Attached is a list of280 delinquent utility accounts, as of October 20th, totaling
$61,786.21. Also attached is a letter from Robert Shumer protesting
responsibility for delinquent utilities of $1 ,032.02 incurred by tenants of rental
property at 6570 Pipewood Curve, owned by Mr. Shumer. I have also included
a section from the City of Chanhassen ordinance where it states, "In the event
any water service is not paid within three (3) months after the time it is rendered,
the city council may recover said amount in an action brought in any court of
competent jurisdiction, or in the alternative, may certify the amount due together
with penalties to the county auditor to be collected with other real estate taxes
levied against the premises served."
It is staffs recommendation that council approve the attached list of 1998
delinquent utility accounts for certification to the county auditor to be collected
with other real estate taxes levied against the premises listed.
Manager's Comments: Property owners really do not like to hear me say that
it is their responsibility to ensure that they understand all of the ramifications of
preparing a rental agreement, but it is true-that is their responsibility.
Determining whether they will get a deposit back or whether a renter needs to
provide a deposit, should be a question that an owner would ask before deciding
whether or not to include that item as the rent or not. In our case, a question as
to, "What will happen ifI rent this property and the renter doesn't pay?" should
be asked. Unfortunately, not all owners think about asking these questions
before they rent and end up in a similar situation as Mr. Schumer.
Unfortunately, state law is clear in that the responsibility for payment lies with
the property owner and that the city's only remedy to ensure collection is the
certification process. [Note: We have occasionally set up a payment plan if this
would benefit the owner.]
Approval of certifying the delinquent list as presented is recommended.

Re: Delinquent Utility Account
This letter is written to appeal a recent bill and notification of delinquent utilities for my
property located at 6570 Pipewood Curve in Chanhassen (Account #331030, PID: 25-
617-00-80). My appeal is based on the fact that the bill was incurred by my tenants, Joan
and Bob Bauman, who lived at the property until approximately the 20th of June. They
left the property shortly before they were to be evicted for non-payment of rent and
damaging the property. Needless to say, they were not very good tenants and had a
terrible payment record. In fact, I have suffered over $10,000 in damages and several
thousands of dollars in lost rent.
It is my belief that the Baumans should be responsible for the debt they incurred since the
water service was registered in their name from July 1997 through June 1998. It does not
seem fair that you should not Qold them liable for the bill they accumulated and the water
and sewer service they used.
I feel it is especially unfair because I never received any notice or indication from the
City that the bill was not being paid. Had I received such a notice, I would have either
attempted to get them to payor would have taken action against them sooner to remove
them from the house. In either event, neither one of us would have allowed them to
accumulate such a large debt.
I fully accept responsibility for any portion of the bill, prior to July 1997 and after June
20, 1998. My past history of payments to the City indicate that I always pay my bills
fully and in a timely manner. I am embarrassed by tenants who did not pay for the water
and sewer service.
After the Baumans left the property, I discovered that they also owed Minnegasco and
Northern States Power substantial amounts of money for gas and electricity service to the
property. Minnegasco did send me a few notices that the tenants were behind in their
payments, and when I called Minnegasco to find out if they were indeed behind, I was
told they were working out the payments on a time plan. I am not sure how much of their
past bills were made up by the Baumans, but I do know that both Minnegasco and NSP
are pursuing collection of back payments from the Baumans and are not holding me liable
for their debt.
Based on this information, I am asking to be treated the same by the City as by the other
utilities, requesting that you recover the unpaid utility bills from the people who actually
used the services. I have always paid my bills owed to the City of Chanhassen in a full
and timely manner, and will continue to do so. I only ask that I not be held liable for
debts incurred by someone else.
Beside my request to be excused from these utility bills, I would also recommend that
you modify existing policies on utility billing to include notification of property owners
when tenants do not pay their debts in a timely manner. It would help property owners to
have a better idea of what their tenants are doing and possibly avoid the abuses of such
irresponsible tenants. It would also help us both to avoid potential losses.
I appreciate your consideration of this important matter. I hope, in your deliberation, that
you will be able to understand the reasons for my appeal and find that there is merit in my
request. Thank you for your time.

(d) In the event any water service charge is not paid within three (3) months after the time >

it is rendered, the city council may recover said amount in an action brought in any court of
competent jurisdiction, or in the alternative. may certify the amount due together with pen- !
alties to the county auditor to be collected with other real estate taxes le~ied against the ,
premises served.
(e) When termination of water service is requested by a consumer. the city clerk shall
direct the water superintendent to turn off the service to the premises involved. The meter
shall be read at that time and a final bill rendered to the consumer. Water service shall not be
restored to the premises except upon the payment of all prior service charges.
(f) In the event a meter is found to have stopped. or to be operating in a faulty manner,
the amount of water used by the consumer shall be estimated, which estimate shall be based
on prior consumption.

ARTICLE m. MUNICIPAL SANITARY SEWAGE DISPOSAL SYSTEM*
Sec. 19-41. Connection required.
(a) The owner of each existing building or structure from which sewage or industrial
waste is drained and which is located on premises adjacent to a sewer of the city sanitary sewer
system, or in a block through or to which the sanitary sewer system extends, or is within one
hundred fllty (150) feet of said sanitary sewer system, shall cause the premises to be connected
with the sanitary sewer system of the city within twelve (12) months after such connection
becomes available to any such premises, unless, in the opinion of the city council after con-
sultation with the city engineer, it is neither feasible nor practical to make such connection.
(b) All buildings and structures constructed within the city after March 11, 1985, on
premises adjacent to a sewer of the city sanitary sewer system, or in a block through or to
which the sanitary sewer system extends, or is within one hundred fifty (150) feet of said
sanitary sewer system, shall be connected to the city sanitary sewer system for the disposal of
sewage or industrial waste.
(c) Any person required by this section to connect premises with the sanitary sewer
system shall cause such connection to be made within thirty (30) days after receipt of written
notice from the city ordering the connection. Service of the notice shall be sufficient if served
personally upon such person or served by certified mail addressed to such person at the
premises.
