The� soil has a historic epipedon which U,�wv.-.ci chanha�s�n.mn.u� is indicative of a hydric soil- a soil that develops under satt�rated conditioias. In addition, bulrush and sedges-obligate wetland plants -���ere observed in abundance throughout tl�e area. Given that piezometer#5 showed consistently elevated water tables, if that ground water elevation remains , consistent moving east of piezometer#5, it is probable that the depth to ground water would be within the i root growth zone. However, the readings of piezometer#6 bring into doubt how fa��that near-surface water extends. In any event, furtl�er investigation in this ai•ea would be needed before any excavation or fill could occur. There is one additional area that could be impacted by the proposed excavation and could potentially be wetland. (Note, tlrer•e are otlter areus fu�ther soa{th on the pf�operty that ar•e eitlief•kfzolvn to be�vetland or preser7t with conspicuous signatu��es thczt would warrant fi.�r•ther im�estigatio�z befor�e land disturbirtg activities tivould be ullowecl.) This area is just south and west of piezometer#1 at the toe of the slope. It has been saturated at the surface during every site visit and was inundated on May 26 and May 27. There was also secondaty indicato►•s of hydrology that were observed including surface soil. While it would be possible to excavate without directly impacting this area, further i�ivestigation would be prudent. Based upon my observations, no excavation should be allowed south of the pipeline, in the vicinity of piezometers#4, #5 and #6 until a qualified wetland professional performs a wetland determination and delineation. Excavation could occur nortl� of the pipeline provided the limits of grading remains east of piezometer#] or a wetland determination and delineation, if needed, is performed in the area west of piezometer#1. This review was only concerned with the areas potentially impacted by the proposed ' grading IUP and is in no way intended to be construed as an exhaustive review of the entire subject property. Planning Commission 8610 Galpin Boulevard IUP —Planning Case 2015-12 June 2, 2015 Page 2 of 4 APPLICABLE REGULATIONS Chapter 7, Article III, Excavating, Mining, Filling and Grading Chapter 20, Article IV, Division 5, Intei•im Use Pennits BACKGROUND On September 11, 1995, the City approved Interim Use Pennit#95-3 foi•the placement of 36,000 cubic yards of fi11 material on the site. In 1957, the Holaseks,Betty and Earl, founded the nurseiy and �-eenhouse on the property which operated until the end of 2014. ANALYSIS Chadwick Group, Inc. has submitted an application to eXcavate up to 52,478 cubic yards on the property located at 8610 Galpin Boulevard. Historically the site has been used as a greenhouse operation. This operation has since ceased and the site will likely be redeveloped in the near future. In anticipation of this the applicant has identified areas on the site that contain soils that are unsuitable for building pads, parking and other site development amenities. These soils are �� proposed to be excavated. The applicant prefers to reinove the eXcavated material from the site. �I In the event that an off-site location is not found for the material the applicant has identified two stockpile areas. Two areas are proposed to be excavated, each to a depth of approximately 10 feet. The northern excavation consists of approximately 25,300 cubic yai•ds of cut; approximately 27,200 cubic yards of cut is expected from the southern excavation. Two stockpile areas are identified in the northwest corner of the propel-ty. The stockpiles will contain material suitable to inake the appropriate soils corrections on the site. The larger stockpile in the northwest corner would be about 30 feet high within a 340-foot by 340-foot area. A second stockpile to the east would be about 20 feet high within a 200-foot by 350-foot area. There are currently buildings within the proposed stockpile areas. A deinolition permit has been issued to relnove all of the buildings fi•om the site. An underground pipeline bisects the property and some of the proposed earthwork is in close proximity to the pipeline. The applicant confirmed that the pipeline company has an easement over this utility. Prior to grading within the pipeline easement the applicant must provide the pipeline coinpany a copy of the grading plan and obtain any necessary pennits. Access to the site for the grading operation will be from the existing driveway at Lyman Boulevard. Before grading operations cormnence the applicant must provide the Engineering Department with the proposed haul route. Any changes to the haul route must be communicated as needed throughout the grading operation. The 2005 borings revealed several areas with peat layers as deep as 24 feet. In some cases, water was observed within the , borings but no time was allowed to observe the static water elevation. Aerial photographs were '�� reviewed for the area back to 1937. In several of these photographs the area presents with signatures indicative of wetland conditions. Because of this data, it is not possible to conclude that wetland does not exist on site. '� Observation of three parameters is i-equired in ordei•for an area to be classified as a wetland: hydric soils, a don�inance of hydr•ophilic vegetation under"no1•mal conditions" and hydrology. Based upon the U.S. Army Coips of Engineers Wetland Delineation Manual (Corps Manual), soils and vegetation appear to be met. However, there is some question as to whether hydrology would be met. Staff inet with the applicant and it was decided that piezometei•s shall be installed by the applicant in the questionable areas and obseived by city staff for a reasonable tiine to determine if hydrology is present as defined in the Corps Manual. If the area is found to have hydrology, a delineation of the wetland areas will be required and any activities must be in compliance with the MN Wetland Conservation Act and the Federal Clean Water Act. If there is an absence of adequate hydrology then the excavation can proceed as planned. The Wetland Conservation Act does allow for excavation in Type l, 2 and 6 wetlands as long as the excavation does not convert the area to deep water habitat or other non-wetland cover type. However, the applicant would not be able to fill in the excavated areas at a later date without that being considered a wetland impact. A security in the amount of$1,000.00 shall be provided for erosion control, vegetation and site stabilization. 6. The interun use pennit shall terminate on November l, 2016. 7. This soil is unsuitable for building purposes. The material does have a use in soil blends particularly the high clay content soils found in the area. The idea is to put to good use,that which Mother Nature created, and make for better gardens in the area. By undertaking this operation at this time, it allows for an orderly usage of the material. If left until the development stage, it will have to be moved in a hurry and will likely be in the way. Each of those factors are a detriment to site development. Wetlands—there is a marsh at the far south west corner of the site. This is nowhere near the areas that will be disturbed. There is a hill separating the area of operations and the marsh. Runoff—The peat deposit is located in low areas on the farm. The natural drainage pattern is in to this area. Removing soil will further lower the site. It is not expected that there will be detrimental erosion, (as water runs down hill). Normal rains would drain into the site, not off of or away from the site. Neighborhood Impact—The site is bounded by a railroad, and industrial districts both in Chanhassen and Chaska. It is located on Lyman Blvd. CR 18 and the entrance is signalized making for an excellent, safe entrance and exit for this operation and future uses of the site. The land is graded for office industrial uses and is currently zoned A-2, Ag Estate. Hours of Operation—While many of the neighboring uses may have 24 hour operations, it is expected this would be a 7am to 7pm operation. Conclusion: We would like to get started just as soon as possible so we could get the good soil to folks this year. It will be beneficial to the site, reducing future costs and allowing greater site utilization.
