PROPOSED MOTION
"The Chanhassen City Council approves a resolution modifying the stormwater
fees for Chanhassen Retail Fourth Addition "
City Council approval requires a majority vote of city council.
BACKGROUND
On November 10, 2014 the City Council approved the final plat for Chanhassen
Retail Fourth Addition. Because there were no public improvements, the approval of
the plat included a resolution for the conditions of approval The applicant
recalculated the storm water construction fees. Modifications to the fees resolution
require council approval

website cost based upon using a different pre - treatment technology The revised opinion of

for the 2014 road project and arrived at a cost of $25,200 (see attached staff estimate)

To resolve the disparity in cost estimates, it was agreed to split the difference between the two.
To this end, the recommended revised cash in lieu of constructing the stormwater practice should
be $18,500 rather than the $25,000 shown in the original resolution
RECOMMENDATION
The Chanhassen City Council approve the attached resolution modifying the stormwater fees for
Chanhassen Retail Fourth Addition

CHANHASSEN RETAIL FOURTH ADDITION
WHEREAS, on November 10, 2014, the City Council approved Resolution #2014 -74
approving the final plat for Chanhassen Retail Fourth Addition creating one lot and one outlot;
and
WHEREAS, Condition #2 of Resolution #2014 -74 required the applicant to submit
$25,000 in lieu of constructing a stormwater facility; and
WHEREAS, the $25,000 amount was based upon the consulting engineer's opinion of
cost to construct a stormwater facility, and
WHEREAS, the estimate of the cost to construct the stonnwater facility has been
modified based on using an different pre- treatment technology; and
WHEREAS, the recommended revised cash requirement in lieu of constructing a
stormwater facility is $18,500.
NOW, THEREFORE, BE IT RESOLVED that the City Council approves the
following modification to Condition #2 of Resolution 2014 -74 as follows-
2 The applicant shall submit $18,500 in lieu of constructing stormwater best management
practices to be used exclusively for the improvement of the water quality downstream of the
site.

A RESOLUTION APPROVING A FINAL PLAT
CREATING CHANHASSEN RETAIL FOURTH ADDITION
WHEREAS, Willow -MN, LLC, has requested final plat approval for Chanhassen Retail
Fourth Addition creating one lot and one outlot and
WHEREAS, the proposed subdivision complies with all requirements of the Chanhassen
City Code, and
WHEREAS, the Chanhassen Planning Commission held a public hearing on September
16, 2014 and found the plan consistent with the Chanhassen Comprehensive Plan and Zoning
ordinance and recommended approval of the subdivision
NOW, THEREFORE, BE IT RESOLVED that the City Council approve the plat of
Chanhassen Retail Fourth Addition subject to the following conditions
Engineering
Before the final plat is recorded the Surface Water Management fees, Park Dedication fees,
and GIS fees, $45 00, must be paid as well as any recording fees not collected with the final
plat application
2 The applicant shall submit $25,000 in lieu of constructing stormwater best management
practices This shall be due at time of final plat to be put into an account to be used
exclusively for the improvement of water quality downstream of the site
The Storm Water Utility fee for the 2014 rate is $18,525 10 and shall be due at final plat
4 The final plat must dedicate drainage and utility easements around the perimeter of the
property in accordance with City Code Section 18 -76
Park and Trail
Full park fees shall be collected as a condition of approval for Shops at Chanhassen. The park
fees in full at the rate in force upon final plat submission (2014 rate $7,562 60)
