FEBRUARY 9, 2015
Mayor Laufenburger called the meeting to order at 7:00 p.m. The meeting was opened
with the Pledge to the Flag.

CONSENT AGENDA: Councilwoman Tjornhom moved, Councilman McDonald
seconded to approve the following consent agenda items pursuant to the City Manager’s
recommendations:
1. Approve City Council Minutes dated January 26, 2015
2. Receive Planning Commission Minutes dated January 20, 2015
3. Approval of Two-Year Lifeguard Contract for Lake Ann Beach, Minnetonka Public
Schools.
Resolution #2015-05:
4. 2015 Street Rehabilitation project (Carver Beach Area): Approve
Plans & Specifications; Order Ad for Bids.

All voted in favor and the motion carried unanimously with a vote of 5 to 0.
VISITOR PRESENTATIONS.
None.
2015 STREET REHABILITATION PROJECT (KERBER BOULEVARD): PUBLIC
HEARING; CONSIDER APPROVAL OF RESOLUTION ORDERING PLANS AND
SPECIFICATIONS.
Paul Oehme presented the staff report on this item. Councilman McDonald asked for
clarification of how assessments are determined. Commissioner Campion asked for a
breakdown of the costs driven by trail repairs versus street repairs. Councilwoman Ryan asked
for clarification on the Municipal State Aid classification, replacement of manholes, and how
pedestrian traffic will be re-routed during trail construction. Mayor Laufenburger clarified that
the CDA property was being assessed for the building, not individual renters before opening the
public hearing. Karen Engberg, 910 Saddlebrook Curve asked if drainage issues with the trail
will be addressed and requested that the City not use the company that took off the top layer of
roadway. Mayor Laufenburger closed the public hearing. Councilman McDonald
acknowledged that council had received an email submitted by Gina Stump. Mayor
Laufenburger asked about staff and the contractor communicating with affected residents.
Councilwoman Ryan asked that speeds be monitored on Kerber Boulevard after construction is
completed.
Resolution #2015-09: Councilwoman Tjornhom moved, Councilwoman Ryan seconded
that the Chanhassen City Council orders the preparation of plans and specifications for the

Project No. 15-02. All voted in favor and the motion carried unanimously with a vote of 5
to 0.
9015 LAKE RILEY BOULEVARD: REQUEST FOR VARIANCE TO EXCEED THE
IMPERVIOUS SURFACE LIMITATION AND THE SHORELAND SETBACK
LIMITATION TO CONSTRUCT A PATIO; APPLICANT/OWNER: ROSEMARY
KELLY.
Bob Generous presented the staff report and Planning Commission update on this item. The
applicant, Rosemary Kelly explained the reasons for requesting this variance is to make the patio
handicap accessible. Mayor Laufenburger opened up the meeting for public comment. No one
spoke. After questions and comments from council members the following motion was made.
Councilwoman Ryan moved, Councilman McDonald seconded that the Chanhassen City
Council approves a 3.5 percent hard surface coverage variance to permit 28.5 percent hard

cover to permit the expansion of an existing patio on the property and denies the additional
shoreland setback variance subject to the following conditions and adopts the Findings of
Fact and Decision:
1. The applicant must apply for and receive the appropriate permit required from the City.
This permit will include a revised survey that displays the location of the patio addition, a
completed hard surface coverage calculation worksheet and any other plan required for
the permit.
2. Landscape materials must be installed to absorb additional runoff on the property. A
landscape plan shall be submitted in conjunction with the permit application.
All voted in favor and the motion carried unanimously with a vote of 5 to 0.
COUNCIL PRESENTATIONS.
Councilwoman Tjornhom commented on a fabulous February

Festival fishing contest that was held on Saturday, February 7 at Lake Ann. Mayor
Laufenburger commented on attending Eastern Carver County School District 112’s jazz festival
that was held on Saturday, reminded people of the Daddy Daughter Dance being held on Friday
and invited the public to attend the Mayor is in City Hall on Saturday morning from 9:00 to
11:30.
ADMINISTRATIVE PRESENTATIONS.
Todd Gerhardt informed council members that
Paul Oehme has been appointed Vice President of the Technical Advisory Commission for Met
Council and that Kate Aanenson has been appointed President of the Sensible Land Use
Coalition.
CORRESPONDENCE DISCUSSION.
Mayor Laufenburger asked Councilman McDonald,
who sits as Chairman of Southwest Transit Commission, to comment on their 2015 CEO goals.
Councilman Campion moved, Councilwoman Tjornhom seconded to adjourn the meeting.
All voted in favor and the motion carried unanimously with a vote of 5 to 0. The City
Council meeting was adjourned at 8:10 p.m.
