SUBJECT: Code Amendment Temporary Events
ISSUE
Numerous sections of the district regulations in City Code reference Section 20-312 for
temporary event guidelines rather than Section 20-964 and temporary events are not currently
allowed in Community Commercial or Industrial Office Park Districts.
BACKGROUND
On October 11th, 2010, City Council passed Ordinance Number 511.1 which amended Section
20-312 "Temporary outdoor sales"relocating its provisions to Section 20-964 "Temporary
outdoor events, seasonal and sidewalk sales activities". The ordinance did not however amend
other provisions in the City Code which referenced section 20-312. As a result, Sections 20-
693(4), 20-713(3), 20-753(3), 20-722(3), and 20-793(3) still refer readers to Section 20-312,
rather than Section 20-964. There is an"Editor's Note" in the code that notes the provisions
previously housed under Section 20-312 can now be found under Section 20-964.
While checking to see which zoning districts contain the above error, it was discovered that
neither the Community Commercial nor Industrial Office Park Districts list temporary outdoor
sales and events as permitted accessory uses. Currently, no area of the city is zoned Community
Commercial,but the 2030 Land Use Plan does have areas guided for that use. If an area were
zoned Community Commercial, temporary events would be a desirable permitted accessory use.
Similarly,temporary events are a desirable permitted accessory use for Industrial Office Park
Districts. Standard practice has been to process and issue temporary event permits for areas
zoned Industrial Office Park in order to allow business to hold company picnics and employee
appreciation events.

RECOMMENDATION
In order to increase the clarity and utility of the City Code, Sections 20-693(4), 20-713(3), 20-
753(3), 20-722(3), and 20-793(3) should be amended to refer to Section 20-964 rather than
Section 20-312. Additionally, Sections 20-743 and 20-813 should be amended to list temporary
events as permitted accessory uses.
