Partial Vacation of a Tree Preservation Easement on Lot 5, Blockl,
Lotus Lake Woods
On August 28, 1995, the City Council approved the final plat (93-10 SUB) to
subdivide 4.47 acres into 7 single family lots, Lotus Lake Woods, as shown in
plans dated received May 15, 1995, with conditions. Some of the parcels have
tree preservation easements.
The site is located west of Frontier Trail. Hestia Homes is requesting a partial
vacation ofa tree preservation easement on Lot 5, Block 1, Lotus Lake Woods.
The designated buildable area on the lot contains soils that require correction.
The applicant wishes to move the house pad to minimize grading and soil
corrections. The proposed house location will not impact any of the trees
proposed to be saved within the easement. Staff is recommending approval of the
partial vacation of the tree preservation easement with the condition that the
applicant submit a legal description for the vacated area as shown on the survey
received October 27, 1998.
STAFF RECOMMENDA nON
Staff recommends the City Council adopt the following motion:
"The City Council approves the partial vacation of the tree preservation easement
with the condition that the applicant submit a legal description for the vacated
area as shown on the survey received October 27, 1998."

Dear Sharmin:
Hestia Homes is asking the City to vacate 2 conservation easements on Lot 5 Block 1 Lotus Lake
Woods. After doing soil borings on the lot, we have determined that most of the ol'iginal building
pad has soils that would require a large oVeJ"sized pad to build on. This original pad design would
disturb trees in the front conservation easement.
It is the recommendation of the engineers that the house follow the hill to minimize the size of the
pad. The attached design does not afTect any trees in the either easement area. We would use
I'etaining walls along the driveway to protect one tree in the front. Two trees not in the easement
would be removed as shown.
