CC SUM 2015 11 23 CHANHASSEN CITY COUNCIL REGULAR MEETING SUMMARY MINUTES NOVEMBER 23, 2015 Mayor Laufenburger called the City Council meeting to order at 7:05 p.m. The meeting was opened with the Pledge to the Flag led by Boy Scout Nathan Fine from Excelsior Boy Scout Troop 409. Todd Gerhardt noted that item H(1), Gateway Medical Center had been tabled per the applicant’s request. CONSENT AGENDA: Councilwoman Tjornhom moved, Councilman McDonald seconded to approve the following consent agenda items pursuant to the City Manager’s recommendations: 1. Approve City Council Minutes dated November 9, 2015 2. Receive Planning Commission Minutes dated November 17, 2015 City Council Summary – November 23, 2015 Resolution #2015-71: 3. Approve Resolution Certifying Water Hookup Charges Resolution #2015-72: 4. 2015 Street Improvement Project (Carver Beach Area): Approve Assessment Abatement for PIDS 251600290, 251601730, 251601810, and 251601900 Resolution #2015-73: 5. City Project 16-04, Park Road Resurfacing and Culvert Replacement: Approve Consultant Contract and Authorize Preparation of Feasibility Study All voted in favor and the motion carried unanimously with a vote of 5 to 0. VISITOR PRESENTATIONS: PRESENTATION OF $10,000 TO THE FIREFIGHTER MEMORIAL FUND, CHARTER BANK. Chief Don Johnson introduced Committee Chairman Doug Foote and Steve White, Market President with Charter Bank who presented a $10,000 donation to the Firefighter Memorial Fund. LAW ENFORCEMENT/FIRE DEPARTMENT UPDATE. Lt. Eric Kittelson noted that th beginning Wednesday, November 25 and running through New Year’s Day the Carver County Sheriff’s office will be included in the Towards Zero Death Impaired Driving enforcement initiative before reviewing the statistics for October. Chief Don Johnson provided updates on staffing, calls for service, and training for the month of October. In discussing other activities he reviewed changes that will be made next year with the medical response team during Chanhassen High School football games, fire prevention week activities, and cautioned people who deep fry their turkeys. PUBLIC HEARING: CONSIDER RESOLUTION VACATING DRAINAGE AND UTILITY EASEMENTS IN CONJUNCTION WITH A LOT LINE ADJUSTMENT, 6270 TH AND 6280 CHASKA ROAD, LOT 1, BLOCK 1 AND LOT 2, BLOCK 2 FRETHAM 15 ADDITION, APPLICANT: DAVID WEEKLEY HOMES. Paul Oehme presented the staff report on this item. Mayor Laufenburger opened the public hearing. No one spoke and the public hearing was closed. Resolution #2015-74: Councilman McDonald moved, Councilwoman Tjornhom seconded that the Chanhassen City Council adopts a resolution approving the vacation of all the drainage and utility easements on the property line between Lots 1 and 2, Block 1, Fretham th 15 Addition. All voted in favor and the motion carried unanimously with a vote of 5 to 0. PUBLIC HEARING: CONSIDER APPROVAL OF EAW AND OFFICIAL MAP, TH 101 (PIONEER TRAIL TO CR 61). 2 City Council Summary – November 23, 2015 Paul Oehme presented the staff report on this item before introducing Jon Horn with Kimley- Horn and Associates who reviewed background information, the preliminary design process, the alternatives that were considered, how a preferred alignment alternative was picked, the Environmental Assessment Worksheet, and right-of-way acquisition. Councilman Campion asked about detour routes during construction and clarification on the negative declaration of the EAW. Mayor Laufenburger opened the public hearing. Kevin Nielsen, 740 Vogelsberg Trail asked council to consider that a home is more than just a house and the cost of the retaining walls to route the road in another alignment. Kevin Nielsen’s fiancée Colleen Jensen stated she hasn’t seen any personal studies on the impact of taking out the 4 homes on the Vogelsberg Trail cul- de-sac and asked that the council do everything in their power to save their neighborhood. Julie Welsh, 2700 Santee Trail, Prior Lake, speaking on behalf of her mother Helen Link and her property, asked for clarification on utility assessments. Dave Kirkbride, 2080 Boulder Road asked for clarification of the official mapping process. Maryanne White, 670 Creekwood Drive explained that she is not in favor of the road alignment that will take out her septic system and approximately an acre of her yard. Don Halla asked that utilities be extended to the lift station at th 96 Street and discussed the loss of the septic system and trees on his daughter, Maryanne White’s property. City Manager Gerhardt asked the City Attorney Knutson to give his opinion on the effects of the official mapping process. James Sabinski, 775 Creekwood asked if there has been consideration of a traffic signal at Highway 101 and Creekwood Drive. Maryanne White concurred that there needs to be a traffic signal at that intersection. Gary Anderson, 725 Creekwood stated he was in favor of installing utilities with the roadway construction of Creekwood to Mandan. Mayor Laufenburger closed the public hearing. After comments and discussion from council members the following motions were made. Resolution #2015-75: Councilman McDonald moved, Councilman Campion seconded that the City Council approves the EAW for the TH 101 Improvements, CSAH 14 to CSAH 61, City Project No. 14-08, and makes a negative declaration on the need for an EIS. All voted in favor and the motion carried unanimously with a vote of 5 to 0. Councilman McDonald moved, Councilman Campion seconded that the City Council approves the ordinance adopting the official map for the TH 101 Improvements, CSAH 14 to CSAH 61, City Project No. 14-08. All voted in favor and the motion carried unanimously with a vote of 5 to 0. ADMINISTRATIVE PRESENTATIONS. Todd Gerhardt provided details for the Highway th 101 bridge opening ceremony being held Tuesday, November 24 and the Truth in Taxation hearing being held on Monday, December 7th. COUNCIL PRESENTATIONS. None. CORRESPONDENCE DISCUSSION. None. 3 City Council Summary – November 23, 2015 Councilwoman Tjornhom moved, Councilwoman Ryan seconded to adjourn the meeting.
