On March 23, the City Council reviewed a report concerning the proposed City of
Park&Recreation Chanhassen 2015 watercraft inspection program. Upon conclusion of discussion that

Carver County and the Riley Purgatory Bluff Creek Watershed District(RPBCWD)
Recreation Center to match an additional contribution from the city. Additionally, the council asked that

• Can you help us understand what process was used to designate how the AIS state aid
dollars are being invested?
The county took into consideration several factors which included past service to area
lakes, potential designated lakes of Chanhassen, lakes within Carver Park Reserve, new
service areas on the MN River, enhanced service at Lake Waconia including
decontamination due to the presence of zebra mussels,rapid response, signage program,
electronic devices, and software for staff management AIS service options were presented
to the County Park Commission and members of the public The Park Commission made a
recommendation to the county board The board held workshop sessions and regular
meetings to consider the 2015 AIS program and provided staff direction to administer
• Is there a formula designating which lakes in the county are scheduled for watercraft
inspections?
No formula, but it is largely based on lakes that received service in the past. To that end,
when the program was developed, it was discussed that the local stakeholders in the
program should continue to fund AIS at previous levels and the county program aid funds
for AIS would be used to supplement and not supplant local funding sources Carver
County did reduce the amount of county tax-supported levy funds to the program My take
on this is that this was justifiable as the county has considerably more invested in staff
time to develop, administer,hire and manage staff in a county-wide coordinated program
for the 2015 AIS program
• Why are Lake Ann, Lake Susan and Lotus Lake not being scheduled for inspection hours
paid for by the county?
County levy funds are not used for most lakes in the county,just like Lake Ann, Lake
Susan and Lotus Lake County levy funds are being used for inspections at Minnewashta
and Bavaria which have lake accesses that are owned by Carver County The Board has
stated that these are priorities given the county owns them County Water Management
funds (WMO) are used to support lakes that are outside of the other water management
organization areas (Riley Purgatory, Minnehaha [CWD]) and therefore are not eligible to
be used for Lake Ann, Lake Susan or Lotus Lake.
• Will the county provide"appropriate rapid response" services to Chanhassen lakes in the
event zebra mussels are discovered?
Yes, keep in mind that rapid response can be in several forms For example, since we
could not find a specific colony of zebra mussels in Lake Wacoma, a treatment area could
not be defined. The rapid response here was to notify the DNR and they implemented their
protocol to investigate and follow up with notification of infestation At Christmas Lake,
they were able to identify a specific area of treatment next to the shore and a containment
area was deployed. We are in contact with a contractor to deploy a containment curtain,

would deploy if it makes sense to do so, and also begin communications and coordination
efforts with other agencies.
The City of Chanhassen applies and promotes a comprehensive Aquatic Invasive Species (AIS)
Policy This policy seeks to prevent and control the spread of AIS within the community and
across the state and region
VOLUNTARY WATERCRAFT INSPECTIONS PROGRAM
Trained inspectors will be employed to help educate watercraft users about AIS and inspect
watercraft at city-owned public water accesses. Inspection hours will be distributed over peak
use times
BEST MANAGEMENT PRACTICES FOR WATER ACCESS
Minnesota Department of Natural Resources' "Best Management Practices for Water Accesses"
has been implemented at city-owned public water accesses
GRANTS AND COLLABORATION WITH OTHER PROJECT PARTNERS
The city and county, with support from local watershed districts and lake associations/alliances,
have taken the lead on one of the state's most comprehensive watercraft inspection programs
As appropriate, these partners are seeking grants to assist with these efforts.
PUBLIC AWARENESS AND EDUCATION ON AIS
All project partners provide and publish extensive information about the importance of
protecting against the spread of aquatic invasive species and provide links to the DNR website
for information regarding DNR contacts, news, programs and other information.
RECOMMENDATION
It is recommended that the city council approve the 2015 Specialized Services Agreement with
Carver County for Watercraft Inspectors at Lake Ann, Lake Susan and Lotus Lake in an amount
not to exceed $56,099.70, for a maximum total number of watercraft inspection hours not to
exceed 3,735 hours

WATERCRAFT INSPECTOR AGREEMENT
AGREEMENT entered into as of , 2015 by and between the CITY OF
CHANHASSEN, a Minnesota municipal corporation ("City"), and COUNTY OF CARVER, a body
corporate and politic under the laws of Minnesota("County").
NOW, THEREFORE, in consideration of their mutual covenants and obligations, the City and
County agree as follows.
I. COUNTY SERVICES
County shall provide watercraft inspectors at selected public accesses during the 2015 boating
season. The scheduling of these watercraft inspectors will be done by the County, at times and locations
specified by the City The purpose of this Agreement is to assist the City in preventing the introduction
of new Aquatic Invasive Species (hereinafter called "AIS") into Lake Ann, Lake Susan and Lotus Lake
through AIS education and inspections. The primary contact for the County is Martin Walsh and Todd
Hoffman is the primary contact for the City.
II. SPECIALIZED PROFESSIONAL AGREEMENT SPECIFICATIONS
1 This Agreement shall commence upon its execution by both parties and continue through
October 31, 2015 The total amount of compensation to be paid to the County shall not exceed
$56,099 70.
2 Inspections will be conducted at the following public access points. Lake Ann, Lake
Susan and Lotus Lake in accordance with the schedule attached as Attachment One
3 Inspectors at Lake Ann and Lake Susan shall be assigned by the County on. Fridays,
Saturdays, Sundays and holidays from (6.00 a.m. to 8.00 p.m) May 23 to September 7, 2015; and at
Lotus Lake from May 9 to September 7 (6 a m to 8 00 p m ), September 8 to 30 (6.30 a.m. to
7 30 p m ), October 1 to 15 (7.00 a m to 7.00 p m ), and October 16 to 31, 2015 (7.30 a m to
6.30 p.m.).
4 Inspections outside of the foregoing hours shall be conducted by the County only with the
mutual consent and agreement of the City and the County The maximum total number of watercraft
inspection hours for these days from May 9, 2015 through October 31, 2015 is three thousand seven
hundred and thirty-five (3,735)
5. The County will provide all necessary supervision to assure that the County's employees
satisfactorily perform their duties under this Agreement.
6. City will provide to Carver County no less than 10 qualified applicants for the position of
AIS Inspector
7 The County will on board applicants as employee inspectors, be responsible for training,
scheduling, and payroll during the term of this agreement. The County will provide inspector service as
long as it has inspector staffing or to the term of this agreement, whichever comes first.

8 Watercraft inspectors placed by the County shall perform in accordance with the
approved position description attached in Appendix A. Responsibilities include' (a)perform public
education and watercraft inspection duties, (b) provide timely and accurate paperwork and
communication to the City, and (c) follow watercraft inspection policies, responsibilities and procedures
as established by the City The City will reimburse the County for inspection at the rate of Fifteen
Dollars and 2/100 ($15.02) per hour up to a total not to exceed $56,099.70.
9 The County will provide reports showing actual time spent by time, day and location.
10 The County will coordinate MnDNR training sessions for the inspectors to be certified as
level I or level II inspectors
11 The County shall act in all respects as an independent County under this Agreement and
will be solely responsible for performance of services required hereunder, as well as the means and
manner of performance thereof Nothing herein authorizes the County to act as an agent or
representative of the City for any purpose.
12. Any amendment to this Agreement must be in writing and executed by both the County
and the City.
III. INDEMNIFICATION
Each party is responsible for its own acts and omissions and the results thereof to the extent
authorized by law Minnesota Statutes Chapter 466 and other applicable law govern the parties'
liability. To the full extent permitted by law, this Agreement is intended to be and shall be construed as
a"cooperative activity" and it is the intent of the parties that they shall be deemed a"single
governmental unit" for the purposes of liability, all as set forth in Minnesota Statutes § 471 59, Subd 1 a
(a), provided further that for purposes of that statute, each party to this Agreement expressly declines
responsibility for the acts or omissions of the other party In addition to the foregoing, nothing herein
shall be construed to waive or limit any immunity from, or limitation on, liability available to either
party, whether set forth in Minnesota Statutes, Chapter 466 or otherwise.
IV. PAYMENT FOR SERVICES
1. Payments to the County will be paid as services are performed and will be paid within
thirty-five (35) days of receipt of the County's invoice, which shall be submitted no more than monthly.
2. All other expenses incurred by the County in completing the work required under this
Agreement will be the County's responsibility.
V. TERMINATION OF AGREEMENT
This Agreement may be terminated at any time by either party for any reason upon seven (7)
days' written notice In the event of termination, the County is entitled to compensation based on the
number of hours worked up to the effective date of termination

VI. NOTICE
1 Any notice, request, demand or other communication required or permitted under the
terms of this Agreement shall be deemed to be properly given when deposited in the United States
Postal Service, postage prepaid, and addressed to the agent of each party as specified herein
2. However, when this Agreement requires immediate notice, such notice shall be
accomplished by telephone to the designated agent of the parties or by facsimile to the numbers listed
herein

Inspections
The 2015 City of Chanhassen Watercraft Inspection Program will include inspections
at Lake Ann, Lake Susan and Lotus Lake Inbound and outbound watercraft inspec-
tions will be conducted by Minnesota Department of Natural Resources Trained Lev-
el I Watercraft Inspectors.The inspectors will be employed by Carver County through
a joint services agreement. Inspectors will be on duty at city-owned public water ac-
cesses on variable schedules from May through October.Inspectors will be on duty at
Lake Ann and Lake Susan, Fridays through Sundays and holidays;and at Lotus Lake
seven days a week. The Riley Purgatory Bluff Creek Watershed District (RPBCWD),
Lotus Lake Conservation Alliance LLCA,Minnesota Department of Natural Resources
(DNR)and the City of Chanhassen provide funding for the city's inspection program.
Lake Riley and Lake Minnewashta also feature watercraft inspections provided by
the City of Eden Prairie and Carver County

This letter serves to reiterate the Lotus Lake Conservation Alliance's commitment to financially support the 2015
Carver County AIS Prevention Program We are very pleased that Chanhassen and Carver County will be joining
forces to help protect the lakes Partnerships like this one will lead to a more efficient AIS program, and with new
funding from the State, as well as ongoing funding from Carver County, Carver County WMO, Minnehaha Creek
Watershed District, Riley Purgatory Bluff Creek Watershed District, the City of Chanhassen and the LLCA, the
program has a very solid financial base
As you are aware, arrangements have not yet been finalized between Chanhassen and Carver County regarding
the 2015 AIS Plan Chanhassen City Council has not yet discussed the plan, and the Carver County Commissioners
have not reached any conclusions regarding plan specifics
The LLCA Board is hopeful that as the AIS plans are finalized, Carver County will include the Chanhassen lakes in
the prioritization process that determines how many inspection hours will be provided at each lake We believe
this would be a more equitable scenario than the current proposal in which Chanhassen receives only those hours
it pays for We would like to see the Chanhassen lakes prioritized along with the other Carver County lakes, and
the shortfall hours funded by the City, RPBCWD and LLCA This is currently being done at Lake Minnewashta and
other Carver County lakes, where the County provides some of the hours, and other sources also help with
funding
The portion of the AIS program funded by the LLCA has increased steadily over the years— last year we spent
approximately $15,000 on inspections, and this year we are currently slated to provide $18,100 As a newly
formed non-profit organization, this is a significant challenge for us, but one that we feel is critically important If
the County is unable to add the Chanhassen lakes into the prioritization process, an alternative scenario would be
for the County to share some of the State funding with Chanhassen to help fund inspections at the Chanhassen
lakes If neither of these scenarios can be worked out, the LLCA will ask both Chanhassen and the RPBCWD for
help with the $18,100 If none of these options are workable, then the LLCA will provide the $18,100 in full, as has
been discussed
