In approximately 1910, the easement for a road was plotted Since then and now, 2015, no road has been built The easement is surrounded by property that has developed homes with existing utilities, and there are no utilities in the easement area Since there has not been any need for a road in 100 years, and the area has developed homes, it is felt that there will not be need for it in the future This area is a hillside which the easement runs across Our property is the sloped section immediately above the easement The hill continues to descend below the easement area, so building a road would have been challenging The easement is vacated along the property adjourning ours, so is a dead end. Vacating the easement right of way area would align our property with the neighboring lot We are requesting vacation of the easement to prevent development of a road. It will also provide additional privacy and some additional space to conduct erosion control if needed in the future We respectfully request your approval of vacating this easement.
