Benson, City Engineer ~ FROM: DATE: December 7, 1998 SUBJ: Authorize Preparation of Feasibility Study for Lake Drive West Street and Utility Improvements (Powers Boulevard to Audubon Road) - Project No. 98-16 The City of Chanhassen has received a petition from Mr. Mark Undestad of Eden Trace Corporation and Redmond Products, Inc. to construct Lake Drive West from Powers Boulevard to Audubon Road. The Lake Drive West alignment goes through Outlot D, Chanhassen Lakes Business Park. Eden Trace Corporation plans to develop Outlot D and is in the process of obtaining necessary governmental approvals. A feasibility study was completed in 1990 by BRW, Inc. for the construction of Lake Drive West from Powers Boulevard to Audubon Road. However, the project did not proceed beyond the feasibility study. Significant changes to City specifications and standard detail plates have occurred since 1990. The City of Chanhassen installed trunk sanitary sewer improvements through the Upper Bluff Creek District, Sanitary Sewer Improvement Project No. 91-17A. Additionally, Powers Boulevard has been reconstructed to an urban four-lane section with a street return provided at the Lake Drive West touchdown point. In order to meet the requirements of State Statute 429, a new feasibility report must be prepared for the project. This feasibility report will establish the feasibility of constructing Lake Drive West, determine preliminary design of the utility and street improvements, estimate the cost of the improvements and determine financing alternatives including establishment of a special assessment roll against benefiting properties in accordance with the provisions of Minnesota Statute 429. The major project work elements include construction of a collector roadway section, storm sewer and ponding, trunk watermain, street lighting, trail and landscaping. In accordance with City policy on similar petitioned projects in the past, it is recommended that the petitioning property owner be required to secure the cost of preparing the feasibility study. If the project is ordered, the security amount will be applied toward the special assessments against the property. At the request of the petitioners, the total cost for conducting the feasibility study will be the responsibility of Eden Trace Corporation. Both BRW, the consulting firm which y of C!](mhassell. A great place to live, work, and pUt} Don Ashworth December 7, 1998 Page 2 prepared the original feasibility report for Project No. 90-01, and Bonestroo and Associates, the fIrm responsible for City Project No. 91-17A, along with four other consulting finns, were requested to provide quotes for conducting the feasibility study. The low quote in the amount of $4,410 was submitted by Bonestroo and Associates. The remaining five quotes ranged from $4,965 to $14,000 for conducting the feasibility study. June, 2000 The construction of Lake Drive West from Powers Boulevard to Audubon Road through Outlot D, Chanhassen Lakes Business Park will complete the City's south frontage road system. It is designated as a collector roadway in the City's comprehensive transportation plan and is a Municipal State Aid Route. It is also identifIed in the City's Capital Investment Plan as a 1999 project. Staff recommends that the City Council authorize the consulting engineering fIrm of Bonestroo, Rosene, Anderlik & Associates to prepare the feasibility study for the construction of Lake Drive West Street and Utility Improvements (powers Boulevard to Audubon Road), Project No. 98-16 for a lump sum fee of $4,410. Bonestroo, Rosene, Anderlik, and Associates has been working with the City since 1989 . We have established a team of professionals dedicated to serving Chanhassen. In establishing a team for Chanhassen, we have become familiar with the standards, needs, and requirements of the City. We have also been able to provide the City with a consistent, high quality, product. We can complete a Feasibility Study for Lake Drive West in accordance with your November 18, 1998 letter for a lump sum fee of $4,410. This fee will include preparation of a report similar to the report for Project 97-1. The fee will also include attending the meetings outlined in your letter. We are familiar with the site having completed the sanitary sewer design through the site as part of Project 91-17 A. There are several design considerations including drainage, wetlands, and park property that will have to be evaluated. We will be able to accommodate an accelerated schedule for the Feasibility Report if necessary. Feel free to contact me if you have any questions or require any additional information. Upon execution of this Agreement, ETC shall pay to the City $4,410.00 to fund preparation of the feasibility report for the Project. 3. If the City awards bids for the project, the payment described above shall be applied toward payment of the special assessments for the Project on the land owned by the party making the payment. ("Redmond") and Eden Trace Corporation ("Eden Trace"), have entered into a Purchase Agreement dated September 25, 1998, pursuant to which Redmond has agreed to sell to Eden Trace and Eden Trace has agreed to purchase from Redmond, the above-referenced property. Eden Trace plans to develop the property and is in the process of attempting to obtain necessary governmental approvals, including certain approvals from the City of Chanhassen. Sometime ago, in connection with development plans which Redmond then had for the property, the City of Chanhassen undertook and completed a feasibility study with respect to the extension of Lake Drive to the property. The purpose of this letter is to formally request the City of Chanhassen to obtain and provide an updated feasibility study with respect to the extension of Lake Drive to the property. It is our understanding that prior to undertaking the study the City will provide us with an estimate of the cost of updating this study and will require that funds be placed in escrow with the City or a third party acceptable to the City to cover such estimated costs. Eden Trace will be responsible for escrowing such funds and paying such costs, and throughout the process the person whom you should contact concerning such costs or any other aspects of the study is Mark Undestad, the President of Eden Trace.
