This is the assessment hearing for three phases of the overall capital improvement
program in the Arboretum Business Park located in the southeast quadrant of Trunk
Highway 5 and Trunk Highway 41 (original Project No. 97-1). The three phases for
the assessment at this time consist of the construction of Century Boulevard Street and
Utilities (97-1A), the construction of Coulter Boulevard east of Century Boulevard
(97-1B-2), and the construction of Coulter Boulevard west of Century Boulevard (97-
ID). The overall project costs for these three phases totals $2,624,909. This is
approximately $79,000 less than the comparable work scope estimated in the
feasibility study dated June, 1997. The total proposed assessable amount is
$2,041,880 which is approximately 2.7% higher than that estimated in the feasibility
study due to a minor revision in the distribution of benefit from the feasibility.
As required by state statute, public notification has been made in the local newspaper
and direct mailing to assessed property owners (see attachments). As of the printing
of this City Council packet, no written objections have been received to this
assessment role. The increase in assessable amount is due to a revised distribution of
benefit; however, the principle assessment/benefit methodology for the feasibility
report has remain unchanged.
The project engineer, Mr. Phil Gravel from Bonestroo & Associates, will be at the
public hearing to provide a presentation of the overall project and special assessment
schedule. At the close of the assessment hearing, if there are no further relevant
questions, comments or concerns which would require further investigation, it is
recommended that the assessment role for the Arboretum Business Park Capital
Improvement Project Nos. 97-1A, 97-1B-2 and 97-1D dated October 8, 1998 be
adopted at a term of 8 years and an interest rate of 7.5%.

Attached for your approval is the proposed Final Assessment Roll for the Arboretum Business
Park Area (Project 97-1). Also attached are drawings indicating the assessable frontages and
areas. Assessment methods and applications are consistent with those presented in the
Feasibility Report for the project. The total amount proposed to be assessed is $2,041,880.-
The proposed assessments are approximately 2.7 percent higher than the estimated amounts in
the Feasibility Report. The increase is the result of higher than expected street construction
costs. The proposed assessment rates are as follows:

ARBORETUM BUSINESS PARK AREA
PROJECT NO. 97-1
Notice is hereby given that the Chanhassen City Council will meet at 6:30 p.m. on Monday,
November 9, 1998, at the City Hall Council Chambers to pass upon the proposed assessments for
Arboretum Business Park Area Improvement Project No. 97-1. Abutting properties and those
properties deriving benefits from this project are proposed to be assessed. Specifically, properties
in the N Yz of Section 16, T116, R23, are proposed to be assessed which include:
Lot 1, Block 1, Arboretum Business Park
Outlot C, Arboretum Business Park
Outlot D, Arboretum Business Park
Lot 1, Block 1, Arboretum Business Park 2nd Addition
Lot 2, Block 1, Arboretum Business Park 2nd Addition
Lot 3, Block 1, Arboretum Business Park 2nd Addition
Lot 4, Block 1, Arboretum Business Park 2nd Addition
Lot 1, Block 2, Arboretum Business Park 2nd Addition
Lot 2, Block 2, Arboretum Business Park 2nd Addition
Outlot B, Arboretum Business Park 2nd Addition
Outlot C, Arboretum Business Park 2nd Addition
The proposed assessment roll is on file for public inspection at the office of the City Engineer.
The total amount to be assessed is 52,041,880. Written and oral objections will be considered at
the meeting, but the Council ml:l,y consider any objections to the amount of the proposed
individual assessment and adjourn the meeting upon such further notice to the affected property
owners as it deems advisable.
An owner may appeal an assessment to the District court pursuant to Minnesota Statute 429.081
by serving notice of the appeal upon the Mayor or City Clerk of the City of Chanhassen within 30
days after the adoption of the assessment and filing such notice with the District Court within 10
days after service upon the Mayor or City Clerk. No appeal may be taken as to the amount of any
assessment adopted unless a VlRITTEN NOTICE signed by the affected property owner is filed
with the City Clerk prior to the assessment hearing or presented to the presiding,Officer at the
hearing. . '-
Residents who are 65 years or older, or retired by reason of permanent and total disability, may
apply to have payment of the assessment deferred. The application shall be may to the City Clerk
within 30 days after the adoption of the assessment roll by the City Council.

The assessment may be paid in full without interest or other charges within thirty (30) days after
the assessment hearing date. These payments may be made in person or may be mailed to
Chanhassen City Hall, 690 Coulter Drive, P.O. Box 147, Chanhassen, MN 55337, Attention:
Treasurer. Please indicate the parcel number on your check. Partial prepayment of the
assessment is pennitted.
If you elect not to pay the full amount within thirty (30) days after the hearing date, the
assessment will be spread over eight (8) years, with installments appearing on your real estate
taxes beginning next year. Interest will be included at the rate of seven and one half (7 1/2)
percent on the unpaid balance.
The proposed assessment roll is on file with the City Clerk. Written and oral objections to the
proposed assessment by any property owner will be considered.
No appeal may be taken as to the amount of any assessment adopted unless a written objection,
signed by the affected property owner, is filed with the City Clerk prior to the assessment hearing
or presented to the presiding officer at the hearing.
All written objections to the assessment not received prior to or at the assessment hearing in the
above matter are waived, unless failure to object prior to or at the assessment hearing is due to a
reasonable cause.
An owner may appeal an assessment to the District Court pursuant to Minnesota Statute section
429.081 by serving notice of the appeal upon the Mayor or City Clerk of the City of Chanhassen
within thirty (30) days after the adoption of the assessment and filing such notice with the District
Court within ten (10) days after derive upon the Mayor or City Clerk.

Residents who are 65 years of age or older, or retired by reason of permanent and total disability,
may apply to have payment of the assessment deferred. The application shall be made to the City
Clerk within thirty (30) days after the adoption of the assessment roll by the City Council.
City staff will be available between the hours of 8:00 a.m. to 4:30 p.m. weekdays until the time of
the pubic hearing to answer questions about the proposed assessments. You may also telephone
City staff at (612)937-1900, extension 106.
You will be notified by mail of any changes adopted by the City Council in interest rates,
prepayment requirements, or the amount of the adopted assessments from those contained in this
notice.
