CC SUM 2016 03 28 CHANHASSEN CITY COUNCIL REGULAR MEETING SUMMARY MINUTES MARCH 28, 2016 Mayor Laufenburger called the meeting to order at 7:00 p.m. The meeting was opened with the Pledge to the Flag. COUNCIL MEMBERS PRESENT: Mayor Laufenburger, Councilman McDonald, and Councilwoman Tjornhom COUNCIL MEMBERS ABSENT: Councilwoman Ryan, and Councilman Campion STAFF PRESENT: Todd Gerhardt, Chelsea Petersen, Kate Aanenson and Roger Knutson PUBLIC PRESENT: Nancy Link 6285 Ridge Road Martin Nyman 6341 Fox Path Jerome Barnes 6320 Fox Path Jack Fess 6280 Ridge Road Deanne Sheeley 6280 Ridge Road PUBLIC ANNOUNCEMENTS: None. CONSENT AGENDA:Councilwoman Tjornhom moved, Councilman McDonald seconded to approve the following consent agenda items pursuant to the City Manager’s recommendations: 1. Approve City Council Minutes dated March 14, 2016 2. Receive Planning Commission Minutes dated March 15, 2016 3. 2016 Street Improvements Project 16-01: Call Assessment Hearing Resolution #2016-28: 4. 2016 Mill and Overlay Project 16-05: Approve Joint Powers Agreement with the City of Victoria 5. Approval of 2016 Liquor License Renewals. 6. Approve Purchase of Two Dell Network Servers All voted in favor and the motion carried unanimously with a vote of 3 to 0. City Council Summary – March 28, 2016 VISITOR PRESENTATIONS. None. LAW ENFORCEMENT/FIRE DEPARTMENT UPDATE. Lt. Eric Kittelson reviewed the calls for service numbers for February, 2016, informed the th council that the Carver County Sheriff’s Office will join 300 agencies statewide from April 11 to the 17th to do enhanced enforcement and education of distracted driving, and discussed details of the new crime reporting system. Mayor Laufenburger asked about the work load associated with the new reporting system. Councilwoman Tjornhom asked why the State of Minnesota is the last state to adopt this reporting system. Chief Don Johnson provided updates on staffing, calls for service, training, invited council members to attend the ground breaking for the fire th fighters memorial on Monday, May 9, and noted that the Chanhassen Lions are hosting a rd pancake breakfast at Fire Station 1 on Sunday, April 3. Mayor Laufenburger asked about response times. Councilwoman Tjornhom commented on the association meeting she attended. 6285 RIDGE ROAD, PLANNING CASE 2016-05: REQUEST FOR AN INTERIM USE PERMIT TO PERMIT CONSTRUCTION OF A STABLE ON 1.74 ACRES OF PROPERTY ZONED RESIDENTIAL SINGLE FAMILY (RSF) AND LOCATED AT 6285 RIDGE ROAD (LOT 1, BLOCK 1, MEYER’S ADDITION). OWNER: NANCY LINK. Kate Aanenson presented the staff report and Planning Commission update on this item. Councilman McDonald asked for clarification of the pool and stable fencing, the code allowing up to 2 regular sized horses, and use of the second access onto Pleasant View Road. Mayor Laufenburger asked for clarification of the standards for approving or denying the interim use permit and standards in Section 5 regarding horses. Councilman McDonald asked staff to evaluate the minimum standards for having livestock in residential areas. The applicant Nancy Link addressed issues regarding runoff, utilities to the stable, and hay delivery. After comments and discussion from council members the following motion was made. Mayor Laufenburger moved, Councilwoman Tjornhom seconded that the Chanhassen City Council approves the Interim Use Permit to permit a private stable subject to the following conditions and adopts the Findings of Fact: 1. A building permit is required. If the proposed construction is to be of a “pole-type” building, a signed structural engineer’s design is required. 2. The applicant shall submit a tree removal plan in conjunction with the building permit application. 3. The applicant shall preserve any significant, healthy trees within the rear yard. 2 City Council Summary – March 28, 2016 4. The applicant shall meet the requirements of City Code Article III, Section 5, Horses. 5. The interim use permit shall end with any of the following occurrences: 1) sale of the property, 2) subdivision of the property or alteration of the property lines or, 3) widening of Pleasant View Road which takes additional right-of-way from the parcel. 6. Inspection of the stable and corral prior to occupancy by the miniature horse. 7. All feed, hay and all materials important to the care of the animal be stored inside the stable. 8. Water and electricity be made available to the miniature horse at the stable year round. 9. There will be prompt and timely removal of accumulated manure and waste. 10. There will be restrictions placed on the use of the temporary gate on Pleasant View Road. 11. This interim use permit is for a single horse, type miniature. All voted in favor and the motion carried unanimously with a vote of 3 to 0. APPOINTMENTS TO SENIOR AND ENVIRONMENTAL COMMISSIONS. Mayor Laufenburger moved, Councilman McDonald seconded to make the following appointments to the Senior Commission: Jean Mancini, Jackie Engel, and Cheryl Ayotte to 3 year terms. To the Environmental Commission the following appointments: Wayne Benbow to a 3 year term; Bill Chappell and Charlotte Chappell to a 2 year term; and Balakrishna Chintaginjala to a 1 year term. All voted in favor and the motion carried unanimously with a vote of 3 to 0. ADMINISTRATIVE PRESENTATIONS. Todd Gerhardt thanked city staff, the Park and Recreation Commission and all the volunteers th that helped with the Easter Egg Candy Hunt on March 26 and noted an upcoming meeting with Senator Ortman to discuss introducing special legislation for the reconstruction of Highway 101 between Flying Cloud Drive and Pioneer Trail. Representative Hoppe has already voiced his support. COUNCIL PRESENTATIONS. Councilman McDonald discussed the growth and that the IRS has bestowed the tax free status as a 501c3 charitable organization to the Chanhassen Beyond the Yellow Ribbon. Councilwoman 3 City Council Summary – March 28, 2016 Tjornhom noted the Carver Scott Veterans Resource Fair being held on Saturday, April 2nd from noon to 4:00 p.m. at the Chaska Curling and Event Center. Councilwoman Tjornhom moved, Councilman McDonald seconded to adjourn the meeting. All voted in favor and the motion carried unanimously with a vote of 3 to 0.
