MEMORANDUM TO: Anita Benson, City Engineer FROM: Dave Hempel, Assistant City Engineer ~(' \,\! .' ~~ DATE: October 12, 1998 SUBJ: Request to Vacate Portions of the Drainage and Utility Easement Between Lots 26 and 27, Block 1, Fox Chase - Vacation File No. 98-5 Staff has received a request from the property owner to vacate the existing drainage and utility easement between Lots 26 and 27, Block 1, Fox Ch~se. The request was initiated due to a lot split which will combine the non-buildable parcel (Lot 26) with the adjacent property (Lots 25 and 27, Block 1, Fox Chase). The City received this drainage and utility easement through the platting process of Fox Chase at no cost to the City. The applicant will be dedicating to the City an additional drainage easement over the existing pond on the parcel as part of the subdivision process for Lot 26. There are no utilities of record within this side yard drainage and utility easement; therefore, it is staffs position that it is no longer in the public's interest to maintain. Therefore, it is recommended that the City Council approve the vacation of the drainage and utility easement as denoted on Exhibit A contingent upon the lot split of Lot 26 being combined with Lots 25 and 27, Block 1, Fox Chase.
