TO: Paul Oehme, City Engineer '\ r FROM: Alyson Morris, Assistant City Engineero,~ DATE: July 15,2005 o~{A SUBJ: Vacation of Drainage and Utility Easements Lots 8 and 9, Block 2, Walnut Grove Vacation File No. 05-02 Steven and Cammie Lillehaug, 7571 Walnut Curve, Lot 8, Block 2, Walnut Grove, request a drainage and utility easement vacation for the sideyard between Lots 8 and 9, Block 2, Walnut Grove. The easement vacation request is in conjunction with the lot split and combination proposal to eliminate the structural encroachment onto Lot 9, which is vacant. The proposed lot split and combination will also bring the home on Lot 8 into conformance with the sideyard setback requirement. The proposed lot division and combination will create Parcels A and B. The existing house will be within Parcel B. The existing lO-foot wide drainage and utility easement over the storm sewer pipe on the west side of Parcel A will remain. A five-foot wide sideyard drainage and utility easement must be dedicated along the east side of Parcel A and along the west side of Parcel B. The proposed lot division/combination drawing must be revised in the northwest comer of Parcel B to reflect this requirement. There is no evidence of any public or private utilities within the proposed easement vacation area. Any proposed house on Parcel A must meet the minimum setback and all other pertinent requirements stipulated in the Zoning Ordinance. Staff recommends approval of the easement vacation.
