An Ordinance Amending Chapter 9 of the
Chanhassen City Code Concerning the Fire
Code
I believe that Fire Inspector Greg Hayes set forth this "housekeeping issue" well
in recommending that the City Council adopt the 1997 Uniform Fire Code. I
commend Greg for identifying this need and pursuing it.
RECOMMENDA nON:
It is the recommendation of staff that the Council adopt this ordinance.

SUBJ:
An ordinance amending Chapter 9 of the Chanhassen City Code
concerning the fire code.
Attached is a copy of the proposed amendment to the Uniform Fire Code referenced
in the Fire Prevention Section of the Chanhassen City Code. Upon reviewing our
city code, I found that our adoption of the 1988 Fire Code was an old reference, and
for the past five years we have actually been using the 1991 Fire Code. The State
Fire Marshal's office just adopted the 1998 Uniform Fire Code, and I recommend
that we adopt the same fire code. I have been working with Roger Knutson, the City
Attorney, on this project, and he drew up the draft copies which are attached for your
review. I would like to get these copies to City Council for approval as soon as
possible, in order to ward off any conflicts between codes.

THE CITY COUNCIL OF THE CITY OF CHANHASSEN ORDAINS:
SECTION 1. Section 9-43 of the Chanhassen City Code is amended to read:
Sec. 9-43. Technical standards-Adopted.
The 1998 Minnesota Uniform Fire Code is adopted by reference.
SECTION 2. This ordinance shall be effective immediately upon its passage and
publication.

THE CITY COUNCIL OF THE CITY OF CHANHASSEN ORDAINS:
SECTION 1. Section 9-42 of the Chanhassen City Code is amended to read:
Sec. 9-42. Interpretation.
Whenever any part of this article conflicts with the Minnesota Uniform Building
Code, or are less restrictive than the Minnesota Uniform Fire Code, the Minnesota
Uniform Building Code and the Minnesota Uniform Fire Code, whichever is applicable,
shall prevail.
SECTION 2. Section 9-43 of the Chanhassen City Code is amended to read:
Sec. 9-43. Technical standards-Adopted.
The 1998 Minnesota Uniform Fire Code is adopted by reference.
SECTION 3. Section 9-44 of the Chanhassen City Code is deleted.
SECTION 4. Section 9-48 of the Chanhassen City Code is amended to read:
Sec. 9-48. Storage of liquified petroleum gases.
(a) The limits referred to in Section 82 of the Uniform Fire Code, in which
the storage of liquified petroleum gas is restricted are hereby amended to read aggregate
capacities of thirty thousand (30,000) gallons water capacity.
(b) Where a single container or the aggregate of interconnected containers is
two hundred fifty (250) or more gallons water capacity, the installer shall obtain a permit
from the Bureau of Fire Protection.

(c) All single-container installations with a total water storage capacity of two
thousand (2,000) gallons or greater, or where the aggregate of inter connected containers
is greater than two thousand (2,000) gallons shall be protected by one (1) or more of the
following methods:
(1) Buried in an approved manner.
(2) Mounded in an approved manner.
(3) Protected by an approved water application system.
(4) Protected by other approved means.
SECTION 5. Section 9-49 of the Chanhassen City Code is amended to read:
Sec. 9-49. Storage of explosives and blasting agents.
The limits referred to in Section 77 of the Uniform Fire Code, in which the
storage of explosives or blasting agents is prohibited are hereby established as within the
boundaries of the city, except under special permit by the fire marshall.
SECTION 6. This ordinance shall be effective immediately upon its passage and
publication.
