Approve Addendum "An to Development Contract/PUD Agreement to
Expand Grading Limits for Springfield 2nd Addition
Project No. 97-20
The developer. Lundgren Bros. Construction, Inc., has requested to proceed with site
grading of future phases of Springfield (Outlot J, Springfield 2nd Addition).
Construction of Springfield 2nd and 3rd Additions have been completed with the
exception of the final lift of asphalt which is required next year. The developer is
requesting approval of the site grading and related drainage improvements this year to
allow for the soils to settle and prepare the site for next year's street and utility
improvements. The proposed grading will complete the site grading for all remaining
phases.
The attached Addendum "An to the Development Contract/PUD Agreement for
Springfield 2nd Addition was prepared by staff to expand the grading limits for
Springfield 2nd Addition to include the remaining development. The conditions of
approval from the construction plan and specification review process have been listed
under the special conditions. Staff has calculated the required [mancial security to
guarantee compliance with the terms of Addendum "An at $53,350.00 and the
administration fees total $3,957.00.
The developer has submitted a detailed grading, drainage, and erosion control plan for
staff review and City Council approval. Staff has reviewed the grading. drainage, and
erosion control plans and has found that it is consistent with the preliminary approved
grading plan for the development. There are a few modifications that will be
incorporated into the plans prior to the preconstruction meeting. Those modifications

the form of a cash escrow or letter of credit in the amount of $53,350.00 and
pay an administration fee of $3,957.00.
2. The grading plans shall be signed by a registered professional engineer.
3. The gr~ding plans shall be revised to include the following items:
a. Temporary sediment basins and outlet pipes shall be installed at the
following locations:
1. At low point just south of Lyman Boulevard on Sutnmerfield Drive.
2. At the end of Greenview Drive where it meets the existing pavement.
3. At the east end of Summerfield Drive.
b. Rock construction entrances shall be provided and maintained at the
intersection of Lyman Boulevard and Summerfield Road and at the end of
Greenview Drive.
c. The height of the berm south of Pond No. 1 shall be increased from 904 to
905. The emergency overflow elevation for Pond No. 1 shall increase from
904 to 904.5. A cross-section of the riprap overflow shall also be provided.
The riprap overflow shall bea. minimum of four feet wide across the top.
d. Protect all existing catch basins with silt fence and/or rock filter dikes.
e.Revise north pond outlet control structure. Use City Detail. Plate No.
3109. .
4. The applicant shall receive and comply with all pertinent agency permits, Le.
Watershed District, MPCA, Williams Brothers Pipeline Company.
5. All disturbed areas as a result of site grading shall be immediately restored with
seed and disc mulch or wooQ fiber blanket within two weeks after site grading
is completed. or before November .15 each constrUction season. All disturbed
areas resulting from construction activities shall.be restored in accordance with
the City's Best Management Practice Handbook for erosion and sediment
control.
6. Access to the site sh~ be limited to Lyman Boulevard, Springfield Drive
and/or Sunnyvale Drive. Access to the site from Kiowa Trail and Trunk
Highway 101 shall be prohibited.

TO SPRINGFIELD 2ND ADDITION
DEVELOPMENT CONTRACT/PUD AGREEMENT
SPECIAL PROVISIONS
AGREEMENTS dated July 27,1998, by and between the CITY OF CHANHASSEN, a
Minnesota municipal corporation ("City"), and LUNDGREN BROS. CONSTRUCTION, INC., a
Minnesota corporation (the "Developer").
1. BACKGROUND. The parties have previously entered into a development contract/PUD
agreement for Springfield 2nd Addition dated March 23, 1998 (the "Development Contract"). The
Development Contract was recorded on April 20, 1998 as Carver County Abstract Document No.
22568 land on April 20, 1998 as Carver County Torrens Document No. T101262. The developer is
now requesting to expand the grading limits to complete site grading for the remaining development
under the Development Contract for Springfield 2nd Addition.

2. EXTENSION OF DEVELOPMENT CONTRACT. The Development Contract shall
remain in full force and effect with the modifications listed in the special conditions below.
3. SPECIAL CONDITIONS. In addition to the terms and conditions outlined in the
development contract/PUD agreement, the following amendments shall apply:
a) Plan "BOO Grading, Drainage and Erosion Control Plans dated August 27, 1997,
revised September 22, 1997, shall also include the Grading, Drainage and Erosion Control plans titled
Springfield Mass Grading dated July 17, 1998, prepared by Pioneer Engineering.
b) Access to the site shall be limited to Lyman Boulevard, Springfield Drive and/or
Sunnyvale Drive. Access to the site from Kiowa Trail and Trunk Highway 10 1 shall be prohibited.
c) The temporary and permanent storm water ponds and associated storm sewer pipe
shall be constructed prior to grading the rest of the site.
d) Development Signs. The Developer shall post a six foot by eight foot development
sign at each entrance to the project. The sign shall be in place before construction of the required
improvements commences and shall be removed when the required improvements are completed.
The signs shall contain the following information: project name, name of developer, developer's
telephone number and designated contact person, allowed construction hours.
e) All disturbed areas as a result of site grading shall be immediately restored with seed
and disc mulch or wood fiber blanket within two weeks after site grading is completed or before
November 15 each construction season. All disturbed areas resulting from construction activities
shall be restored in accordance with the City's Best Management Practice Handbook for erosion and
sediment control.

4. RECORDING. The Development Contract and this Addendum "A" shall be recorded
against all lots and blocks and outlots in Springfield 2nd Addition.
