Approval requires a simple majority vote of the City Council. The Chanhassen Farmer's Market recently changed leadership, and with this change, it is a perfect time to update agreements, rules, and regulations. The farmers market has been coordinated and managed by community volunteers since 2004 and has been a popular Saturday morning destination for residents to pick up fresh produce, flowers, and other items. Staff met with the market's co-coordinators Jackie Coulter and Bill Schmidt to update the agreement between the City of Chanhassen and the Chanhassen Farmers Market. These changes also lead to the creation of new rules, regulations, vendor applications, and a map showing where vendors can set up to the sell their products. Farmers Market representatives will coordinate a market Saturday mornings from June 3 through October 14, 2017; 9:00 am— 1:00 pm at City Center Park. 2. All vendors shall be restricted to the area depicted on the site map. 3. No vendor shall be allowed within the right-of-way of Market Boulevard. 4. Each vendor shall comply with all state and local regulations and provide proof of appropriate liability insurance. These documents, or copies thereof, shall be made available upon request. 5. One or both of the co-coordinators of the farmer's market shall be on the premises during weekly set-up, operation, and take-down of the market. 6. The Market shall provide its own barricades to block off and designate the vending area of the Farmers Market. 7. Each vendor shall provide for and remove its own trash. 8. The City of Chanhassen and the Chanhassen Library shall be permitted at various times to display and/or sell various items pertinent to their operations. 9. The Farmer's Market co-coordinators shall submit an annual report to the City Council at the close of each season. 10. The City retains the right to close the Market for any reason with one weeks' notice. 11. The Farmer's Market will be covered under the City of Chanhassen's Comprehensive General Liability insurance policy to cover the Fanner's Market operation. 12. Processors are person or entities offering fresh food products(such as meats, seafood, ciders, baked goods,jams, etc.) that have added value to their product through some sort of"hands-on" processing (e.g., smoked or butcher meats, handmade candies, etc.). All processors' permits and licenses shall be displayed whenever a processor is selling at the Chanhassen Farmers' Market. Processors must produce their products in Minnesota or be Minnesota based. Processed food products should use ingredients from Minnesota farms as much as possible.The Chanhassen Farmers' Market shall give stall preference to processors using ingredients from Minnesota farms or waters. These include raw agricultural products that have been processed by the vendor, or any product, the sale of which a government agency regulates. Examples are milk, cheese, oils, vinegars, meats, poultry, eggs, honey, soap, and herbal preparations.Agricultural products licensed, inspected or otherwise regulated by the federal government,the State of Minnesota, Carver County, or the City of Chanhassen may be sold only upon the Farmer's Market's receipt and acceptance of required documentation of compliance with all regulations. When selecting prepared food vendors, the Chanhassen Farmer's Market will encourage vendors to provide a good variety of healthy goods, and will give preferences to vendors using ingredients produced in Minnesota. Certain vendors may be restricted due to contractual obligations of the farmers' market. Limited stalls with access to electricity and room for vehicles are available. Returning vendors must return application and pay full fee by April, 30th, 2017 to reserve a stall as well as product exclusivity. Stall spaces for full-season vendors will be reserved for the full season. Weekly vendors must pay at least one week in advance to reserve a stall space.The Market Manager will assign stall spaces for all vendors. For safety reasons the designated parking lot area for the market will be closed to ALL traffic starting at 9:00 am through 1:00 pm. Early take-down and departure before closing time will not be allowed. Exceptions may be made in case of emergency—please see the Market Manager. No sales should be made prior to 9:00 am. Each vendor will be given a sign promoting the Farmer's Market that they will be responsible for the season. The vendor will also be provided with a location with-in the city where they will need to drop off the sign at on their way to the market and pick-up the same sign as they leave the market every Saturday. If a vendor forgets to pick-up their sign on their way home,they must notify the Market Manager immediately so that alternate arrangements can be made to retrieve the sign. Rules and Regulations Miscellaneous/Appearance and Conduct: 1. Vendors will be neat, suitably dressed (shirt and shoes), and deal with the public and fellow vendors in a courteous and appropriate manner at all times. 2. All vendors will display their products neatly and attractively, with consideration for the other vendors and public. 3. Vendors are responsible for their own stalls, will supply all necessary trash containers, and will leave their site clean and in a condition suitable to the Market Manager and the City of Chanhassen. Each member will remove containers, waste, and trimmings before leaving the market. 4. Vendors will in no way cause detriment to other vendors. 5. No rummage sale, second hand, or flea market type items may be sold. 6. Space dimensions must be respected. Do not block the view of other vendors, the flow of traffic, or encroach on areas assigned to other vendors. 7. Alcoholic beverages may not be sold, consumed, or advertised at the market. 8. Vendors are required to post an identification sign in a prominent place stating the vendor name, product, and area they are from. 9. All vendors are expected to clean up in and around their stall after usage.This includes the parking lot. 11. All stall fees are due in advance. 12. No smoking will be allowed with-in the area designated for the market. Membership • Membership fee is included in stall fees. By becoming a member, the vendor agrees to the terms of the Rules and Regulations and the Bylaws of the Chanhassen Farmers' Market. • All vendors need to provide their own insurance. • As condition of membership, the member agrees to release and hold the Chanhassen Farmers' Market, its directors, officers, agents, and employees harmless from all claims related to or arising from such membership. Chanhassen Farmers' Market reserves the right to prohibit anyone from selling at the Farmers' Market. • Members are expected to comply with any government regulation that may be in effect for activities that take place at the Farmers' Market.These include certification of scales, health rules applicable to samples and food display, statements about being organically grown, eggs, etc. • Food vendors are responsible for providing proper"product liability" insurance. Product liability insurance is necessary because customers may have allergic reactions or illness due to some chemical residue, product-acidity, food spoilage, or other food-safety relate issue. • Compliance with all Health, Fire, and Police Department codes and regulations as well as state Health and Revenue Departments, and the Center for Disease Control codes and regulations is required.These agencies have the final say in any dispute in the operation of the Farmers' Market.These codes and regulations will also apply to the preparation of food on-site including food samples. • Vendors found to be in violation of one or more rules may be suspended from selling at the Farmers' Market. • Anyone who fails to comply with the Rules and Regulations or the Bylaws may have their membership terminated with no refund of dues or fees. The time of the Farmers Market will be 9:00 a.m.tol: ©O p.m., each Saturday. The goal of the Chanhassen Farmers Market is to enhance the Chanhassen area with an excellent farmer's market,offering produce which is locally grown. The farmer's market will be a gathering place for area residents. Our goal is twenty vendors, with the first year likely to be less than that number, at least at the beginning of the season. Each vendor will support the Chanhassen Farmer's Market with membership dues, and an annual or daily fee. Each vendor will provide their own liability insurance and will be required to comply with all applicable rules and codes regarding weights and measures, labeling requirements, or any other regulations which might apply. A member of the Farmer's Market board will be present each morning to insure compliance. The Chanhass6n Farmer's Market is being encouraged by the Chanhassen Chamber of Commerce. A committee of the Chamber has met for months planning this project. The farmer's market will be incorporated as a not-for-profit-corporation. The board of directors of the farmer's market will promote the market, collect the fees, and insure compliance with farmer's market rules and guidelines,to be developed by the board, especially health regulations. The parking lot just north of the park, on Market Blvd.,would be closed for vendors. Vendors would either sell from booths in the landscaped area, or from the back of their vehicles on the south edge of the parking lot. Citizens of the area will benefit by having access to locally grown, farm-fresh produce and the opportunity to interact with the farmer who grows the produce. Farmers markets help to promote good nutrition, wholesome eating habits, and better food preparation. The Chanhassen Farmer's Market will help small farm families in the area,providing direct access to supplement farm income. The farmer's market will be a great benefit to residents. Over time, it will also serve to boost the Chanhassen economy, by increasing buyer traffic downtown. The target date for our opening is May 8, 2004. Park and Rec Summary—January 27, 2004 APPROVAL OF MINUTES: Spizale moved, Robinson seconded to approve the Minutes of the Park and Recreation Commission meeting dated December 16, 2003 as presented. All voted in favor and the motion carried unanimously with a vote of 6 to 0. CHANHASSEN FARMERS MARKET PROPOSAL. Todd Hoffman introduced Jim Bledsaw and David Boorsma from the Farmers Market Committee. Jim Bledsaw corrected the times proposed to 9:00 a.m. to 1:00 p.m. and showed a layout for the booths at City Center Park. David Boorsma talked about his background and work on similar committees in other cities. Commissioner Spizale asked for clarification on the booth set-up. Commissioner O'Shea asked how vendors were recruited. Commissioner Robinson asked how the board will balance the types of vendors. Commissioner Atkins asked how the farmers market would deal with local farmers such as the Klingelhutz and Dimler's who have corn huts in town. She also asked what kind of items could be sold. Todd Hoffman stated staff had included condition number 4 which states that products shall be limited to produce and other food products, flowers and outdoor plant materials. No flea market or art sale items would be allowed, except perhaps on special occasions. He then presented the staff report. Commissioner Atkins asked who would make up the Farmers Market Board. Commissioner Robinson asked how the board was going to handle advertising and promotion. Commissioner O'Shea asked for clarification on parking. Chairman Stolar asked if there was adequate power, adequate parking available, if this would put a drain on city resources, and if vendors would need bonding along with liability insurance. He suggested that the farmers market be incorporated into the 4`h of July celebration. O'Shea moved, Kelly seconded that the Park and Recreation Commission recommend that the City Council approve the Chanhassen Farmers Market proposal for City Center Park with the following conditions: 1. All vendors shall be restricted to the area depicted on the site map. 2. No vendor shall be allowed within that right-of-way of Market Boulevard. 3. Each vendor shall comply with all state and local regulations and provide proof of appropriate liability insurance. These documents or copies thereof shall be posted in a conspicuous location at each booth. 4. Products shall be limited to just produce and other food products, flowers and outdoor plant materials. 5. A member of the farmers market board shall be on the premises during the weekly set-up, operation and take down of the market. 6. Todd Hoffman presented the staff report on this item asking the commission to select a committee to review playground structure replacements at Lake Ann Park and Meadow Green Park and a new structure at Bandimere Park for the 2 to 5 age group. He outlined the review process for selecting a manufacturer and equipment. Chairman Stolar asked for volunteers, excluding himself due to a conflict of interest. Tom Kelly, Jack Spizale and Amy O'Shea volunteered to be on the committee, along with Jim Manders, a former Park and Recreation Commissioner who was asked by staff to be on the committee. Commissioner O'Shea asked if staff will look for neighborhood input. Chairman Stolar suggested asking a volunteer from the homeowners association near Meadow Green Park to be on the selection committee. REVIEW 2004 LAKE ANN BEACH LIFEGUARD CONTRACT, MINNETONKA COMMUNITY EDUCATION AND SERVICES. Jerry Ruegemer provided background information on this contract and pointed out that the 2004 contract price remained the same as 2003. Chairman Stolar asked that staff provide information on the number of lifeguards and actual hours worked during the 2004 season when this item comes back for review next year. Spizale moved, Atkins seconded that the Park and Rec Commission recommend the City Council approve the 2004 Lifeguard Contract for Lake Ann Beach for services provided by Minnetonka Community Education and Services in the amount of $27,555.
