City Council approval requires a simple majority vote of the City Council present. BACKGROUND August 11, 2014: At the Council work session staff reviewed with Council the proposed 2015 Street Improvements in the Carver Beach area. November 10, 2014: Notictes for the Open House were sent out. Notices to residents that own more than one property included a letter notifying the residents that they would have more than one property that would be subject to the assessment. April 27, 2015: City Council adopted the assessment roll for the improvements. October 26, 2015: Staff contacted Carver County taxpayer services to determine if any of the property owners requested to combine assessed properties under one Property Identification (PID) _ Chanhassen is a Community for Life - Providing for Today and Planning for Tomorrow City Project 15 -01 Assessment Abatements November 23, 2015 Page 2 PROJECT SUMMARY During the summer of 2015 approximately 4.3 miles of streets in the Carver Beach neighborhood were rehabilitated, as shown in Figure 1. Figure 1: Carver Beach Project Area Properties with driveway access to any street within the project was included in the assessment roll. After consulting with the Planning Department, vacant lots of record within the project area that could be improved to include a single family residence were also included in the assessment roll. The final assessment amount is $2,596.96/unit. The April 27, 2015 assessment hearing memo included the history of the Carver Beach plan and analysis of vacant properties. The Carver Beach area is unique in that the area was platted as 20 foot wide by 100 foot long lots in 1927. As a result there are vacant parcels within the area that are non - conforming lots of record. City Ordinance permits development of these lots subject to zoning regulations. The vacant parcels that could potentially development are proposed to be assessed. Affected property owners were informed of this in with the notification for the November, 2014 open house and asked to contact staff with any questions. After the November, 2014 open house engineering consulted the planning staff regarding the vacant properties that were proposed to be assessed with the project, referencing City Code Section 20 -73: Sec. 20 -73. - Nonconforming lots of record. (a) No variance shall be required to construct a detached single - family dwelling on a nonconforming lot of record, excluding platted outlots, provided that it fronts on a public street or approved private street and provided that the structure meets the minimum requirements of this chapter. (b) Except as otherwise specifically provided for detached single - family dwellings, there shall be no expansion, intensification, replacement or structural changes of a structure on a nonconforming lot. (c) If a nonconforming lot or parcel is, or at any time since June 25, 2012, has been held in common ownership with all or part of an adjoining or abutting parcel or lot, then such nonconforming lot or parcel and such adjoining or abutting parcel or lot shall be deemed one lot. If in a group of two or more adjoining or abutting lots or parcels owned or controlled by the same person, any single lot or parcel does not meet 75 percent of the full minimum depth, width, and area requirements of this chapter, such single lot or parcel shall not be considered as a separate lot or parcel able to be conveyed or developed under this chapter. No. 543, § 1, 6- 25 -12) City Project 15 -01 Assessment Abatements November 23, 2015 Page 4 The following property owners have expressed an interest to combine tax PIDs and request that the corresponding assessment be abated. Shoberg properties, 834 Lone Eagle Drive Two units of benefit were assigned: PID 251601780 (which contains the home) and PID 251601730 is used as the front yard to the home. The property owner has submitted the required documentation to Carver County to combine the properties under one PID, therefore staff recommends that the council abate the assessment for PID 251601730. 2. Tillotsen properties, 6690 Deerwood Drive Two units of benefit were identified: PID 251600290 is vacant and bisects PID 251600450, which contains the home. The property owner has submitted the necessary documentation to the County to combine the parcels under one PID. On October 29, 2015, Carver County taxpayer services notified staff that the taxes on PID 251600290 had not been paid; taxes must be paid in full in order to combine properties under one PID. Staff left a voice mail message for the property owner relaying this message. Staff recommends abating the assessment for PID 251600290. If Council approves the assessment abatements the total assessments would be decreased by $5,193.92. It is proposed the revolving assessment fund would pay for the abatement amount.
