Request to Vacate Portions of the Drainage and Utility Easement
Between Lots 26 and 27, Block 1, Fox Chase - Vacation File No.
98-5
Staff has received a request from the property owner to vacate the existing
drainage and utility easement between Lots 26 and 27, Block 1, Fox Ch~se. The
request was initiated due to a lot split which will combine the non-buildable parcel
(Lot 26) with the adjacent property (Lots 25 and 27, Block 1, Fox Chase). The
City received this drainage and utility easement through the platting process of Fox
Chase at no cost to the City. The applicant will be dedicating to the City an
additional drainage easement over the existing pond on the parcel as part of the
subdivision process for Lot 26. There are no utilities of record within this side
yard drainage and utility easement; therefore, it is staffs position that it is no
longer in the public's interest to maintain. Therefore, it is recommended that the
City Council approve the vacation of the drainage and utility easement as denoted
on Exhibit A contingent upon the lot split of Lot 26 being combined with Lots 25
and 27, Block 1, Fox Chase.

NOTICE IS HEREBY GIVEN that the Chanhassen City Council will hold a public
hearing on Monday, October 26, 1998 at 6:30 p.m. in the Council Chambers in Chanhassen City
Hall, 690 City Center Drive. The purpose of this hearing is to consider the application to vacate
the unused portion of the drainage and utility easement between Lots 26 and 27, Block 1, Fox
Chase, Carver County
A plan showing the location of the proposal is available for review at City Hall during
regular business hours.
All interested persons are invited to attend this public hearing and express their opinions
with respect to this proposal.

applicants, Thomas & Sheryl Ebenreiter, are requesting vacation of the drainage and utility easeml
between Lots 26 and 27, Block 1, Fox Chase (6520 and 6530 Fox Path).
What Happens at the Meeting: The purpose of this public hearing is to inform you about the
developer's request and to obtain input from the neighborhood about this project. During the
meeting, the Mayor will lead the public hearing through the following steps:
1. Staff will give an overview of the proposed project.
2. The Developer will present plans on the project.
3. Comments are received from the public.
4. Public hearing is closed and the Council discusses project. The City Council will then
make a decision.
Questions and Comments: If you want to see the plans before the meeting, please stop by City
Hall during office hours, 8:00 a.m. to 4:30 p.m., Monday through Friday. If you wish to talk to

Commencing at the most northerly corner of said Lot 26; thence South 42 degrees
57 minutes 00 seconds East, an assumed bearing along the northeasterly line of said
