Assessment Hearing for Lake Lucy Road Project No. 98-1
This is the assessment hearing for the Lake Lucy Road Project No. 98-1. The primary
project elements consisted of the construction of the remaining portion of Lake Lucy
Road between Brenden Pond and Woodridge Heights developments, storm sewer
construction and pond excavation and bituminous trail construction. As identified in
the feasibility report, a portion of the project costs are considered to be of benefit and
assessable to the developer of Brenden Pond 3rd Addition. The assessments are based
upon front footage costs consistent with the previous Lake Lucy Road (Phase I)
Project No. 92-12 with a construction cost index (CCI) factor added.
As of the printing of this City Council packet, no written objections to the final
assessment role have been received. The total amount proposed to be asse.s.sed is
$46,766.72. This is based on the front footage as shown on the Brenden Pond 3rd
Addition plat. While the Brenden Pond 3rd Addition final plat has not received final
approval by the Chanhassen City Council, it is recommended that the City Council
adopt this assessment role. Any revisions to the total front footage approved for the
Brenden Pond 3rd Addition plat can be made administratively by staff.
At the close of the public hearing, if there are no relevant questions, comments or
concerns which require further investigation, it is staffs recommendation that the final
assessment role for Lake Lucy Road Project No. 98-1 dated October 30, 1998 be
approved at a term of 8 years and an interest rate of 7.5 % on the unpaid balance.

Dear Anita:
Attached for your approval is the proposed Final Assessment Roll for the Lake Lucy Road
Improvements (98-1). Also attached is a drawing indicating the front frontages. Assessment
methods and applications are consistent' with the information provided by your office and
presented in the Feasibility Report for the project.
The total amount proposed to be assessed is $46,766.72. The total estimated construction cost is
$117,800 including the pond and storm sewer revisions.
Notices for the Public Hearing have been sent to the official paper. Individual notices for the
affected property owners will be mailed next week.
We will be at the November 9, 1998, City Council Meeting and Assessment Hearing to answer
any questions. Feel free to contact me if you require any addition information.

The City Council will hold a public hearing to consider proposed assessments for
Improvement Project No. 98-1 (Lake Lucy Road) on Monday November 9, 1998,
at 6:30 p.m., in the Council Chambers at 690 City Center Drive, Chanhassen,
Minnesota. The area to be assessed includes Outlot B of Brenden Ponds. The
total amount of the proposed assessment revenue is $46,766.72. Your
assessment has been calculated in accordance with the City Council's policy as
follows:

The assessment may be paid in full without interest or other charges within thirty (30) days after
the assessment hearing date. These payments may be made in person or may be mailed to
Chanhassen City Hall, 690 Coulter Drive, P.O. Box 147, Chanhassen, MN 55337, Attention:
Treasurer. Please indicate the parcel number on your check. Partial prepayment of the
assessment is permitted.
If you elect not to pay the full amount within thirty (30) days after the hearing date, the
assessment will be spread over eight (8) years, with installments appearing on your real estate
taxes beginning next year. Interest will be included at the rate of seven and one half (7 1/2)
percent on the unpaid balance.
The proposed assessment roll is on file with the City Clerk. Written and oral objections to the
proposed assessment by any property owner will be considered.
No appeal may be taken as to the amount of any assessment adopted unless a written objection,
signed by the affected property owner, is filed with the City Clerk prior to the assessment hearing
or presented to the presiding officer at the hearing.
All written objections to the assessment not received prior to or at the assessment hearing in the
above matter are waived, unless failure to object prior to or at the assessment hearing is due to a
reasonable cause.
An owner may appeal an assessment to the District Court pursuant to Minnesota Statute section
429.081 by serving notice of the appeal upon the Mayor or City Clerk of the City of Chanhassen
within thirty (30) days after the idoption of the assessment and filing such notice with the District
Court within ten (10) days after derive upon the Mayor or City Clerk.
Residents who are 65 years of age or older, or retired by reason of permanent and total disability,
may apply to have payment of the assessment deferred. The application shall be made to the City
Clerk within thirty (30) days after the adoption of the assessment roll by the City Council.
City staff will be available between the hours of 8:00 a.m. to 4:30 p.m. weekdays until the time of
the pubic hearing to answer questions about the proposed assessments. You may also telephone
City staff at (612)937-1900, extension 106.
You will be notified by mail of any changes adopted by the City Council in interest rates,
prepayment requirements, or the amount of the adopted assessments from those contained in this
notice.
