design for the section of TH 101 from Lyman Boulevard to Pioneer Trail.
Proposals at that timed ranged from $224,858.00 to $354,703.44. Kimley -Horn and Associates' work on that
project was acceptable. Staff feels the cost Kimley -Horn and Associates submitted is acceptable based on the
2010 proposals. Kimley -Horn and Associates also completed the construction administration and inspection
for the TH 101 improvements from Lyman Boulevard to Pioneer Trail project. Their work on this project
was acceptable. SEH, Inc. completed the final design for the Flying Cloud Drive improvements for the TH
101 Minnesota River Crossing Improvements. Their work and background knowledge on that project will be
very helpful to complete the preliminary design.
Most of the project work is proposed to be completed by Kimley -Horn and Associates. Public management,
environmental worksheet writing, utility and traffic are planned to be completed mainly by Kimley -Horn and
Associates. SEH, Inc. will work primarily on preliminary design some traffic aspects of the project surveying
and drainage.
The City of Chanhassen will take the lead on the project. The City has budgeted for this work in the 2014
CIP (ST -032). The City's share of the study is proposed to be funded with Pavement Management funds.
Including funding 1/3 of the cost of the project, MnDOT will provide 1' contour survey drawings, take soil
borings and possible historic building impacts. The study includes only a high level review of cultural
resources review. No archeological work is part of the study. If reviewing agencies require a more in -depth
archeological study including on site investigation, this work will need to be contracted out separately.
The contract is a time and materials based work not -to- exceed amount. Hours will be billed separately for
each project area. As with all engineering contracts, the consultant must submit periodic invoices that staff
will review before processing. The consultant will be required to submit timesheets verifying the hours
worked on the project and expense sheets. Staff will review the invoices and expense sheets for accuracy and

conformance to the contract. If the joint powers agreement with the other agencies is not in place before 33%
of the project is completed, the City has the right to stop the project or void the contract.
SCHEDULE
The preliminary schedule for the project is attached to this background. The work is scheduled to be
completed in late 2015.

This project will reconstruct TH 101 from Pioneer Trail (CSAH 14) to Flying Cloud Drive (CSAH 61). This is the last section of TH 101 that
needs improvements from TH 5 into the City of Shakopee. The improvements are proposed to improve safety, mobility and to plan for future
growth in the region. The project is consistent with the 2007 TH 101 corridor scoping study. State, Federal and Carver County funds are
proposed to help pay for most of the improvements. The City contribution to the project is anticipated to help pay for some environmental work,
watermain improvements, corridor landscaping, trails and storm sewer improvements. The tentative schedule is to complete predesign and
environmental review in 2014. Right of way acquisition would take place in 2016 and construction would commence in 2018.
