Todd Gerhardt, City Manager FROM- Bob Generous, Senior Planner DATE- December 8, 2014 SUBJ Metes and Bounds Subdivision, 2631 Forest Avenue Planning Case #2014 -36 PROPOSED MOTION The Chanhassen City Council approves the resolution creating a two -lot metes and bounds subdivision of Lot 30 and Part of Lot 31, Minnewashta Park subject to the conditions of the staff report, and adopts the Findings of Fact and Decision " City Council approval requires a majority vote of City Council. EXECUTIVE SUMMARY The applicant is requesting metes and bounds subdivision approval to divide the property into two lots. City council may approve a metes and bounds subdivision of a lot into two lots inside the urban services area if both resulting lots meet the minimum requirements of the zoning ordinance and abut an existing public street, pursuant to Section 18 -37 (b) of the Chanhassen City Code. PROPOSAL SUMMARY The applicant is requesting a metes and bounds subdivision of a 2.57 -acre parcel into two (2) lots on property zoned Single - Family Residential (RSF) located at 2631 Forest Avenue. The applicant and property owners are Kenneth and Betty Lange. The area is single- family residential The applicant is not requesting to rezone the property and the provided grading plan is conceptual at this time BACKGROUND Mmnewashta Park was platted in July 1887. House constructed in 1975 November 5, 1990, the City received a 40 -foot access easement to access Herman Field Park. W f- fb� r ti6 r to mo - ji The proposed building is set at the western edge of Parcel B A driveway approximately 200 feet long will provide access to Forest Avenue (60 foot ROW, 22' +/- paved) The grading will direct water to sheet flow over the driveway for approximately 40 feet near Forest Avenue The driveway shows a grade of 4% and 10% Ten percent (10 %) is the maximum driveway grade allowed in the City Code. No part of the driveway may exceed 10% The grading plan shall show the connection of the proposed driveway to the street Todd Gerhardt Forest Avenue Metes & Bounds Subdivision December 8, 2014 Page 3 EASEMENTS The standard 10 -foot at front and 5 -foot drainage and utility easements shall be granted around the perimeter of the parcels The developer's engineer shall submit legal descriptions and exhibits to the city for recording. The owner of Parcel A must grant an easement for the water and sanitary service for Parcel B to run across Parcel A The city must grant an encroachment agreement for the water and sanitary service for Parcel B to run through the City's drainage and utility easement on Parcel B. GRADING: DRAINAGE The lot drains to the south and west into Lake Minnewashta through a Manage 2 shallow marsh located within Herman Park The drainage is conveyed through a swale that intersects the eastern third of the existing parcel and drains from north to south The proposed grading will continue the existing drainage pattern The developer must submit a soils report to the city indicating the soil conditions, permeability and slope If water is encountered, the lowest floor elevation of the proposed building must be three feet above the highest known groundwater elevation The existing topographic plan must show the first floor elevation of the nearby building at 6360 Forest Circle. The grading plan must show drainage arrows for proposed and existing water flow. Grading at the northwest corner of the proposed building shall be revised so that it is not directing water towards the structure The grading plan shall be revised to show the elevation at the corners of the proposed building pad. The grading north and west of the proposed building shall be revised so that no slope is steeper than 3 1 SITE GRADING: EROSION PREVENTION AND SEDIMENT CONTROL When a building permit application is submitted, an erosion control plan consistent with Section 19 -145 of city code will be required. SITE CONSTRAINTS Wetland Protection The City of Chanhassen Wetland Inventory and the Minnehaha Creek Watershed Wetland Inventory both indicate a wetland immediately adjacent to the subject property within Herman Todd Gerhardt Forest Avenue Metes & Bounds Subdivision December 8, 2014 Page 4 Park Given the existing topography and the mapped soil unit as well as the existing drainage patterns, there is some chance that the wetland extends onto the subject property The conceptual grading plan appears to keep all land - disturbing activities at a high enough elevation so as to make it unlikely that it would result in any wetland impacts if it does in fact extend onto the subject property Because of the nature of wooded ephemeral wetlands, it would be very difficult to determine the extent of the wetland with the current conditions As such, it will be required that before any site plan is approved, the applicant at that time will need to determine the wetland extent and design accordingly Bluff Protection There are steep slopes on the subject property with grades approaching 25% This does not meet the criteria for classification as a bluff but does merit caution during the design and construction of any future home The soils on much of the subject property are considered to be highly erodible These factors must be considered in the development of the site plan and erosion prevention and sediment control plan when the site plan review is applied for. Shoreland Management The property lies within the shoreland district for Lake Mmnewashta The proposed lot dimensions meet the requirements for the management classification. Floodplain Overlay This property does not lie with a floodplam. STORM WATER MANAGEMENT Article VII, Chapter 19 of City Code describes the required storm water management development standards. Section 19 -141 states that "these development standards shall be reflected in plans prepared by developers and /or project proposers in the design and layout of site plans, subdivisions and water management features " Given the wooded nature of the subject property and the space needed to construct a stormwater management feature, staff feels that it would be of equal benefit to forego the construction of a storm water management practice and spare the subject area from additional tree removal It is noteworthy that the aforementioned swale receives surface drainage from Forest Avenue and some of Orchard Lane There may be potential in the future for the city to install a surface water management BMP to capture and treat this watershed Storm Water Utility Connection Charges Section 4 -30 of code sets out the fees associated with surface water management A water quality and water quantity fee are collected with a subdivision. The City Council conducted a public hearing on the proposed subdivision preceded by published and mailed notice The City Council heard testimony from all interested persons wishing to speak and now makes the following FINDINGS OF FACT 1 The property is currently zoned Single- Family Residential District, RSF. 2. The property is guided in the Land Use Plan for Residential Low Density uses 3 The legal description of the property is Lot 30 and part of Lot 31, Minnewashta Park, Carver County, Minnesota 4 The Subdivision Ordinance directs the City Council to consider seven possible adverse affects of the proposed subdivision The seven (7) affects and our findings regarding them are. a The proposed subdivision is consistent with and complies with the zoning ordinance, b.
