City Council approval requires a simple majority vote of the City Council present. Staff has received a letter from David Hempel of Westwood Professional Services stating that the utility improvements have been constructed in accordance with the approved plans and specifications. Staff has performed a walk - through inspection and finds the completed improvements acceptable for perpetual maintenance and ownership contingent upon receipt of a two -year maintenance bond. Professional Engineering Services including the design and observation of public improvements for Southwest Village have been provided by Westwood Professional Services. The public improvements which consisted of sanitary sewer; water main and storm sewer, were constructed in accordance with project construction documents approved by the City of Chanhassen. Based on our observations, it is our opinion that all utility construction is in accordance with the approved plans and specifications. Westwood Professional Services requests the city accept the public improvements for city ownership and that the financial surety be reduced or released per the conditions of the Development Agreement.
