PROPOSED MOTION
"The City Council approves a resolution accepting the public utilities in
Southwest Village 2nd Addition for perpetual maintenance and ownership."
City Council approval requires a simple majority vote of the City Council
present.
Staff has received a letter from David Hempel of Westwood Professional Services
stating that the utility improvements have been constructed in accordance with the
approved plans and specifications. Staff has performed a walk - through inspection
and finds the completed improvements acceptable for perpetual maintenance and
ownership contingent upon receipt of a two -year maintenance bond.

On behalf of Ryland Homes, we are submitting the as build items required by the city for final
acceptance of the public improvements and release of the surety for Southwest Village.
Professional Engineering Services including the design and observation of public improvements for
Southwest Village have been provided by Westwood Professional Services. The public
improvements which consisted of sanitary sewer; water main and storm sewer, were constructed in
accordance with project construction documents approved by the City of Chanhassen. Based on our
observations, it is our opinion that all utility construction is in accordance with the approved plans
and specifications.
Westwood Professional Services requests the city accept the public improvements for city ownership
and that the financial surety be reduced or released per the conditions of the Development
Agreement.

IMPROVEMENTS IN SOUTHWEST VILLAGE 2ND ADDITION
PROJECT NO. 13-13
WHEREAS, the City has received a letter from David Hempel of Westwood Professional
Services indicating the above - referenced utility improvements have been completed in
conformance with the approved plans and specifications and all testing has been successfully
completed; and
WHEREAS, staff has performed a walk - through inspection and finds the improvements
acceptable for perpetual maintenance and ownership; and
NOW, THEREFORE, BE IT RESOLVED that the Chanhassen City Council hereby
accepts the public utility improvements in Southwest Village 2 "d Addition, Project No. 13 -13, for
perpetual maintenance and ownership contingent upon receipt of a two -year maintenance bond.
Passed and adopted by the Chanhassen City Council this 9`" day of November, 2015.
