A Notice of Hearing was mailed to property owners on the enclosed list on 10/16/98. Chanhassen City Code, Article XXIII, Section 20-904( c) BACKGROUND The home is now located within the recently approved Lake Lucy Estates subdivision and is being moved in conjunction with that development. ANAL YSIS City code requirements. City code requires a moved home to: comply with the Uniform Building Code; be well maintained and in a good state of repair; comply with Chanhassen City Code, Chapter 20; and not materially depreciate surrounding property values. Uniform Building Code. Inspections Division staff inspected the home on 10/15/98. The applicant was given a list of items (enclosed) required to bring the home up to current code. These items will be incorporated into the building, plumbing and HV AC permits that will be required as part of the move. Dwelling Condition. The home, which was built in 1982/83, has been generally well maintained. I have enclosed exterior pictures of the dwelling submitted by the applicant. Chapter 20. The home and proposed accessory structure will meet all setback requirements. The main level ofthe two story home is about 1,076 square feet; the second floor is about 928 square feet. This exceeds the minimum required area for two story homes in Chanhassen. The existing two car garage will be moved with the house. Surrounding Property. Available records show surrounding houses on Powers Blvd. and Lake Lucy Road were built from 1976 to 1981, and are similar to the house being moved. Homes on Mulberry Circle East were built from 1992 to 1994. The Mulberry Circle homes will are to the west of the proposed moved house. Accessory building. The applicant wishes to erect an accessory building on the subject property prior to moving the dwelling on to the property. Storage space in needed for possessions that must be removed from the dwelling prior to the move. Issuance of a moving permit for the Christensen House Move October 26, 1998 Page 3 primary structure permits work to commence on the subject property. Permitting an accessory structure to be place on the property at that time is reasonable since City Code permits construction of accessory structures simultaneously to commencement of construction of the primary structure. A condition that the accessory building be removed if the applicant fails to complete the house move within 12 months of approval will insure an accessory building is not permitted on property without a primary structure. RECOMMENDATION Staff recommends that the City Council adopt the following motion: "House Moving Permit # ID98-010HM is approved subject to the following conditions: 1. The applicant shall obtain building, plumbing and HV AC permits from the Inspections Division prior to moving the dwelling. 2. The applicant shall obtain a road use permit from the city prior to moving the dwelling. 3. A 12' x 12' accessory structure may be constructed on the subject property prior to the house being moved onto the site. The accessory structure must be removed within twelve months of the house moving permit approval if the house move is not complete. 4. The city council may further condition approval upon the applicant furnishing a letter of credit satisfactory to the city sufficient to cover the necessary work to bring the building into compliance.
